CIRCULAR
Promulgating the set of statistical indicators on children and child abuse, and administrative handling of child abuse acts[1]
Pursuant to the November 23, 2015 Statistics Law;
Pursuant to the April 5, 2016 Law on Children;
Pursuant to the June 20, 2012 Law on Handling of Administrative Violations and the November 13, 2020 Law Amending and Supplementing a Number of Articles of the Law on Handling of Administrative Violations;
Pursuant to the National Assembly’s Resolution No. 121/2020/QH14 of June 19, 2020, on further raising the effect and effectiveness of the implementation of policies and laws on child abuse prevention and control;
Pursuant to the Government’s Decree No. 94/2016/ND-CP of July 1, 2016, detailing and guiding the implementation of a number of articles of the Statistics Law;
Pursuant to the Government’s Decree No. 97/2016/ND-CP of July 1, 2016, prescribing contents of statistical indicators belonging to the national statistical indicator system;
Pursuant to the Government’s Decree No. 56/2017/ND-CP of May 9, 2017, detailing a number of articles of the Law on Children;
Pursuant to the Government’s Decree No. 14/2017/ND-CP of February 17, 2017, defining the functions, tasks, powers and organizational structure of the Ministry of Labor, Invalids and Social Affairs;
At the proposal of the Director General of the Department of Child Affairs;
The Minister of Labor, Invalids and Social Affairs promulgates the Circular on the set of statistical indicators on children and child abuse, and administrative handling of child abuse acts.
Article 1. To promulgate together with this Circular the set of statistical indicators on children and child abuse, and administrative handling of child abuse acts
1. The set of statistical indicators on children and child abuse, and administrative handling of child abuse acts is a system of ministerial and sectoral statistical indicators in various sectors and fields that aims to collect statistics on children, monitor and assess the realization of children’s rights, the situation of child abuse, and administrative handling of child abuse acts, thus meeting the demand for statistical information on children, and serving as a basis for state management agencies in charge of children to inspect and evaluate the implementation and formulation of policies on children.
2. The set of statistical indicators on children and child abuse, and administrative handling of child abuse acts includes:
a/ The list of statistical indicators on children which comprises indicators’ codes, groups and names (Appendix I to this Circular);
b/ The list of statistical indicators on child abuse and administrative handling of child abuse acts, which comprises indicators’ codes, groups and names (Appendix II to this Circular);
c/ Contents of statistical indicators on children, which comprises the definition, method of calculation, main groupings, period of announcement, data sources and agencies in charge of collection and summarization (Appendix III to this Circular);
d/ Contents of statistical indicators on child abuse and administrative handling of child abuse acts, which comprises the definition, method of calculation, major groupings, period of announcement, data sources and agencies in charge of collection and summarization (Appendix IV to this Circular).
Article 2. Organization of implementation
1. The Ministry of Labor, Invalids and Social Affairs shall assume the prime responsibility for, and coordinate with the Ministry of Planning and Investment (the General Statistics Office of Vietnam) and related ministries and sectors in:
a/ Summarizing statistical information belonging to the set of statistical indicators on children and child abuse, and administrative handling of child abuse acts through the statistical reporting regime, statistical surveys and administrative data of ministries and sectors, thus ensuring the provision of sufficient and accurate statistics.
b/ Building a statistical database on children, child abuse, and administrative handling of child abuse acts; developing statistical softwares to collect, process and disseminate statistical information on children.
c/ Monitoring, guiding and reporting on the implementation of this Circular.
d/ Exploiting and analyzing data on children, child abuse, and administrative handling of child abuse acts to examine and evaluate the implementation of policies on children, serving as a basis for formulating policies to ensure the realization of children’s rights, create an environment for all-sided development of children, and control violence against children and child abuse.
2. Based on the set of statistical indicators on children, child abuse, and administrative handling of child abuse acts promulgated together with this Circular, ministries, ministerial-level agencies, government-attached agencies, provincial-level People’s Committees, provincial-level Departments of Labor, Invalids and Social Affairs and related agencies shall, within the ambit of their tasks and powers, integrate, collect and summarize the indicators assigned to them belonging to the set of statistical indicators, and provide them to the Ministry of Labor, Invalids and Social Affairs for summarization.
Article 3. Effect
1. This Circular takes effect on November 15, 2021.
2. Statistical indicators with codes 0201, 0202, 0203, 0204, 0205, 0206, 0207, 0208, 0209, 0210, 0211 and 0212 specified in Appendix II to this Circular take effect on January 1, 2022.
3. Any problems arising in the course of implementation of this Circular should be promptly reported to the Ministry of Labor, Invalids and Social Affairs.-
