CIRCULAR

Guiding standards and norms for specialized machine and equipment use in the field of education and training

Pursuant to the Law on Education dated June 14, 2005; the Law on amending and supplementing a number of  Articles of the Law on Education dated November 25, 2009;

Pursuant to the Law on Higher Education dated June 18, 2012; the Law on amending and supplementing a number of Articles of the Law on Higher Education dated November 19, 2018;

Pursuant to the Law on Management and Use of Public Property dated June 21, 2017;

          Pursuant to the Decision No. 50/2017/QD-TTg dated December 31, 2017 of the Prime Minister on standards and norms for machine and equipment use;

Pursuant to the Decree No. 69/2017/ND-CP dated May 25, 2017 of the Goverment defining functions, tasks, powers and organizational structure of Ministry of Education and Training;

At the request of the Director of Educational facilities and equipment Department;

          The Minister of Education and Training issues Circular guiding standards and norms for specialized machine and equipment use in the field of education and training.

Article 1. Scope of adjustment and subjects to application

1. This Circular provides guidelines on standards and norms for specialized machine and equipment use in the field of education and training under State management of Ministry of Education and Training as prescribed at Point a, Paragraph 2, Article 8 of the Decision No. 50/2017/QD-TTg dated December 31, 2017 of the Prime Minister.

2. Standards and norms for specialized machine and equipment use in the field of education and training specified in this Circular shall apply to machines and equipment qualified as fixed assets under regulations of policies on managing and calculating the property depreciation of fixed assets of agencies, organizations and units.

3. This Circular shall apply to public service providers, including:

a) Institutions of early childhood education, institutions of general education, centers for continuing education, centers for professional education - continuing education, specialized schools (hereinafter referred to as educational institutions).

b) Universities and other forms of higher education institutions, pedagogical colleges, pedagogical professional secondary schools, colleges with teacher training disciplines (hereinafter referred to as training institutions).

c) Relevant authority, organizations and individuals.

Article 2. Term interpretation

Specialized machines and equipment in the field of education and training prescribed in this Circular are synchro machines and equipment; separate machines and equipment; technological lines; tools; gadgets, children’s toys; tables; chairs; boards; locker/shelves and other equipment (hereinafter referred to as equipment) used in the nurturing, caring, teaching, studying, training, experimenting, practicing, scientific research, and technological exchange of educational institutions and training institutions.

Article 3. Purposes of guiding standards and norms for equipment use

1. Creating basis for educational institutions, training institutions to develop their standards and norms for equipment use.

2. Creating basis for educational institutions, training institutions to make plans, estimate costs; to assign, invest, procure, lease or provide fixed funding for using equipment; to manage, and use equipment.
