CIRCULAR
Guidingstandards and norms for specialized machine and equipment use in the field of education and training

Pursuant to the Law on Educationdated June 14,2005;the Law onamending and supplementing a number ofArticles of the Law on Education dated November 25, 2009;
Pursuant to the Law on Higher Education dated June 18, 2012; the Law onamending and supplementing a number ofArticles of the Law on Higher Education dated November 19, 2018;
Pursuant to the Law on Management andUse of Public PropertydatedJune21, 2017;
Pursuant to the Decision No.50/2017/QD-TTg dated December 31, 2017 of the Prime Minister on standardsand norms for machine and equipment use;
Pursuant to the Decree No. 69/2017/ND-CP dated May 25, 2017 of the Govermentdefining functions, tasks, powers and organizational structure of Ministry ofEducation and Training;
At the request of the Director ofEducational facilities and equipmentDepartment;
The Minister ofEducation and TrainingissuesCircularguidingstandards and norms for specialized machine and equipment use in the field of education and training.
Article 1. Scope ofadjustmentand subjects to application
1. This Circular provides guidelines on standards and norms for specialized machine and equipment use in the field of education and training under State management of Ministry of Education and Training as prescribed at Point a, Paragraph 2, Article 8 of the Decision No.50/2017/QD-TTg dated December 31, 2017 of the Prime Minister.
2.Standards and norms for specialized machine and equipment use in the field of education and training specified in this Circular shall apply to machines and equipment qualified as fixed assets under regulations ofpolicies on managing and calculatingthe property depreciation of fixed assets of agencies, organizations and units.
3. This Circular shall apply to public service providers, including:
a) Institutions of early childhood education, institutions of general education, centers for continuing education,centersfor professional education - continuing education, specialized schools (hereinafter referred to aseducational institutions).
b) Universities and other forms of higher education institutions, pedagogical colleges, pedagogicalprofessional secondary schools, colleges with teacher training disciplines (hereinafter referred to astraining institutions).
c) Relevant authority, organizations and individuals.
Article 2. Term interpretation
Specialized machines and equipment in the field of education and training prescribed in this Circular are synchro machines and equipment; separate machines and equipment; technological lines; tools; gadgets, children’s toys; tables; chairs; boards; locker/shelves and other equipment (hereinafter referred to asequipment) used in the nurturing, caring, teaching, studying, training, experimenting, practicing, scientific research, and technological exchange of educational institutions and training institutions.
Article 3. Purposes of guidingstandards and norms for equipment use
1. Creating basis for educational institutions, traininginstitutionsto develop theirstandards and norms for equipment use.
2.Creating basis for educational institutions, traininginstitutionsto makeplans, estimate costs; to assign, invest,procure,lease or provide fixed funding for using equipment; to manage, and use equipment.
Article 4. Standards and norms for equipment use in educational institutions
1. Equipment standards
a) Equipment defined in the list of teaching equipment prescribed by Ministry of Education and Training.
b) Equipment not defined in the list of teaching equipment prescribed by Ministry of Education and Training includes:
- Equipment, kitchen and eating utensils, dormitories for the care and nurture of children and students;
- Equipment for examination and admission, assessment and quality control;
- Computers, computer network devices, softwares that support teaching, learning and scientific research; audio-visual equipment, sets of tables, chairs, boards, shelves/ cupboards installed in classrooms and such functional rooms as: meeting rooms, profession-exchange rooms, art education rooms, science-technology rooms, computer rooms, foreign language rooms, department rooms, multi-functional rooms, rooms for Youth Union activities, memorial rooms, support rooms for disabled students, student consultation rooms, and multi-functional buildings.
- Sanitary equipment in student restrooms;
- Equipment for school health issues;
- Equipment and gears for school sport activities;
- Equipment for specialized schools;
- Other teaching and learning equipment.
2. Equipment norms
To determine equipment norms, educational institutions shall base on the following principles:
a) For equipment defined in the list of teaching equipment prescribed by Ministry of Education and Training.
Based on the size of students, number of classes and regulations in the list of teaching equipment issued by the Ministry of Education and Training to determine the quantity and ensure sufficient equipment for teaching and learning, education and childcare activities in educational institutions.
b) For equipment not defined in the list of teaching equipment prescribed by Ministry of Education and Training, educational institutions shall base on the following principles:
- Suitable for educational program contents and activities;
- In line with development orientations of educational institutions to reach standardized levels of infrastructure and equipment in each period;
- The size of students and the number of classes;
- The actual demand;
- Infrastructure conditions for equipmentinstallation, storage and operation.
Article 5. Standards and norms for equipment use in training institutions
1. Equipment standards
- Equipment in laboratories, practical laboratories; experimental workshops/stations/training camps;
- Equipment in libraries or Library and Information centers, technological lines for training, scientific research and technology transfer;
- Equipment for examination and admission, assessment and quality control;
- Computers, computer network devices, softwares that support teaching, learning and scientific research; audio-visual equipment, sets of tables, chairs, boards, shelves/ cupboards installed in classrooms, meeting rooms, profession-exchange rooms, lecture halls, medical rooms, laboratories, practical laboratories; experimental workshops/ stations/ training camps, libraries or Library and Information centers;
- Air conditioning, dehumidifying, insulating, fire-fighting, water treatment, and waste treatment systems in laboratories, practical laboratories, and scientific research rooms; experimental workshops/stations/training camps;
- Other equipment for training, scientific research, technology transfer activities and specific tasks of training institutions.
2. Equipment norms
To determine equipment norms, training institutions shall base on the following principles:
a)The size of students andlecturersaccording to development orientationsof training institutions.
b) According to requirements and objectives of training disciplines and programs; requirements and objectives of scientific research in association with training and technology transfer; requirements and objectives of tasks, projects, programs and research topics for training purposes.
c) The size of students in each major.
d) Infrastructure conditions for equipmentinstallation, storage and operation.
Article 6. Implementation
1. For the Department of Education and Training, the Department of Education - Science and Technology (hereinafter referred to asthe Department of Education and Training):
a) Developing standards and norms for equipment use in educational institutions and training institutions under its scope of management based on provisions of this Circular.
b) Submitting to the centrally-run or provincial People s committees. After recieving opinions from the Standing People s Councils of the same level, centrally-run or provincial People s committees shall directly issue or decentralize competent agencies to issue standards and norms for equipment use for agencies, organizations and units under their scope of management.
2. For training institutions
a) Developing their own standards and norms for equipment use based on provisions of this Circular;
b) Submitting to competent authorities in charge of issuing or decentralizing to issue standards and norms for equipment use for training institutions;
3. Educational institutions and training institutions shall ensure operating costs and investment costs according to provisions of this Circular and shall develop and issue their ownstandards and norms for equipment use;
4. Standards and norms for specialized equipment use must be made public on portal websites of Departments of Education and Training and training institutions.
Article 7. Forward handlings
1. For standards and norms for equipment use in the field of education and training issued by competent agencies or decentralized for issuance before the effective date of this Circular, only those which comply with provisions of this Circular shall continue being implemented. In cases of incompatibility with the provisions of this Circular, these standards and norms must be reviewed and proposed for amendment and supplement.
2. Investment and equipment procurement projects approved by competent authorities before effective date of this Circular shall continue being conducted.
Article 8. Implementation effect and responsibilities
1. This Circular takes effect from November 20, 2019.
2. The Chief of the Ministry office, the Director of Educational facilities and equipmentDepartment, Heads of units under the Ministry of Education and Training; Chairmen of centrally-run and provincial People s committees; Directors of Departments of Education and Training; Heads of educational institutions and training institutions, and relevant agencies and individuals shall implement this Circular.
