CIRCULAR
Providing standard conformity declaration, technical regulation conformity declaration and methods of assessment of conformity with standards and technical regulations
Pursuant to Law No. 68/2006/QH11 on Standards and Technical Regulations, amended and supplemented under Law No. 35/2018/QH14 and Law No. 70/2025/QH15;
Pursuant to Law No. 05/2007/QH12 on Product and Goods Quality, amended and supplemented under Law No. 78/2025/QH15;
Pursuant to the Government’s Decree No. 22/2026/ND-CP of January 16, 2026, detailing a number of articles of, and providing measures for organizing and guiding the implementation of the Law on Standards and Technical Regulations;
Pursuant to the Government’s Decree No. 37/2026/ND-CP of January 23, 2026, detailing a number of articles of, and providing measures for organizing and guiding the implementation of the Law on Product and Goods Quality;
Pursuant to the Government’s Decree No. 55/2025/ND-CP of March 02, 2025, defining the functions, tasks, powers and organizational structure of the Ministry of Science and Technology;
At the proposal of the Chairperson of the Commission for Standards, Metrology and Quality of Vietnam;
The Minister of Science and Technology promulgates the Circular providing standard conformity declaration, technical regulation conformity declaration and methods of assessment of conformity with standards and technical regulations.
Chapter I
GENERAL PROVISIONS
Article 1. Scope of regulation
This Circular provides standard conformity declaration, technical regulation conformity declaration and methods of assessment of conformity with standards and technical regulations.
Article 2. Subjects of application
This Circular applies to organizations, individuals and management agencies involved in activities about conformity assessment, standard conformity declaration and technical regulation conformity declaration.
Article 3. Interpretation of terms
In this Circular, the terms below are construed as follows:
1. Standard conformity certification organization means an organization that evaluates and certifies that a subject matter of activities in the field of standards conforms to the relevant standard.
2. Technical regulation conformity certification organization means an organization that evaluates and certifies that a subject matter of activities in the field of technical regulations conforms to the relevant technical regulation.
3. Product or goods model means a specific product or goods identified by the manufacturer’s model number, name or trade symbol and defined by a set of specific technical specifications.
4. Product or goods type means a collection of product or goods models having the same properties, utilities, constituent components, basic design, technical structure and operating principle, in which design characteristics are the principal factors determining the conformity of the product or goods type with the same applicable technical and safety requirements, although certain specific technical specifications may differ.
5. Product or goods group means a collection of products or goods consisting of one or more types and/or multiple models having similarities in properties, utilities, constituent components, basic design, operating principle and principal intended use, in which differences among products within the group do not alter their conformity with applicable technical and safety requirements.
Article 4. Standard conformity marks and technical regulation conformity marks
1. Standard conformity marks and use of standard conformity marks
The shape, structure, presentation and use of a standard conformity mark granted to a subject matter certified for standard conformity shall be prescribed by the certification organization and must satisfy the following basic requirements:
a) Being clear and not causing confusion with other marks;
b) Fully displaying the code number of the relevant standard or having a measure to ensure retrieval of information on the code number of the standard used as the basis for standard conformity certification.
Standard conformity marks shall be used in accordance with the guidance in TCVN ISO/IEC 17030. Where an organization or individual declares standard conformity based on self-assessment results, the standard conformity mark may not be used.
2. Technical regulation conformity marks and use of technical regulation conformity marks
a) A technical regulation conformity mark shall have the shape and dimensions specified in Appendix I to this Circular and shall be used for a subject matter certified for technical regulation conformity;
b) A technical regulation conformity mark shall be affixed directly to a product or goods, packaging, technical documentation or label of product or goods;
c) A technical regulation conformity mark shall be displayed in a conspicuous and legible position and must be not easily erasable and impossible to remove and re-affix;
d) A technical regulation conformity mark may be enlarged or reduced, provided that the basic dimensional proportions specified in Appendix I to this Circular are maintained and the mark is recognizable to the naked eye;
dd) A technical regulation conformity mark shall be designed and displayed in a single, readily recognizable color;
e) If products or goods are subject to regulation by many different technical standards, the technical regulation conformity mark may be used only after the products or goods conform to relevant technical regulations;
g) If an organization or individual uses an electronic label for a product, the technical regulation conformity mark shall be displayed on the product’s electronic label. The provisions at Points b and c of this Clause are not mandatory where an organization or individual uses an electronic label.
Article 5. Certification methods
1. Conformity certification shall be conducted by one of the following methods:
a) Method 1: Certification through testing of a sample representative of a product or goods model or type;
b) Method 2: Certification through testing of a sample representative of a product or goods model or type. Supervision through testing of a sample taken from the market;
c) Method 3: Certification through testing of a sample representative of a product or goods model or type and assessment of the production process. Supervision through sample testing and assessment of the production process. Samples for supervision testing shall be taken at the place of production;
d) Method 4: Certification through testing of a sample representative of a product or goods model or type and assessment of the production process. Supervision through sample testing and assessment of the production process. Samples for supervision testing shall be taken at the place of production or from the market, or from both the place of production and the market;
dd) Method 5: Certification through testing of a sample representative of a product or goods model or type and assessment of the production process or management system. Supervision through sample testing and assessment of the production process or management system. Samples for supervision testing may be taken at the place of production or from the market, or from both the place of production and the market;
e) Method 6: Certification through assessment and supervision of the management system;
g) Method 7: Certification through testing and assessment of a product or goods lot;
h) Method 8: Certification through testing or inspection of every product or goods item.
2. The contents, order and principles for use of conformity certification methods are specified in Appendix II to this Circular.
3. A ministry in charge of sectors or fields or certification organization may apply methods other than those specified above but must ensure compliance with TCVN ISO/IEC 17067 and international practices.
Article 6. Principles for application of certification methods
1. The method of technical regulation conformity certification applicable to a specific product, goods, service, process, the environment or another subject matter in a socio-economic activity shall be specified in the relevant technical regulation or relevant specialized legal document. The certification method shall be clearly stated in the technical regulation conformity certificate.
2. Based on the risk level of products or goods, line ministries and provincial-level People’s Committees may detail the application of certification methods in the relevant technical regulations.
3. Method 1 and method 6 specified in Article 5 of, and Appendix II to, this Circular do not apply to high-risk products or goods.
4. The sampling of products or goods from the market for testing and determination of conformity with one or more criteria of the relevant technical regulation shall be carried out only if the characteristics of such products or goods are likely to change during distribution or circulation on the market.
5. For a certification method requiring testing of a sample representative of a product or goods model or type, permission to take a sample representative of a product or goods type in lieu of sampling each product or goods model, or to take a sample representative of a product or goods group in lieu of sampling each product or goods model or type, shall be detailed by the ministry in charge of sectors or fields or provincial-level People’s Committee in the relevant technical regulation or relevant legal document, ensuring the following principles:
a) It applies only to medium-risk products or goods;
b) Specialized law applicable to the products or goods prescribes a management measure under which all technical criteria of the products or goods must be tested in accordance with the relevant technical regulation before the products or goods are circulated on the market for the first time;
c) The organization or enterprise has obtained certification that its quality management system conforms to the relevant standard (ISO 9001, HACCP, GMP or another quality management system standard) for a certification scope relating to the products or goods concerned. The certification organization must be accredited by an accreditation organization that is a signatory to a mutual recognition agreement or multilateral recognition arrangement (MRA/MLA) of an international or regional accreditation cooperation organization (Global Accreditation Cooperation Incorporated, formed through the consolidation of the International Laboratory Accreditation Cooperation (ILAC) and the International Accreditation Forum (IAF); or the Asia Pacific Accreditation Cooperation (APAC)), or by an accreditation organization recognized under a mutual recognition agreement (MRA/MLA) to which Vietnam is a party.
6. When applying a certification method requiring the taking of samples for supervision testing of medium-risk or high-risk products or goods, line ministries and provincial-level People’s Committees shall detail in the relevant technical regulations the exemption from, or reduction of, the number of test samples or the exemption from, or reduction of, test criteria. The exemption or reduction of the number of test samples or the exemption or reduction of test criteria specified in this Clause during supervision assessments may be applied only when the following requirements are satisfied:
a) The organization or enterprise provides sufficient evidence that it is applying, and has obtained certification of, a quality management system conforming to the relevant standard (ISO 9001, HACCP, GMP or another quality management system standard). The certification organization has been accredited by an accreditation organization that is a signatory to a mutual recognition agreement or multilateral recognition arrangement (MRA/MLA) of an international or regional accreditation cooperation organization (Global Accreditation Cooperation Incorporated; the Asia Pacific Accreditation Cooperation (APAC)), or by an accreditation organization recognized under a mutual recognition agreement (MRA/MLA) to which Vietnam is a party;
b) The application of the quality management systems specified in Clause 7 of this Article includes the implementation by the organization or enterprise of internal supervision and testing programs for products or goods eligible for testing exemption or reduction, or the performance by the organization or enterprise of testing of products and goods eligible for exemption from or reduction of testing at the request of relevant parties (customers, management agencies and other relevant parties);
c) The testing results specified at Point b of this Clause are produced by accredited testing organizations;
d) Within one certification cycle, the criteria of the products or goods specified in the relevant technical regulation may undergo supervision testing at least once;
7. When applying a certification method requiring assessment of the production process during supervision of medium-risk or high-risk products or goods, line ministries and provincial-level People’s Committees shall detail in the relevant technical regulations the exemption from, or reduction of, production-process assessment requirements. Provisions in this Clause applies only when the organization or enterprise provides sufficient evidence that it is applying, and has obtained certification of, a quality management system conforming to the relevant standard (ISO 9001, HACCP, GMP or another quality management system standard).
8. A certificate of conformity of a quality management system with the relevant standard specified in Clauses 5, 6 and 7 of this Article must satisfy the following requirements:
a) Remaining valid for at least 06 months at the time the exemption or reduction measure is considered;
b) The scope of certification is consistent with the products and goods specified in the technical regulation;
c) Being granted by a certification organization accredited by an accreditation organization that is a signatory to a mutual recognition agreement or multilateral recognition arrangement (MRA/MLA) of an international or regional accreditation cooperation organization (Global Accreditation Cooperation Incorporated or the Asia Pacific Accreditation Cooperation (APAC)), or by an accreditation organization recognized under a mutual recognition agreement (MRA/MLA) to which Vietnam is a party;
9. When Method 7 is applied to certify a product or goods lot, line ministries and provincial-level People’s Committees shall, based on the risk level and technical characteristics of the products or goods, detail in the relevant technical regulations the taking of product or goods samples representative of the model, type or group. If a technical regulation requires representative sampling of a product or goods lot according to the principle of statistical probability, technical regulations must clearly specify a sampling plan in accordance with national or international standards on statistical probability sampling for the relevant lot (TCVN 9597-1 or ISO 10576-1, the TCVN 7790 series or ISO 2859 series, or TCVN 8243-1 or ISO 3951-1).
10. The method of standard conformity certification applicable to each specific product, goods, service, process, the environment or another subject matter in a socio-economic activity shall be selected by the standard conformity certification organization or by the organization or individual declaring standard conformity from among the conformity assessment methods specified in Article 5 of this Circular. The selected certification method must be appropriate to the risk level of the assessed subject matter to ensure the reliability of certification results. In standard conformity certification, standard conformity certification organizations shall decide on the application of the principles specified in Clauses 2, 3, 4, 5, 6, 7, 8 and 9 of this Article. The standard conformity certificate shall clearly state the certification method. No standard conformity mark may be granted when Method 1 is applied for standard conformity certification.
Chapter II
STANDARD CONFORMITY DECLARATION
Article 7. Principles of standard conformity declaration
1. Subject matters of standard conformity declaration are products, goods, services, processes, the environment or other subject matters in socio-economic activities specified in relevant standards.
Standard conformity declaration is voluntary.
2. Declaration of conformity with relevant standards shall be based on:
a) Results of standard conformity certification conducted by a registered or accredited certification organization; or
b) Results of the conformity self-assessment conducted by the organization or individual declaring standard conformity.
Testing serving standard conformity assessment shall be conducted by a registered or accredited testing organization.
Article 8. Assessment of conformity with standards
1. Assessment of the conformity of products, goods, services, processes, the environment or other subject matters in socio-economic activities with relevant standards is standard conformity assessment.
a) Standard conformity assessment shall be conducted by a registered or accredited certification organization or by the organization or individual declaring standard conformity.
b) Standard conformity certification shall be conducted by a conformity certification method specified in Article 5 of this Circular;
2. Standard conformity assessment results specified at Point a, Clause 1 of this Article serve as a basis for organizations and individuals to declare standard conformity.
Article 9. Order of standard conformity declaration
Standard conformity declaration shall be made according to the following steps:
1. Step 1: The organization or individual shall complete the notice of standard conformity declaration, made according to the form provided in Appendix III to this Circular.
The organization or individual may select and list the standards applicable to its products, goods, services, processes, the environment or other subject matters in socio-economic activities in the notice of standard conformity declaration.
The organization or individual responsible for the products, goods, services, processes, the environment or other subject matters in socio-economic activities shall sign and certify the notice of standard conformity declaration.
2. Step 2: The organization or individual shall give notice of standard conformity declaration via the National database on standards, metrology and quality and; receive a confirmation code certifying completion of notice of standard conformity declaration on the National database on standards, metrology and quality.
If the National database on standards, metrology and quality encounters an error or its infrastructure has not yet been completed, the organization or individual shall give notice of standard conformity declaration by direct submission or by postal service to the local specialized agency. The local specialized agency shall update the notice of standard conformity declaration on the National database on standards, metrology and quality. If there is no local specialized agency, an agency of the ministry in charge of sectors or fields designated or assigned by the Minister shall receive the organization’s or individual’s dossier of standard conformity declaration.
Article 10. Responsibilities of organizations and individuals declaring standard conformity
1. To select a conformity assessment method appropriate to the subject matter of standard conformity declaration to ensure the reliability of assessment results.
2. To continuously maintain, and take responsibility for, the conformity of products, goods, services, processes, the environment or other subject matters in socio-economic activities for which notice of standard conformity declaration has been given; and to maintain quality control, testing and periodic supervision at production and business establishments.
3. Upon detecting the nonconformity of products, goods, services, processes, the environment or other subject matters in socio-economic activities for which standard conformity has been declared during circulation or use, organizations and individuals declaring standard conformity shall perform responsibilities and obligations in accordance with the Law on Product and Goods Quality.
4. To make and retain standard conformity declaration dossiers as follows:
a) If standard conformity declaration is based on results of standard conformity certification by a certification organization, the organization or individual shall make and retain a standard conformity declaration dossier comprising: the original standard conformity certificate; the certification dossier prepared by the standard conformity certification organization; the notice of standard conformity declaration and information confirming that notice of standard conformity declaration has been given on the National database on standards, metrology and quality.
b) If standard conformity declaration is based on self-assessment results of a production or business organization or individual, organization or individual shall make and retain a standard conformity declaration dossier comprising: the original self-assessment dossier of the organization or individual; the notice of standard conformity declaration; and information confirming that notice of standard conformity declaration has been given on the National database on standards, metrology and quality.
c) A self-assessment dossier of an organization or individual must contain:
- A general description of the product, goods, service, process, the environment or another subject matter in a socio-economic activity (functions, utilities, structure and basic technical specifications; design documents, diagrams, photographs, labels and packaging); The production procedure and process, including information on materials, technology and the quality management system (if applicable);
- Information on testing methods and testing results; and results of comparison with the requirements of the relevant standard;
- Other relevant documents (if required by the relevant standard);
- The self-assessment report of the organization or individual is signed and certified by a competent or authorized person.
5. To provide documents proving the conformity of products, goods, services, processes, the environment or other subject matters in socio-economic activities with relevant standards at the request of a competent state agency.
6. To make a re-declare upon any change in the contents of the declared standard, any change in the contents of the notified standard conformity declaration, or any change in the functions, utilities or characteristics of the products, goods or services for which standard conformity has been declared.
Chapter III
TECHNICAL REGULATION CONFORMITY DECLARATION
Article 11. Principles of technical regulation conformity declaration
1. Subject matters of technical regulation conformity declaration are products, goods, services, processes, the environment or other subject matters in socio-economic activities specified in national technical regulations promulgated by line ministries or in local technical regulations promulgated by provincial-level People’s Committees.
Technical regulation conformity declaration is mandatory.
2. Based on the risk levels of products, goods, services, processes, the environment and other subject matters in socio-economic activities, declaration of conformity with relevant technical regulations shall be based on:
a) Results of technical regulation conformity certification by a certification organization designated in accordance with law;
b) Results of technical regulation conformity certification by a certification organization accredited in accordance with law;
c) Results of self-assessment by the organization or individual on the basis of testing results of a testing organization accredited or designated in accordance with law;
d) Conformity assessment results of recognized international, regional or foreign organizations according to regulations.
3. Products and goods are exempt from technical regulation conformity declaration under Clause 2, Article 48 of the Law amending and supplementing a number of articles of the Law on Standards and Technical Regulations shall comply with quality management and safety requirements prescribed by specialized law.
Article 12. Assessment of conformity with technical regulations
1. Assessment of the conformity of products, goods, services, processes, the environment or other subject matters in socio-economic activities with relevant technical regulations is technical regulation conformity assessment.
a) Technical regulation conformity assessment shall be conducted by a certification organization or by an organization or individual based on risk levels and quality management principles prescribed by the law on product and goods quality.
b) In case of certification by a certification organization, certification activities shall be conducted in accordance with Article 6 of, and Appendix II to, this Circular;
2. Technical regulation conformity assessment results specified at Point a, Clause 1 of this Article serve as a basis for organizations and individuals to declare technical regulation conformity.
Article 13. Order of technical regulation conformity declaration
Technical regulation conformity declaration shall be made according to the following steps:
1. Step 1: The organization or individual shall complete the registration of technical regulation conformity declaration, made according to the form provided in Appendix IV to this Circular.
The organization or individual shall identify and fully list all relevant technical regulations compulsorily applicable to its products, goods, services, processes, the environment or other subject matters in socio-economic activities in the registration of technical regulation conformity declaration.
The organization or individual responsible for the products, goods, services, processes, the environment or other subject matters in socio-economic activities shall sign and certify the registration of technical regulation conformity declaration.
2. Step 2: The organization or individual shall register the technical regulation conformity declaration via the National database on standards, metrology and quality and receive a confirmation code certifying completion of registration on the National database.
Enclosed documents include:
- An electronic form of the certificate of conformity with the relevant technical regulation, granted by the technical regulation conformity certification organization to the organization or individual, where technical regulation conformity declaration is based on results of certification by a technical regulation conformity certification organization.
- A technical regulation conformity self-assessment report, (made according to the form provided in Appendix V to this Circular), enclosed with an electronic form of testing results showing conformity with the technical regulation, issued by a testing organization designated or accredited as specified in the relevant technical regulation, where technical regulation conformity declaration is based on self-assessment results of the organization or individual.
If the National database on standards, metrology and quality encounters an error or its infrastructure has not yet been completed, the organization or individual shall register the technical regulation conformity declaration by direct submission or by postal service to the local specialized agency. The local specialized agency shall update the registration of technical regulation conformity declaration on the National database on standards, metrology and quality. If there is no local specialized agency, an agency of the line ministry or ministerial-level agency designated or assigned by the Minister or head of the ministerial-level agency shall receive the organization’s or individual’s technical regulation conformity declaration dossier.
Article 14. Responsibilities of organizations and individuals declaring technical regulation conformity
1. To announce their technical regulation conformity declaration through appropriate means of communication to ensure easy access by users of the products or goods.
2. To continuously maintain, and take responsibility for, the conformity of products, goods, services, processes, the environment or other subject matters in socio-economic activities for which technical regulation conformity has been declared; and to maintain quality control, testing and periodic supervision.
3. To use technical regulation conformity marks for products and goods for which technical regulation conformity has been declared in accordance with Clause 2 Article 4 of this Circular before circulating them on the market. To make monitoring books and annually report on the use of technical regulation conformity marks to the certification organization.
4. Upon detecting the nonconformity of products, goods, services, processes, the environment or other subject matters in socio-economic activities for which technical regulation conformity has been declared during circulation or use, organizations and individuals declaring technical regulation conformity shall perform responsibilities and obligations in accordance with the Law on Product and Goods Quality.
5. To make and retain technical regulation conformity declaration dossiers to serve as a basis for examination and inspection by state management agencies as follows:
a) If technical regulation conformity declaration is based on results of technical regulation conformity certification by a certification organization, the organization or individual shall make and retain a technical regulation conformity declaration dossier comprising: the original technical regulation conformity certificate; the certification dossier prepared by the technical regulation conformity certification organization; the registration of technical regulation conformity declaration; and information confirming registration of the technical regulation conformity declaration on the National database on standards, metrology and quality.
b) If technical regulation conformity declaration is based on self-assessment results of a production or business organization or individual, the organization or individual shall make and retain a technical regulation conformity declaration dossier comprising: the original self-assessment and supervision dossier of the organization or individual; the registration of technical regulation conformity declaration; and information confirming registration of the technical regulation conformity declaration on the National database on standards, metrology and quality.
c) A self-assessment dossier of an organization or individual must contain:
- A general description of the product, goods, service, process, the environment or another subject matter in a socio-economic activity (functions, utilities, structure and basic technical specifications; design documents, diagrams, photographs, labels and packaging, etc.); and the production procedure and process, including information on materials, technology and the quality management system (if applicable).
- A report on testing methods and results and comparison with the requirements of the relevant technical regulation, enclosed with a copy of testing results issued by a testing organization accredited, designated or recognized in accordance with law.
- A plan for quality control and periodic supervision of conformity with the technical regulation, specifying the frequency and methods of examination and testing and measures for maintaining conformity with the relevant technical regulation.
- Other relevant documents (if required by the relevant technical regulation).
- The self-assessment report of the organization or individual is signed and certified.
6. To provide documents proving the conformity of products, goods, services, processes, the environment or other subject matters in socio-economic activities with relevant technical regulations at the request of a competent state agency.
7. To make a re-declare upon any change in the contents of a technical regulation, any change in the contents of the registered technical regulation conformity declaration, or any change in the functions, utilities or characteristics of the products, goods or services for which technical regulation conformity has been declared.
Chapter IV
ORGANIZATION OF IMPLEMENTATION
Article 15. Responsibilities of management agencies
1. Responsibilities of the Ministry of Science and Technology:
a) To assist the Government in uniformly managing and providing general guidance on activities about conformity assessment, standard conformity declaration and technical regulation conformity declaration;
b) To coordinate with and guide line ministries and provincial-level People’s Committees in determining risk levels of products and goods and appropriate management measures in the relevant technical regulations promulgated by line ministries or provincial-level People’s Committees, in accordance with the principles of technical regulation conformity declaration prescribed in the Law on Standards and Technical Regulations;
c) To designate agencies to receive registrations of technical regulation conformity declaration for the management of technical regulation conformity declaration activities in the assigned fields of state management;
d) To coordinate with line ministries and provincial-level People’s Committees in urging and guiding the implementation of standard conformity declaration and technical regulation conformity declaration in accordance with this Circular;
dd) To monitor standard conformity declarations and technical regulation conformity declarations for products, goods, services, processes, the environment or other subject matters in socio-economic activities under the management responsibility of the Ministry of Science and Technology, line ministries and provincial-level People’s Committees; and to monitor designations made by line ministries regarding activities about conformity assessment, standard conformity declaration and technical regulation conformity declaration;
e) To coordinate and share data from the National database on standards, metrology and quality with line ministries and provincial-level People’s Committees for synthesis, reporting, examination and inspection.
2. Responsibilities of line ministries and provincial-level People’s Committees:
a) To organize technical regulation conformity declaration activities in accordance with this Circular when promulgating relevant technical regulations for management;
b) To designate agencies to receive registrations of technical regulation conformity declaration for the management of technical regulation conformity declaration activities in the respective assigned fields of state management;
c) To coordinate with the Ministry of Science and Technology in determining risk levels of products and goods and appropriate management measures in the relevant technical regulations promulgated by line ministries or provincial-level People’s Committees, in accordance with the principles of technical regulation conformity declaration prescribed in the Law on Standards and Technical Regulations;
d) To manage and monitor technical regulation conformity declaration registration activities of agencies designated by line ministries or provincial-level People’s Committees in assigned fields;
dd) To coordinate with the Ministry of Science and Technology in managing standard conformity declaration and technical regulation conformity declaration activities at line ministries and provincial-level People’s Committees.
Article 16. Effect
1. This Circular takes effect on May 25, 2026.
2. The following Circulars cease to be effective from the effective date of this Circular:
- Circular No. 28/2012/TT-BKHCN dated December 12, 2012, of the Minister of Science and Technology, providing standard conformity declaration, technical regulation conformity declaration and methods of assessment of conformity with standards and technical regulations, which took effect on January 27, 2013.
- Circular No. 02/2017/TT-BKHCN dated March 31, 2017, of the Minister of Science and Technology, amending and supplementing a number of articles of Circular No. 28/2012/TT-BKHCN dated December 12, 2012, of the Minister of Science and Technology, providing standard conformity declaration, technical regulation conformity declaration and methods of assessment of conformity with standards and technical regulations, which took effect on May 15, 2017.
- To annul Clause 8, Article 3, and Clause 4, Article 19, of Circular No. 06/2020/TT-BKHCN dated December 10, 2020, of the Minister of Science and Technology, detailing and providing measures for implementing a number of articles of the Government’s Decree No. 132/2008/ND-CP dated December 31, 2008, Decree No. 74/2018/ND-CP dated May 15, 2018, Decree No. 154/2018/ND-CP dated November 09, 2018, and Decree No. 119/2017/ND-CP dated November 01, 2017;
- To annul Articles 15 and 30 of Circular No. 07/2024/TT-BKHCN dated October 08, 2024, of the Minister of Science and Technology, amending and supplementing a number of articles of legal documents falling under the promulgation competence of the Minister of Science and Technology concerning the Commission for Standards, Metrology and Quality of Vietnam.
- Circular No. 04/2025/TT-BKHCN dated May 31, 2025, of the Minister of Science and Technology, amending and supplementing a number of articles of Circular No. 28/2012/TT-BKHCN dated December 12, 2012, of the Minister of Science and Technology, providing standard conformity declaration, technical regulation conformity declaration and methods of assessment of conformity with standards and technical regulations, as amended and supplemented unders Circular No. 02/2017/TT-BKHCN dated March 31, 2017.
Article 17. Transitional provisions
1. Organizations and individuals that conducted assessment of conformity with standards or technical regulations, standard conformity declaration or technical regulation conformity declaration before the effective date of this Circular may continue using their standard conformity certificates, technical regulation conformity certificates, standard conformity marks and technical regulation conformity marks until the expiry of their validity periods, and are not required to re-notify their notices of standard conformity declaration or re-register their technical regulation conformity declarations.
Article 18. Organization of implementation
1. Ministers, heads of ministerial-level agencies and Chairpersons of provincial-level People’s Committees shall organize the implementation of this Circular.
2. The Chairperson of the Commission for Standards, Metrology and Quality of Vietnam shall guide and organize the implementation of this Circular.
3. If any problems or difficulties arise during implementation, organizations and individuals shall promptly report them in writing to the Ministry of Science and Technology for study and appropriate amendment or supplementation./.
