Circular 13/2021/TT-BVHTTDL amending Circular 06/2017/TT-BVHTTDL detailing the Law on Tourism

CIRCULAR

Amending and supplementing a number of articles of the Minister of Culture, Sports and Tourism's Circular No. 06/2017/TT-BVHTTDL dated December 15, 2017, on detailing a number of articles of the Law on Tourism

Pursuant to the Law on Tourism dated June 19, 2017;

Pursuant to the Government’s Decree No. 79/2017/ND-CP of July 17, 2017, defining the functions, tasks, powers and organizational structure of the Ministry of Culture, Sports and Tourism;

At the proposal of the Director of the Department of Legal Affairs and the Director General of the Vietnam National Administration of Tourism;

The Minister of Culture, Sports and Tourism promulgates the Circular amending and supplementing a number of articles of the Minister of Culture, Sports and Tourism's Circular No. 06/2017/TT-BVHTTDL dated December 15, 2017, on detailing a number of articles of the Law on Tourism.

Article 1. To amend and supplement a number of articles of the Minister of Culture, Sports and Tourism's Circular No. 06/2017/TT-BVHTTDL dated December 15, 2017, on detailing a number of articles of the Law on Tourism

1. To amend and supplement Point a, Clause 3, Article 6 as follows:

“a) After 30 days from the date of publishing the decision on revocation of the travel service business license on the portal of the licensing agency and the website for management of travel service enterprises, in case there is no complaint or denunciation about the enterprise’s obligations toward tourists or tourist service-providing establishments, the licensing agency shall send a written request to the bank so that the enterprise may withdraw its deposit; in case there is any complaint or denunciation about the enterprise’s obligations toward tourists or tourist service-providing establishments, the licensing agency shall coordinate with related competent agencies in settling it according to regulations;”

2. To amend and supplement Clause 1, Article 7 as follows:

“1. Within 05 working days from the date of receiving the inspection or examination conclusion, the licensing agency shall issue a decision to revoke the travel service business license. This decision shall be sent to the enterprise, the inspection or examination agency, the state agency in charge of immigration, the tax agency and the provincial-level business registration agency of the locality where the enterprise is headquartered, and published on the portal of the licensing agency and website for management of travel service enterprises.”

Article 2. Responsibility for implementation organization

1. The Vietnam National Administration of Tourism shall assume the prime responsibility for, and coordinate with the Department of Legal Affairs and related agencies and units in, guiding the implementation of this Circular.

2. Heads of agencies and units under the Ministry, Directors of Departments of Culture, Sports and Tourism, Departments of Tourism and related individuals shall be responsible for organizing the implementation of this Circular.

Any problems arising in the course of implementation of this Circular should be promptly reported to the Ministry of Culture, Sports and Tourism for research, and appropriate amendments and supplements.

Article 3. Implementation provisions

1. This Circular takes effect on the signing date.

2. The agencies, units and travel service enterprises that are carrying out the procedures for refunding the deposits according to Articles 6 and 7 of the Circular No. 06/2017/TT-BVHTTDL shall apply the time limit as prescribed in this Circular for settlement./.
