CIRCULAR
Providing regulations on technical safety and environmental protection inspection of road motor vehicles

Pursuant to the Law on Road Traffic dated November 13, 2008;
Pursuant to the Government’s Decree No. 12/2017/ND-CP dated February 10, 2017, defining the functions, tasks, powers and organizational structure of the Ministry of Transport;
At the proposal of the Director of the Department of Science and Technology and the Director General of the Vietnam Register;
The Minister of Transport hereby promulgates the Circular providing regulations on technical safety and environmental protection inspection of road motor vehicles.
Chapter I
GENERAL PROVISIONS
Article 1. Scope of regulation
1. This Circular provides regulations on technical safety and environmental protection inspection of automobiles; trailers and semi-trailers drawn by automobiles (hereinafter referred to as motor vehicles).
2. This Circular does not apply to army and police motor vehicles used for national defense and security purposes.
Article 2. Subjects of application
This Circular applies to organizations and individuals involved in the technical safety and environmental protection inspection of motor vehicles.
Article 3. Interpretation of terms
In this Circular, the terms below are construed as follows:
1. Technical safety and environmental protection inspection (hereinafter referred to as inspection) means the initial and regular inspection and assessment of the motor vehicles’ technical safety and environmental protection compliance with prescribed standards and regulations.
2. Inspection certificate of motor vehicle for compliance with technical safety and environmental protection requirements (hereinafter referred to as inspection certificate) means a document certifying that the motor vehicle has been inspected and satisfies technical safety and environmental protection standards, regulations and provisions.
3. Inspection sticker of motor vehicle for compliance with technical safety and environmental protection requirements (hereinafter referred to as inspection sticker) means a logo granted to a motor vehicle that has been granted with an inspection certificate and is permitted to join road traffic within the territory of the Socialist Republic of Vietnam and countries to which Vietnam has signed mutual recognition agreements on inspection certificates according to the term specified in the inspection sticker.
4. Original motor vehicle means a motor vehicle without any change in its structure, shape, layout, working principles, parameters, and technical specifications of all systems, in comparison with those designed by manufacturer.
5. Vehicle documentation record sheet refers to a recording of administrative information and technical specifications of an original motor vehicle and an update of changes made during the operational period.
6. Inspection record sheet refers to a recording of the result to be obtained and photo of a motor vehicle to be taken after each inspection.
7. Inspection printout refers to blank certificates, inspection stickers and documentation record sheets of vehicles.
8. Vehicle dossier comprises vehicle documentation record sheet and documents relating to administrative information and technical specifications, including changes made during the motor vehicle’s operational period.
9. Inspection dossier comprises documents recording the result obtained in each inspection.
10. Vehicle owner means the owner of the motor vehicle, driver or the person driving the motor vehicle to the inspection place.
11. Inspection Management Program means a software system that í developed by the Vietnam Register to manage the inspection database and motor vehicle inspection activities, and used by inspection centers and the Vietnam Register.
12. Technical materials refer to manufacturers’ documents, competent agencies’ certificates, technical specification handbooks, technical regulations, standards or other technical printouts which have been published and are of definite origin.
Article 4. Prohibited acts in inspection of motor vehicles
1. Conducting inspections with insufficient contents, in contravention of procedures or regulations; conducting inspections outside the inspection lines or inspection centers in contravention of regulations; falsifying the inspection results.
2. Conducting inspections with damaged inspection equipment; conducting inspections with inspection equipment that has not yet been tested, assessed or calibrated.
3. Conducting inspections when failing to ensure the network connection for data or inspection data transmission; conducting inspections with the system of surveillance cameras and video storage fails to satisfy requirements.
4. Arranging insufficient persons to conduct the inspection on the inspection lines, in contravention of regulations.
5. Requesting the vehicle owner to have his/her vehicle repaired or maintained at a designated repair or maintenance facility.
6. Collecting inspection charges and fees in contravention of regulations; committing acts of harassing customers.
7. Conducting inspections and granting inspection certificates for motor vehicles of which the lifetime limits have been reached.
8. Compiling inspection and vehicle dossiers, using inspection printouts, printing inspection certificates or inspection stickers, and reporting inspection results in contravention of regulations.
Chapter II
INSPECTION OF MOTOR VEHICLES
Article 5. Inspection places
1. The compilation of vehicle and inspection dossiers (including the cases of supplementation and amendment of vehicle dossiers) of motor vehicles shall be carried out at any inspection center nationwide.
2. Motor vehicles must be inspected on the inspection lines. Oversize or overmass motor vehicles that cannot be inspected on the inspection lines shall be inspected in terms of working condition and brake efficiency on an off-line test road. Motor vehicles operating in islands without roads for driving to the inspection centers; motor vehicles operating areas in needs to be guaranteed in terms of safety and national security where the conditions for driving the vehicles to inspection centers are not fully met; motor vehicles performing urgent tasks (such as prevention of natural disasters, epidemics) may be inspected outside the inspection centers in accordance with Clause 3 Article 8 of this Circular.
Article 6. Required documents for compilation of vehicle dossiers and inspection
1. Compilation of vehicle dossiers
Vehicle dossiers shall be compiled in their initial inspections for joining traffic (in case of initial inspection for grant of inspection certificates and inspection stickers with a validity period of 15 days, vehicle dossiers shall not be compiled). When driving the motor vehicle to the inspection center for inspection and vehicle dossier compilation, the vehicle owner must produce and submit the following documents:
a) Produce: vehicle registration documents (an original vehicle registration certificate granted by the competent state agency, or a credit institution’s written confirmation of keeping the original vehicle registration certificate of the mortgaged vehicle), or an appointment letter for the grant of the vehicle registration certificate;
b) Submit a copy of the factory quality inspection note, for the domestically manufactured or assembled motor vehicle (except for liquidated motor vehicles);
c) Submit an original inspection certificate of compliance with technical safety and environmental protection requirements, for a newly refurbished motor vehicle.
2. Inspection
When driving the motor vehicle to the inspection center for inspection, the vehicle owner must produce, submit and provide the following documents and information:
a) Documents specified at Points a and c Clause 1 of this Article;
b) Information about username, password and address of the website managing surveillance cameras and tracking devices of motor vehicles subject to tracking device and surveillance camera installation;
c) Make declarations of the transportation business in the dossier monitoring sheet, using the form specified in Appendix I to this Circular.
Article 7. Inspection and assessment of motor vehicles
1. Inspection contents and methods, and defects of motor vehicles undergoing inspection are prescribed in Table 1 Appendix II to this Circular.
2. Defects of a motor vehicle which are detected after the inspection process are classified into 3 levels as follows:
a) Minor defect (MiD) means a damage that does not affect technical safety or cause environmental pollution when the motor vehicle joins in traffic. In such cases, the motor vehicles shall be granted an inspection certificate;
b) Major defect (MaD) means a damage that may affect technical safety or cause environmental pollution when the motor vehicle joins in traffic. In such cases, the motor vehicles shall not be granted an inspection certificate and are required to be repaired for re-inspection;
c) Dangerous defect (DD) means a damage that causes direct and instant dangers when the motor vehicle joins in traffic. In such cases, the motor vehicles shall neither be granted an inspection certificate nor join traffic, and are required to be repaired for re-inspection.
3. If a motor vehicle has many defects with different levels at the same time, it shall be assessed as having defect at the highest level among such defects.
4. If a motor vehicle has many defects at the same level and the combination of such defects may cause more dangers to the vehicle, it shall be assessed as having defect at the next higher level.
5. For a motor vehicle that is re-inspected on the same day as the previous inspection by the same inspection center, the inspection center shall only conduct re-inspection for defect items. Particularly for items relating to brake and drive system, if only one item fails the inspection, the whole driver and brake system shall be re-inspected. In case where the vehicle is re-inspected on another day, or by another inspection center, all items shall be re-inspected.
6. The inspection and assessment of the motor vehicle’s compliance with technical safety and environmental protection requirements shall be conducted by register officers. A motor vehicle may be inspected by one or more assigned register officers. The inspection and assessment of the motor vehicle’s compliance with technical safety and environmental protection requirements shall be conducted in 05 stages. The inspection contents of each stage are specified in Table 2 Appendix II to this Circular, including:
a) Stage 1: Checking identification and general condition;
b) Stage 2: Checking the upper part of the vehicle;
c) Stage 3: Check the effectiveness of braking and traverse;
d) Stage 4: Environmental testing;
dd) Stage 5: Checking the bottom of the vehicle.
7. Motor vehicles entering the inspection must be photographed at the inspection centers. To be specific:
a) Take a photo of the vehicle and a photo of the vehicle's number plate for printing on the inspection record sheet: The photo must show the overall vehicle and its number plate, the motor vehicle image occupies about 75% of the photo area.
b) Take a photo of the motor vehicle to print on the inspection certificate: The photo must be taken at a diagonal angle of about 45 degrees from the rear right in the direction of the vehicle, showing the overall vehicle and its number plate, the motor vehicle image occupies about 75% of the photo area.
c) Take photos of the luggage compartment (cargo hold); take photos of the passenger compartment from the front and back of the vehicle for passenger automobiles with more than 9 seats, including the driver.
d) Clear photo (minimum resolution 1280 x 720), showing the full shooting time in terms of day, month, year, hour and minute of photographing.
8. Register officers shall drive the vehicles themselves during the inspection. For combination of single vehicles (tractors and semi-trailers; uni-body vehicle and trailers), or passenger automobiles of more than 30 seats, if register officers are unable to drive them, they can ask for help from vehicle owners.
Article 8. Order and procedures for implementation
1. Compilation of vehicle dossiers
a) The inspection center shall receive the dossier, check documents in accordance with Clause 1 Article 6 of this Circular, the checking of dossier shall comply with Appendix III to this Circular. If the dossier is incomplete, the inspection center shall guide the vehicle owner to supplement it.
b) The inspection center shall print the vehicle’s technical specifications from the Vietnam Register's import, assembly and manufacture database; inspect the motor vehicle and compare with technical specification prints and documents. For liquidated motor vehicles and motor vehicles with diplomatic number plates of which the information is not included in the Vietnam Register's import, assembly and manufacture database, the inspection center shall comply with Section 3 Appendix IV to this Circular.
c) If the inspection and comparison result is satisfactory, the inspection center shall update the motor vehicle’s technical specifications and administrative information into the Inspection Management Program according to the methods specified Appendix IV to this Circular; print the vehicle documentation record sheet according to the form provided in Appendix V to this Circular. If the result is unsatisfactory, the inspection center shall notify the vehicle owner to remedy.
d) Take 02 overall photos clearly showing the number plate of the motor vehicle (one photo at a diagonal angle of about 45 degrees from the front next to the vehicle and one photo from the back of the opposite corner, the shooting time may be displayed on the photos); take 02 photos (one taken from the front of the vehicle and one taken from the back of the vehicle) of the undercarriage for archiving, for 9-seater passenger automobiles.
2. Conducting inspection at the inspection centers
An organization or individual shall drive its/his/her motor vehicle and documents specified in Clause 2 Article 6 of this Circular to the inspection center for inspection. The inspection center shall receive documents and conduct the inspection according to the procedures specified in Appendix III to this Circular:
a) Receive, inspect and check the warnings, compare the dossier with data on the Inspection Management Program. If the dossier is incomplete, the inspection center shall guide the vehicle owner to supplement. In case the dossier is complete, it shall register the inspection, conduct the inspection and assessment of the vehicle’s compliance with technical safety and environmental protection requirements, and print the inspection record sheet according to the form provided in Appendix VI to this Circular;
b) If the motor vehicle passes the inspection, the inspection center shall grant the inspection certificate and affix the inspection sticker on the vehicle. For a motor vehicle only accompanied with an appointment letter to grant a vehicle registration certificate, the registration center shall issue an appointment letter to grant the inspection certificate to the vehicle owner, using the form provided in Appendix VII to this Circular. When the vehicle owner produces the vehicle registration document, the inspection center shall make a copy of such document to archive in the vehicle and inspection dossiers, and grant the inspection certificate. In case where the motor vehicle is notified failing the inspection on the Vietnam Register's portal, the inspection center shall delete the notice;
c) If the motor vehicle is detected as having defects after inspection, the inspection center shall print and send a notice of defects according to the form provided in Appendix VIII to this Circular to the vehicle owner for remedy and repair. If the vehicle fails the inspection and is not granted an inspection certificate, the inspection center shall update the failing content in the vehicle’s inspection failure warning section on the Vietnam Register’s portal.
3. Conducting inspection outside the inspection centers
a) The vehicle owner shall make a written request according to the form specified in Appendix IX to this Circular, clearly specifying the reason and inspection place (outside the inspection center), attach the list of motor vehicles to be inspected, and send them directly or by post office or other appropriate methods to the inspection center.
b) The inspection center shall check and consider the vehicle owner's request. If the vehicle is eligible for inspection outside the inspection center under Clause 2 Article 5 of this Circular and the testing road satisfies requirements, within 03 working days from the date of receiving the vehicle owner's written request, the inspection center shall send a notice to the vehicle owner of the inspection time. If the testing road fails to meet requirements, a written notice clearly stating the reason shall be sent to the vehicle owner.
c) The vehicle owner shall drive his/her vehicle to the inspection place, the inspection center shall conduct the inspection according to the procedures and methods specified in Clause 2 of this Article.
4. Additionally recording, modifying vehicle dossiers upon changing the vehicles’ information on the vehicle registration documents.
a) The vehicle owner shall bring documents specified at Point a Clause 1 Article 6 of this Circular to the inspection center for change recording.
b) The registration center shall check the documents: If the documents are sufficient, it shall record changes in the vehicle dossier and the Inspection Management Program. If the document is insufficient, it shall guide the vehicle owner to supplement. If the inspection center does not manage the vehicle dossier, it must send copies of the vehicle registration documents bearing its seal to the inspection center managing such dossier for updating and archiving in the vehicle dossier.
5. Additionally recording, modifying vehicle dossiers upon changing the vehicles’ technical specifications.
a) The vehicle owner shall bring the vehicle and documents specified at Points a and c Clause 1 Article 6 of this Circular, and relevant technical materials and documents to the inspection center for inspection and change recording.
b) The registration center shall check the documents, compare them with the information in the Inspection Management Program: If the documents are insufficient, it shall guide the vehicle owner to supplement. If the documents are sufficient, it shall take photos and record additional and modified information into the vehicle dossier and the Inspection Management Program. In case where the center conducting the inspection is not the center managing the vehicle dossier, the inspection center conducting the inspection must send the inspection certificate of refurbished motor vehicle for compliance with technical safety and environmental protection requirements and technical materials relating to the amendment and supplement, and copy of the inspection certificate to the center managing the vehicle dossier for updating and archiving in the vehicle dossier.
6. Procedures for supplementing a number of vehicle dossiers
a) A liquidated motor vehicle of which the information is not included in the import, assembly, manufacture and inspection database must be brought to the inspection center for inspection and vehicle inspection compilation. If it passes the inspection, the inspection center shall issue an appointment letter to grant the inspection certificate to the vehicle owner according to the form specified in Appendix VII to this Circular, affix the inspection sticker for the vehicle, and at the same time, verify the liquidated vehicle's compliance on the vehicle registration database or with the registration agency. If the verification result is inconsistent with the vehicle's actual condition, the registration center shall notify the vehicle owner, at the same time, destroy the compiled vehicle dossier, notify the revocation of the granted inspection sticker, and give warnings on the Vietnam Register's portal. In case the verification result is consistent with the vehicle’s actual condition, the inspection center shall send a notice and grant the inspection certificate to the vehicle owner.
b) In case the motor vehicle is owned by an organization permitted to temporary import for re-export: After compiling the vehicle dossier, the inspection center shall conduct the inspection, grant the inspection certificate and inspection sticker with a validity period not exceeding the one stated on the vehicle registration certificate, and at the same time, send the vehicle information to the Vietnam Register to give warnings on the Inspection Management Program. The inspection center shall conduct initial inspection for the vehicle temporarily imported for re-export, after it is transferred to another organization, agency or individual in Vietnam, and verify the consistency of its information on the vehicle registration database or with the vehicle registration agency, and follow provisions of Point a Clause 6 of this Article.
Chapter III
INSPECTION DOSSIERS, PRINTOUTS AND REPORTS
Article 9. Inspection certificates and inspection stickers
1. Motor vehicles that pass the inspection shall be granted an inspection certificate and inspection sticker according to the forms specified in Appendix X to this Circular.
a) The inspection certificate and inspection sticker granted to a motor vehicle must have the same serial number, be printed from the Inspection Management Program, on the blank certificate issued by the Vietnam Register, with content consistent with the vehicle dossier and data on the Inspection Management Program. Motor vehicles declared by their owners for commercial use shall be granted with an inspection certificate and inspection sticker applicable to commercial motor vehicles. Other motor vehicles declared not for commercial use shall be granted with an inspection certificate and inspection sticker applicable to non-commercial motor vehicles.
b) Motor vehicles not allowed to join road traffic shall only be granted with an inspection certificate, but not an inspection sticker.
c) For motor vehicles with an inspection certificate of imported motor vehicle for compliance with technical safety and environmental protection requirements, or an inspection certificate of assembled automobile for compliance with technical safety and environmental protection requirements, which specifies that it only operates within a narrow scope, and oversize or overmass motor vehicles specified in Circular No. 46/2015/TT-BGTVT, only an inspection certificate with the following information shall be granted (an inspection sticker shall not be granted): “Vehicle must obtain permission form the road administration agency before joining traffic”.
2. The validity period of an inspection certificate and inspection sticker shall comply with the inspection intervals specified in Appendix XI to this Circular, but must not exceed the expiry date of the vehicle registration certificate (if any), or the lifetime limit of the motor vehicle.
3. The following motor vehicles shall be granted with an inspection certificate and inspection sticker with a validity period of 15 days upon passing the inspection:
a) Motor vehicles given warning on the Inspection Management Program under Clause 12 Article 80 of Decree No. 100/2019/ND-CP.
b) Motor vehicles undergoing the process of completing the region changing dossiers; motor vehicles granted with an inspection certificate for refurbished motor vehicle for compliance with technical safety and environmental protection requirements; newly assembled motor vehicles with a factory quality note; imported motor vehicles granted with an inspection certificate for imported motor vehicle for compliance with technical safety and environmental protection requirements, exported motor vehicles granted with an inspection certificate for manufactured or assembled motor vehicle for compliance with technical safety and environmental protection requirements (in case of failing to have such inspection certificate, manufactured or assembled vehicle must obtain the manufacturer's documents) that wish to join traffic to move to the specific locations (documents specified in Article 6 of this Circular are not required to be produced or submitted upon inspection).
c) Motor vehicles wishing to join traffic for research or testing before certifying compliance with technical safety and environmental protection requirements in motor vehicle manufacturing and assembling. In such case, upon inspection, the vehicle owners are not required to produce or submit documents specified in Article 6 of this Circular, however, the following documents must be provided: Design dossiers; documents proving that the vehicle is permitted for a 3,000km test drive in the factory's internal roads; the manufacturer’s written commitments on take responsibility for ensuring technical safety and environmental protection during transport for the purpose of research and testing, including the road route, scope, operation time; technical specification declarations enclosed with the manufacturer’s assembly quality inspection record and notes of the to-be-granted inspection certificate which clearly states that: “Vehicle owner must drive according to the road route, scope, operation time and ensure safety when driving”.
4. Inspection certificate shall be delivered to the vehicle owner for bringing with him/her when joining traffic. Inspection sticker must be affixed on the upper right corner, inside the front windshield of the vehicle; for trailers and semi-trailers, the inspection sticker must be affixed to the chassis, near the number plate mounting position, with a transparent protective layer on the outside.
5. In case the inspection certificate or inspection sticker is lost or damaged, the vehicle owner must have his/her vehicle re-inspected to be granted with an inspection certificate or inspection sticker.
6. When detecting that the dossier is forged, modified or erased by the vehicle owner; the already granted inspection certificate or inspection sticker is non-compliant with the inspected vehicle, the registration center must revoke the inspection certificate or inspection sticker already granted to the motor vehicle (if it still remains valid) and report to the Vietnam Register.
7. The inspection certificate and inspection sticker shall be invalid when:
a) The motor vehicle has been granted with a new inspection certificate and inspection sticker;
b) The vehicle owner has announced the loss of certificate or sticker to the inspection center;
c) The inspection center has notified the revocation of the certificate or sticker;
d) The motor vehicle meets an accident leading to its failure to satisfy technical safety and environmental protection requirements;
dd) The inspection center has confirmed the inconsistency between technical specifications on the inspection certificate and actual specifications of the motor vehicle.
Article 10. Issuance of inspection printouts
1. The inspection center shall make and send the written request for inspection printout (directly or via post office or email) according to the form provided in Appendix XII to this Circular to the Vietnam Register between the 15th and 20th of the last month every quarter.
2. The Vietnam Register shall, based on the inspection center’s demand, send the inspection printout by post office, or issue directly to the inspection center between the 23rd and 30th of the last month every quarter.
3. In case of request for additional issuance, the inspection center shall make and send the written request for additional issuance of inspection printout (directly or via post office or email) according to the form provided in Appendix XII to this Circular to the Vietnam Register. The Vietnam Register shall, based on the inspection center’s demand, send the inspection printout by post office, or issue directly to the inspection center after 15 days from the date of receiving the written request for additional issuance of the inspection printout.
Article 11. Reporting the inspection
1. Reports on inspection results and use of inspection printouts are prescribed as follows:
a) Name of the report: Report on inspection result, and report on the use of inspection printout;
b) Reporting contents: The number of inspected vehicles, including vehicles inspected outside the inspection center (if any), the number of used printouts and the number of unused printouts;
c) Reporting subject: Registration centers;
d) Report-receiving agencies: Vietnam Register shall receive reports on inspection results, reports on the use of inspection printouts and reports on inventory of inspection printouts. Provincial-level Departments of Transport shall receive reports on inspection results;
dd) Methods of sending and receiving reports: Reports shall be sent directly or via post office or email;
e) Deadline: Reports must be submitted before the 20th of every month;
g) Frequency: Reports must be submitted monthly;
h) Period for closing report data: From the 15th of the preceding month to the 14th of the month of the reporting period;
i) Report forms: Made according to Appendix XIII to this Circular.
2. Reports on the list of automobiles of which the lifetime limits have been reached; reports on the list of automobiles of which the lifetime limits are going to be reached:
a) Name of the report: Report on the list of automobiles of which the lifetime limits have been reached; report on the list of automobiles of which the lifetime limits are going to be reached;
b) Reporting contents: Report on the number of automobiles of which the lifetime limits have been reached, and the number of automobiles of which the lifetime limits are going to be reached;
c) Reporting subject: Inspection centers;
d) Report-receiving agencies: Vietnam Register, provincial-level Departments of Transport;
dd) Methods of sending and receiving reports: Reports shall be sent directly or via post office or email;
e) Deadline: Before January 20 every year, for reports on the list of automobiles of which the lifetime limits have been reached; and before August 20 every year, for reports on the list of automobiles of which the lifetime limits are going to be reached;
g) Frequency: Reports must be submitted annually;
h) Period for closing report data: The number of automobiles of which the lifetime limits have been reached from January 1 of the reporting year, for reports on the list of automobiles of which the lifetime limits have been reached; and the number of automobiles of which the lifetime limits will have reached from January 1 of the following year, for reports on the list of automobiles of which the lifetime limits are going to be reached.
i) Report forms: Made according to Appendix XIV to this Circular.
3. Irregular reports shall be made at the request of competent agencies.
Article 12. Archiving of dossiers and inspection data
The inspection center must manage and archive vehicle dossiers, inspection dossiers and inspection data. Archived dossiers must be complete, well-preserved and convenient for monitoring and checking.
1. Vehicle dossiers shall be archived and arranged into a separate set, managed by dossier serial numbers. A vehicle dossier must comprise:
a) Vehicle documentation record sheet;
b) Documents specified at Point b Clause 1 Article 6 of this Circular;
c) Inspection certificate of compliance with technical safety and environmental protection requirements, for refurbished motor vehicle;
d) Printed overall photo of the vehicle as prescribed at Point d Clause 1 Article 8 of this Circular (including the case where the motor vehicle is refurbished to change its technical specifications or general shape);
dd) A copy of the initial inspection certificate after compiling the vehicle dossier, or due to change of the technical specifications;
e) A copy of the registration certificate in case of initial inspection after compiling the vehicle dossier, or renewing inspection certificate;
g) Documents relating to the modification of administrative information and technical specifications during the motor vehicle's operational period (if any).
h) Documents relating to the verification of compliance with the vehicle registration database or that of the registration agency, if motor vehicles are subject to verification as prescribed.
2. Inspection dossier of each motor vehicle shall be arranged into a separate set according to the serial number of the dossier monitoring sheet, and archived by day, enclosed with a copy of the daily task assignment sheet, a print of the daily inspection result report. An inspection dossier must comprise:
a) A dossier monitoring sheet, inspection record sheets; for the case of re-inspection within the same working day, inspection record sheets must be kept in one inspection dossier;
b) Copies of the following documents: Vehicle registration certificate, inspection certificate, inspection sticker newly issued to the motor vehicle. In case of not issuing an inspection sticker, the blank inspection sticker shall be archived;
c) Documents relating to the supplementation and amendment of the vehicle dossier not managed by the inspection center;
d) A print of the surveillance camera and tracking device inspection result via websites;
dd) Printed photos of the luggage compartment (cargo hold); photos of the passenger compartment from the front and back of the vehicle for passenger automobiles with more than 9 seats, including the driver.
3. Compiling books managing dossiers and printouts to monitor the archiving and reporting, including:
a) A book monitoring the issuance of inspection stickers and certificates according to the form provided in Appendix XV to this Circular;
b) A book monitoring the modification of vehicle documentation record sheets according to the form provided in Appendix XVI to this Circular;
c) A book assigning inspection tasks according to the form provided in Appendix XVII to this Circular;
b) A book managing vehicle documentation record sheets according to the form provided in Appendix XVIII to this Circular.
4. Inspection data shall be stored at inspection centers, and on the database of the Vietnam Register's Inspection Management Program.
5. Damaged printouts shall be stored by type, printout serial number, and be stored separately by month. On each printout, the damage reason must be clearly stated, for the latter to destroy at the Vietnam Register's instructions.
6. Period and place of storage
a) Vehicle dossiers and management, issuance books made during the compilation of vehicle dossiers: Shall be stored at the inspection centers compiling the vehicle dossiers during the operational periods of motor vehicles. For motor vehicles of which the lifetime limits have been reached, their dossiers shall be destroyed after 03 years (36 months) from the time on which the lifetime limits are reached.
b) Inspection dossiers and management, issuance books made during the inspection; photos of inspected motor vehicles: Shall be stored at registration centers, and destroyed after 03 years (36 months) after the inspection date.
c) Motor vehicles to be inspected must be recorded during the inspection process on the line and stored at the inspection centers. Images of IP cameras monitoring the inspection process on the line must be stored at the inspection centers in the form of video for at least 30 working days from the date of inspection.
d) Photos of to-be-inspected motor vehicles, taken in accordance with Clause 7 Article 7 of this Circular, must be stored in .JPEG format according to the inspection date for 03 years (36 months) from the date of inspection.
Chapter IV
RESPONSIBILITIES OF ORGANIZATIONS AND INDIVIDUALS
Article 13. Responsibility of vehicle owners
In addition to follow the provisions specified in this Circular, the vehicle owner shall:
1. Take responsibility for remaining compliance with technical safety and environmental protection requirements of the vehicle according to the prescribed standards when joining road traffic between two inspections.
2. Not rent or borrow subassemblies or spare parts of the motor vehicle for the purpose of meeting requirements for inspection; forge, erase or modify the content of the inspection certificate or inspection sticker.
3. Take responsibility for providing or declaring accurate information relating to the inspection content, administrative information or technical specifications of the motor vehicle, including the provision of relevant dossiers and documents to inspection centers.
4. Preserve the inspection certificates and inspection stickers.
5. Return the inspection certificate and inspection sticker when receiving the revocation notice from the inspection center.
Article 14. Responsibility of the Vietnam Register
1. Organize and provide professional guidance on inspection of motor vehicles according to this Circular.
2. Develop, manage and provide unified instructions to use the Inspection Management Program and inspection database nationwide, receive and manage the inspected motor vehicle data of inspection centers.
3. Regularly, periodically and irregularly inspect and monitor inspection activities of inspection centers. Handle violations committed by register officers, professional employees and motor vehicle inspection centers according to regulations, at the same time, send written notices of results of handling violations to provincial-level Departments of Transport.
4. Give warnings and remove warnings on the Inspection Management Program for motor vehicles with inconsistent administrative information or technical specification information, and the cases specified in Clause 12 Article 80 of the Government’s Decree No. 100/2019/ND-CP dated December 20, 2019.
5. Print, manage, issue and provide guidance on using printouts of all types, inspection certificates, and provide instructions on destroying damaged printouts, or invalid printouts.
Article 15. Responsibility of the provincial-level Departments of Transport
1. Conduct examination and inspection of the motor vehicle inspection in the locality.
2. Provide and exchange information and data relating to the motor vehicle inspection.
3. Handle violations in inspection operation of leaders, register officers and professional employees according to competence.
4. Coordinate with the Vietnam Register in state management of motor vehicle inspection, and perform other tasks within the competence in the locality.
Article 16. Responsibility of inspection centers
1. Conduct the inspection and grant inspection certificates for motor vehicles according to regulations. Leaders of inspection centers, persons in charge of inspection lines, register officers and professional employees conducting the inspection shall take responsibility for the inspection results.
2. Publicize the order, procedures, contents, processes, standards, regulations, fees, charges and working time.
3. Archive and make reports according to regulations.
4. Keep confidentiality login accounts to the Vietnam Register's portal, and update warning data from the Vietnam Register's data network according to regulations.
5. Transmit data on inspection results, road user charge collection to the Vietnam Register's Inspection Management Program database at least once a day. Such data must be saved in the form of a compressed file with the name of the output file from the Inspection Management Program in the directory of the center at the server of the Vietnam Register
6. Abide by the functional agencies’ inspection, examination and monitoring of the inspection activities. Report to the Vietnam Register and provincial-level Departments of Transport the implementation of examination and inspection conclusions.
7. Manage and issue inspection certificates and printouts according to regulations; destroy damaged printouts according to the Vietnam Register's instructions
8. Check, maintain and repair to remain the accuracy and operation status of inspection equipment and devices as prescribed, fully record in the device monitoring books according to the form provided in Appendix XIX to this Circular. Report to the Vietnam Register and provincial-level Departments of Transport when the inspection lines or devices fail to operate.
9. Use the inspection management software, and software controlling devices according to the version announced by the Vietnam Register.
10. Manage and monitor inspection activities at the center.
11. Receive the registration for inspection (via telephone or website) of motor vehicles upon the vehicles’ demands.
12. Develop annual and long-term training plans for its register officers and professional employees to improve their knowledge on motor vehicle inspection.
13. Provide accurate information relating to motor vehicles during the inspection for other inspection centers at their request.
14. Take responsibility for sending and updating documents relating to the change of administrative information and technical specifications of motor vehicles in accordance with Clauses 4 and 5 Article 8 of this Circular.
15. Provide regular training on professional ethics for officers, register officers and employees, combat negativity in the inspection activities within the center; remind vehicle owners not to leave money or valuables on the vehicle when entering for inspection.
16. Check and certify on the printout issuance sheet, and send it to the Vietnam Register within 10 working days from the date of receiving the inspection printout from the Vietnam Register.
17. Verify the compliance with the vehicle registration database or that of the registration agency, for liquidated motor vehicles.
Chapter V
IMPLEMENTATION PROVISIONS
Article 17. Effect
1. The Circular takes effect from October 1, 2021, and replaces the Minister of Transport's Circular No. 70/2015/TT-BGTVT dated November 9, 2015, on inspection for the means of road transport.
2. Inspection certificates and inspection stickers granted by inspection centers to motor vehicles before the effective date of this Circular shall remain valid until their expiry dates.
3. In case any documents referred to in this Circular are replaced or amended, supplemented, the new ones shall prevail.
Article 18. Implementation organization
The Chief of Ministry Office, the Ministerial Chief Inspector, Directors, Directors General of Vietnam Road Administration and Vietnam Register, Directors of Departments of Transport of provinces and centrally-run cities, Heads of related agencies, organizations and individuals shall implement this Circular./.
