CIRCULAR
On repeal of a number of legal documents under the Minister of Industry and Trade’s management
Pursuant to the Law on Promulgation of Legal Documents No. 64/2025/QH15; the Law on Promulgation of Legal Documents No. 87/2025/QH15;
Pursuant to the Government’s Decree No. 78/2025/ND-CP detailing a number of articles of, and providing measures for implementing, the Law on Promulgation of Legal Documents; the Government’s Decree No. 79/2025/ND-CP dated April 01, 2025, on examination, review, systematization and handling documents; the Government’s Decree No. 187/2020/ND-CP dated July 01, 2025, amending and supplementing a number of articles of the Government’s Decree No. 78/2025/ND-CP dated April 01, 2025, detailing a number of articles of, and providing measures for implementing, the Law on Promulgation of Legal Documents, and the Government's Decree No. 79/2025/ND-CP dated April 01, 2025, on examination, review, systematization and handling documents;
Pursuant to the Government's Decree No. 40/2025/ND-CP dated February 26, 2025, defining the functions, tasks, powers and organizational structures of the Ministry of Industry and Trade; and the Government’s Decree No. 109/2025/ND-CP dated May 20, 2025, defining the functions, tasks, powers and organizational structure of the Government Inspectorate of Vietnam; the Government’s Decree No. 193/2025/ND-CP dated July 02, 2025, detailing a number of articles of, and providing measures for implementing, the Law on Geology and Minerals;
At the request of the Director of the Legal Affairs Department,
The Minister of Industry and Trade hereby promulgates the Circular on repeal of a number of legal documents under the Minister of Industry and Trade’s management.
Article 1. Entire repeal of a number of legal documents under the Minister of Industry and Trade’s management
1. The Minister of Industry's Decision No. 69/2003/QD-BCN dated April 25, 2003, promulgating regulations on coal inventory stocktaking.
2. The Minister of Industry's Decision No. 07/2006/QD-BCN dated April 11, 2006, providing for technical standards and conditions for the use of electricity as a means of direct protection.
3. The Minister of Industry's Decision No. 44/2006/QD-BCN dated December 08, 2006, prescribing rural electricity technical standards.
4. The Minister of Industry and Trade's Circular No. 40/2010/TT-BCT dated December 13, 2010, on order and procedures for settlement of disputes in the power market.
5. The Minister of Industry and Trade's Circular No. 43/2010/TT-BCT dated December 29, 2010, on regulations on safety management in industry and trade.
6. The Minister of Industry and Trade's Circular No. 45/2012/TT-BCT dated December 28, 2012, on the inspection of food safety and quality during the production of foods under the management of the Ministry of Industry and Trade.
7. The Minister of Industry and Trade’s Circular No. 14/2013/TT-BCT dated July 15, 2013, promulgating coal trading conditions.
8. The Minister of Industry and Trade’s Circular No. 15/2014/TT-BCT dated May 28, 2014, prescribing reactive power trading.
9. The Minister of Industry and Trade’s Circular No. 06/2015/TT-BCT dated April 23, 2015, amending and supplementing a number of circulars of the Ministry of Industry and Trade concerning administrative procedures in the fields of chemicals, electricity, and commodity trading through commodity exchanges.
10. The Minister of Industry and Trade's Circular No. 33/2015/TT-BCT dated October 27, 2015, providing regulations on technical safety inspection of electrical equipment and instruments.
11. The Minister of Industry and Trade’s Circular No. 24/2016/TT-BCT dated November 30, 2016, prescribing a number of measures for shortening the time required for electricity access.
12. The Minister of Industry and Trade’s Circular No. 13/2017/TT-BCT dated August 03, 2017, amending and supplementing a number of articles of articles of Circular No. 56/2014/TT-BCT on providing method to determine electricity generation prices, sequence to inspect power purchase agreement; Circular No. 30/2014/TT-BCT on operation of the competitive power generation market; and Circular No. 57/2014/TT-BCT prescribing methods and procedures for formulation and promulgation of the power generation price framework.
13. The Minister of Industry and Trade's Circular No. 21/2020/TT-BCT dated September 09, 2020, providing the order and procedures for grant of electricity activity licenses.
14. The Minister of Industry and Trade’s Circular No. 05/2021/TT-BCT dated August 02, 2021, detailing a number of contents on electricity safety.
15. The Minister of Industry and Trade's Circular No. 13/2022/TT-BCT dated August 25, 2022, annulling Clause 6 Article 7 of the Minister of Industry and Trade's Circular No. 05/2021/TT-BCT dated August 02, 2021, detailing a number of contents on electricity safety.
16. The Minister of Industry and Trade's Circular No. 10/2023/TT-BCT dated April 21, 2023, amending and supplementing a number of articles of the Minister of Industry and Trade’s Circular No. 21/2020/TT-BCT of September 9, 2020, providing for the order and procedures for grant of electricity activity licenses.
17. The Minister of Industry and Trade’s Circular No. 16/2023/TT-BCT dated August 31, 2023, providing guidance on the power purchase agreement for daily-life purpose.
18. The Minister of Industry and Trade’s Circular No. 12/2024/TT-BCT dated August 01, 2024, amending and supplementing a number of Circulars of the Minister of Industry and Trade concerning the load dispatch and operation of the national power system and the electricity market.
19. Joint Circular No. 16/2011/TTLT-BCT-BNV dated April 05, 2011, of the Minister of Industry and Trade and the Minister of Home Affairs, providing guidance on the functions, duties, powers, organizational structure, and staffing of Industrial Promotion and Industrial Development Consultancy Centers under Departments of Industry and Trade.
20. Joint Circular No. 29/2011/TTLT-BCT-BTC dated August 04, 2011, of the Minister of Industry and Trade and the Minister of Finance, providing guidance on coordinated inspection activities between Market Surveillance Authorities and Price Management Authorities.
21. Joint Circular No. 36/2012/TTLT-BCT-BCA-BTP-BYT-TANDTC-VKSNDTC dated December 07, 2012, of the Minister of Industry and Trade, the Minister of Public Security, the Minister of Justice, the Minister of Health, the Chief Justice of the Supreme People's Court, and the Procurator General of the Supreme People's Procuracy, providing guidance on handling violations relating to the trading of smuggled alcoholic beverages, smuggled tobacco products, and smuggled tobacco materials.
22. Joint Circular No. 27/2015/TTLT-BCT-BCA-VKSNDTC-TANDTC dated August 17, 2015, of the Minister of Industry and Trade, the Minister of Public Security, the Procurator General of the Supreme People's Procuracy, and the Chief Justice of the Supreme People's Court, providing guidance on the transfer of dossiers of electricity theft cases for criminal prosecution.
Article 2. Partial repeal of a number of legal documents under the Minister of Industry and Trade’s management
1. To repeal Clause 2, Article 9 of the Minister of Industry and Trade’s Circular No. 28/2024/TT-BCT dated December 25, 2024, on energy consumption norms in beer and non-alcoholic beverage production industry.
2. To repeal Clause 2, Article 9 of the Minister of Industry and Trade’s Circular No. 29/2024/TT-BCT dated December 25, 2024, prescribing energy consumption norms in the plastics manufacturing industry.
3. To remove the phrases “organizations that are” and “assigned within the competence” in Clause 2, Article 4; the phrases “organizations that are”, “assigned”, and “provincial-level People's Committees and” in Clause 3, Article 4; the phrase “assigned organizations within the competence” in Clause 1, Article 6; the phrase “organizations assigned duties” in Clause 4, Article 6; the phrases “organizations that are” and “assigned” in the title of Article 7; the phrases “ORGANIZATIONS THAT ARE” and “ASSIGNED” in the title of Appendix II; and the phrase “ASSIGNED BY THE PROVINCIAL-LEVEL PEOPLE'S COMMITTEE” in Appendix IV of the Minister of Industry and Trade's Circular No. 40/2025/TT-BCT dated June 22, 2025, on issuance of certificates of origin and written approvals for traders to self-certify the origin of exports under Clause 6, Article 28 of the Government’s Decree No. 146/2025/ND-CP dated June 12, 2025, on the delegation of powers and decentralization in the field of industry and trade.
4. To remove the phrase “organizations that are” and the phrase “assigned” in Clause 2, Article 4 of the Minister of Industry and Trade’s Circular No. 44/2025/TT-BCT dated July 07, 2025, on the Rules of Origin in the Agreement Establishing the ASEAN-Australia-New Zealand Free Trade Area.
5. To remove the phrase “organizations that are” and the phrase “assigned” in Clause 2, Article 4 of the Minister of Industry and Trade’s Circular No. 49/2025/TT-BCT dated September 09, 2025, providing for the Rules of Origin of Goods under the Trade in Goods Agreement within the Framework Agreement on Comprehensive Economic Cooperation among the Governments of member countries of the Association of Southeast Asian Nations and the Government of the Republic of Korea.
Article 3. Effect
1. This Circular takes effect from May 01, 2026.
2. The Director of the Legal Affairs Department, the Chief of the Ministry Office, Heads of units under the Ministry of Industry and Trade and relevant agencies, organizations and individuals shall implement this Circular./.
