Circular 12/2026/TT-NHNN amending Decision 38/2007/QD-NHNN on regulation on grant, use and management of bank identification numbers

CIRCULAR

Amending and supplementing a number of articles of Decision No. 38/2007/QD-NHNN of the Governor of the State Bank of Vietnam, on issuance of the Regulation on grant, use and management of bank identification numbers

Pursuant to the Law on the State Bank of Vietnam No. 46/2010/QH12;

Pursuant to the Law on Credit Institutions No. 32/2024/QH15, amended and supplemented under Law No. 96/2024/QH15;

Pursuant to the Government's Decree No. 52/2024/ND-CP on cashless payment;

Pursuant to the Government’s Decree No. 26/2025/ND-CP defining the functions, tasks, powers and organizational structure of the State Bank of Vietnam;

At the proposal of the Director of the Payment Department;

The Governor of the State Bank of Vietnam hereby promulgates the Circular amending and supplementing a number of articles of Decision No. 38/2007/QD-NHNN of the Governor of the State Bank of Vietnam, on issuance of the Regulation on grant, use and management of bank identification numbers.

Article 1. To amend and supplement Article 3 of Decision No. 38/2007/QD-NHNN

“Article 3. Heads of units under the State Bank of Vietnam, credit institutions, and foreign bank branches shall organize the implementation of this Decision./.”.

Article 2. To amend and supplement Article 6 of the Regulation on grant, use and management of bank identification numbers promulgated together with Decision No. 38/2007/QD-NHNN

“Article 6. Procedures for grant of BINs

1. Upon having demand for grant of the BIN, the card issuer shall send an application (made according to Form No. 01 to this Regulation) to the State Bank of Vietnam (the Payment Department) by either of the following methods:

a) Direct submission at the Single-window section of the State Bank of Vietnam;

b) Submission via postal service;

c) Online submission via the National Public Service Portal.

2. Within 03 working days from the receipt of the valid application for grant of BIN, the State Bank of Vietnam (the Payment Department) shall notify the BIN grant result to the card issuer. In case of refusal, the State Bank of Vietnam (the Payment Department) shall issue a written reply, clearly stating reasons.

 The State Bank of Vietnam (the Payment Department) shall return the result of grant or refusal to grant BIN to the card issuer in electronic form through National Public Service Portal.  Upon request of the card issuer, the result shall be sent in paper form via postal services or directly at the Single-window section of the State Bank of Vietnam.

3. The State Bank of Vietnam shall grant one unique BIN to each eligible card issuer.”.

Article 3. To amend and supplement Article 10 of the Regulation on grant, use and management of bank identification numbers promulgated together with Decision No. 38/2007/QD-NHNN

“Article 10. Responsibilities of units under the State Bank of Vietnam

1. The Payment Department shall

a) Carry out the grant, management and revocation of BINs; receive notifications from card issuers regarding use of BINs; supervise the use of BINs in accordance with this Regulation;

b) Act as the focal point in coordinating with relevant units in advising the Governor of the State Bank of Vietnam on handling difficulties arising during the implementation process;

c) Conduct inspection of the use of BINs in accordance with this Regulation;

d) On an annual basis (before January 15 of the following year), update the list of BINs granted by the State Bank of Vietnam on its website.

2. The SBV Inspectorate and Regional branches shall

Conduct inspections and handle violations according to competence with respect to card issuers in implementing this Regulation and notify the results to the Payment Department.”.

Article 4. Implementation responsibility

Heads of units under the State Bank of Vietnam, credit institutions, and foreign bank branches shall organize the implementation of this Circular.

Article 5. Implementation provisions

1. This Circular takes effect from July 04, 2026.

2. This Circular repeals Clause 2 and Clause 5, Article 1 of Circular No. 26/2019/TT-NHNN amending and supplementing a number of articles of the Regulation on grant, use and management of bank identification numbers promulgated together with Decision No. 38/2007/QD-NHNN dated October 30, 2007, of the Governor of the State Bank of Vietnam./.
