CIRCULAR

Amending and supplementing a number of articles of the Minister of Industry and Trade’s Circular No. 20/2014/TT-BCT of June 25, 2014, on the implementation of the Rules of Origin under the ASEAN-Korea Free Trade Agreement^[1]

Pursuant to the Government’s Decree No. 98/2017/ND-CP of August 18, 2017, defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;

Pursuant to the Government’s Decree No. 31/2018/ND-CP of March 8, 2018, detailing the Law on Foreign Trade Management regarding origin of goods;

In implementation of the Decision to endorse the transposed product specific rules in Appendix 2 of Annex 3 (Rules of Origin) of the Agreement on Trade in Goods under the Framework Agreement on Comprehensive Economic Cooperation Among the Governments of the Member Countries of the Association of Southeast Asian Nations and the Republic of Korea issued by the 17^th Asia-Korea Free Trade Agreement Implementing Committee (AKFTA-IC) meeting in February 2019 in Seoul, the Republic of Korea;

At the proposal of the Director General of the Agency of Foreign Trade;

The Minister of Industry and Trade promulgates the Circular amending and supplementing a number of articles of the Minister of Industry and Trade’s Circular No. 20/2014/TT-BCT of June 25, 2014, on the implementation of the Rules of Origin under the ASEAN-Korea Free Trade Agreement (below referred to as Circular No. 20/2014/TT-BCT).

Article 1. To amend and supplement a number of articles of Circular No. 20/2014/TT-BCT

1. To amend and supplement Article 2 as follows:

“Procedures for grant and examination of Vietnam’s certificate of origin (CO), form AK, must comply with:

1. The Government’s Decree No. 31/2018/ND-CP of March 8, 2018, detailing the Law on Foreign Trade Management regarding the origin of goods, and the Ministry of Industry and Trade’s Circular No. 05/2018/TT-BCT of April 3, 2018, on the origin of goods.

2. Appendix V to this Circular.”

2. To amend and supplement Appendix II - Product specific rules as follows:

To annul Appendix II - Product specific rules to Circular No. 20/2014/TT-BCT, and replace it with the Appendix to this Circular.

Article 2. Implementation provisions

1. This Circular takes effect on September 13, 2019.

2. From September 1, 2019 through December 31, 2019, HS code in cell No. 7 of the certificate of origin, form AK, must:

a/ Follow the  HS 2017 version with a respective code of the  HS 2012 version put in brackets; or,

b/ Follow the HS 2012 version.

3. This Circular replaces the Ministry of Industry and Trade’s Circular No. 04/2015/TT-BCT of March 16, 2015, amending and supplementing the product specific rules promulgated together with Circular No. 20/2014/TT-BCT.-
