CIRCULAR

On guiding of pilot auction for import sugar quotas in 2019
 

Pursuant to the Decree No. 98/2017/ND-CP dated August 18, 2017 on defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;

Decree No. 69/2018/ND-CP dated May 15, 2018 of the Government on guidelines for the Law on Foreign Trade Management;

Decree No. 62/2017/ND-CP dated May 16, 2017 of the Government on guidelines for the Law on Property Auction;

Decree No. 151/2017/ND-CP dated December 26, 2017 of the Government on guidelines for the Law on Management and Use of Public Property;

At the proposal of the Director of the Import and Export Department;

The Minister of Industry and Trade promulgates the Circular on guiding of pilot auction for import sugar quotas in 2019.

Article 1. Scope of regulation

This Circular regulate the sugar import quotas and principles of pilot auctions for sugar import quotas in 2018.

Article 2. Subjects of application

1. Tradespersons directly using sugar as materials in the production process and those who use raw sugar for production of refined sugar.

2. Individuals and organizations related to the import of sugar according to the specified tariff quotas in 2019.

Article 3. Quantification of sugar import quotas at auction in 2019

Quantification of imported sugar to be auctioned (HS code 1701) according to tariff quotas in 2019 shall be 98,700 tons.  

Article 4. Auctioning principles

1.  Principles, processes and procedures for the property auction shall comply with legal regulation on auction and in accordance with the nature of property being auctioned.

2. The Ministry of Industry and Trade shall establish the Board of pilot auction for sugar import quotas in 2019 in order to operate the auction. 

The Chairperson of the auction Board shall issue regulations on pilot auction of sugar import quotas in 2019.

Article 5. Notification for the right of quota usage

1. After receiving the auction result report of the auction Board, the Ministry of Industry and Trade shall issue the written notification for the right of quota usage of sugar import quota to the auction winning entities.

2. Trader uses the written notification for the right of quota usage to carry out customs procedures shall comply with the provisions of customs law.

Article 6. Effect

This Circular takes effect from November 02, 2019 to December 31, 2019.
