SUMMARY

List of products, goods subject to certification before customs clearance under the Ministry of Transport’s management

The Circular No. 12/2022/TT-BGTVT providing the List of potentially unsafe products and goods subject to the state management by the Ministry of Transport is issued on June 30, 2022 by the Ministry of Transport.

Accordingly, to promulgate the List of potentially unsafe products and goods subject to certification before customs clearance (regarding import), or marketing (regarding manufacture and assembly), including tanker semi-trailers; container trailers; container semi-trailers; crane lorries; fire fighting vehicles; concrete-mixer lorries; spraying lorries; motorcycles (including those with side-cars); mopeds; electric bicycles; motorized bicycles, etc.

Besides, the Ministry of Transport also provides the List of products and goods subject to certification or announcement of technical regulation conformity. Such List includes: Tractor-trailers; Shuttle buses used in airports; Limousine buses (for the transport of 10 or more persons, including the driver); Prison vans; Hearses; Motorcycles, mopeds, electric bicycles and motorized bicycles for disabled persons.

Such products and goods must be registered for state inspection in terms of quality. In case HS codes specified in these Lists are different from those specified in the Vietnam’s nomenclature of exports and imports promulgated by the Ministry of Finance, the HS codes promulgated by the Ministry of Finance shall prevail.

This Circular takes effect on August 15, 2022.

CIRCULAR

Providing the List of potentially unsafe products and goods subject to the state management by the Ministry of Transport

Pursuant to the Law on Road Traffic dated November 13, 2008;

Pursuant to the Law on Product and Goods Quality dated November 21, 2007;

Pursuant to the Government’s Decree No. 132/2008/ND-CP dated December 31, 2008, detailing a number of articles of the Law on Product and Goods Quality;

Pursuant to the Government’s Decree No. 74/2018/ND-CP dated November 21, 2016, amending and supplementing a number of articles of the Government’s Decree No. 132/2008/ND-CP dated December 31, 2008;

Pursuant to the Government's Decree No. 13/2022/ND-CP dated January 21, 2022, amending and supplementing a number of articles of the Government’s Decree No. 132/2008/ND-CP dated December 31, 2008, and Decree No. 74/2018/ND-CP dated May 15, 2018, detailing a number of articles of the Law on Product and Goods Quality, and Decree No. 86/2012/ND-CP dated October 19, 2012, detailing and guiding the implementation of a number of articles of the Law on Measurement;

Pursuant to the Government’s Decree No. 12/2017/ND-CP dated February 10, 2017, defining the functions, tasks, powers and organizational structure of the Ministry of Transport;

At the proposal of the Director of the Department of Science and Technology and the Director General of Vietnam Register;

The Minister of Transport hereby promulgates the Circular providing the List of potentially unsafe products and goods subject to the state management by the Ministry of Transport.

 

Article 1. Scope of regulation

This Circular provides regulations on:

1. The List of potentially unsafe products and goods subject to the state management by the Ministry of Transport.

2. HS codes for the List of potentially unsafe products and goods subject to the state management by the Ministry of Transport.

Article 2. Subjects of application

This Circular applies to:

1. Domestic and foreign organizations and individuals that carry out activities of production, business, design and construction of potentially unsafe products and goods subject to the state management by the Ministry of Transport.

2. Organizations and individuals related to the management and assessment of the quality of potentially unsafe products and goods subject to the state management by the Ministry of Transport.

Article 3. Rules for managing the list of potentially unsafe products and goods subject to the management by the Ministry of Transport

1. Regarding the List of products and goods prescribed in the Appendix I to this Circular, the following rules shall be applied:

a) Imported products and goods must be granted technical quality and safety and environmental protection certificates according to regulations before customs clearance;

b) Products and goods that are domestically manufactured and assembled must be granted technical quality and safety and environmental protection certificates before marketing.

2. Regarding the List of products and goods prescribed in the Appendix II to this Circular, the following rules shall be applied:

a) Imported products and goods must be granted technical quality and safety and environmental protection certificates according to regulations, except for the cases specified at Point b of this Clause;

b) For imported products and goods specified in Section E Appendix II to this Circular serving the purpose of replacement or maintenance with the quantity of less than 100 products and goods of the same types in a shipment, the importers shall be announced the technical regulation conformity based on the result of self-assessment of the conformity or granted the technical quality and safety and environmental protection certificate according to regulations, if needed;

c) The certification or announcement of technical regulation conformity specified at Point a and Point b of this Clause shall be carried out after the customs clearance of imported products and goods is carried out and before they are brought into the market;

d) Products and goods that are domestically manufactured and assembled must be granted technical quality and safety and environmental protection certificates before marketing.

3. The Vietnam Register shall receive the dossiers for announcement of technical regulation conformity for products and goods as prescribed by law.

Article 4. Principles of application

1. Products and goods in the Lists provided in Appendix I and Appendix II to this Circular must be registered for state inspection in terms of quality.

2. In case only 4-digit codes are listed, all 8-digit codes of this 4-digit group shall be applied, provided that they are conformable with the name specified in the certificate of quality.

3. In case only 6-digit codes are listed, all 8-digit codes of this 6-digit group shall be applied, provided that they are conformable with the name specified in the certificate of quality.

4. In case HS codes specified in Appendix I and Appendix II to this Circular are different from those specified in the Vietnam’s nomenclature of exports and imports promulgated by the Ministry of Finance, the HS codes promulgated by the Ministry of Finance shall prevail.

Article 5. Effect

1. This Circular takes effect on August 15, 2022 and replaces the Minister of Transport’s Circular No. 41/2018/TT-BGTVT dated July 30, 2018, on the list of potentially unsafe commodities under the management of the Ministry of Transport.

2. For imported products and goods of which the date of arriving ports or border gates, or the date of opening the import declaration as prescribed by the Customs Law; and assembled products and goods of which the date of manufacture is before the effective date of this Circular, provisions of the Minister of Transport’s Circular No. 41/2018/TT-BGTVT dated July 30, 2018, on the list of potentially unsafe commodities under the management of the Ministry of Transport shall be applied.

3. In case legal normative documents, technical regulations and standards referred to in this Circular are amended, supplemented or replaced, the new ones shall prevail.

Article 6. Responsibility of implementation

1. Directorates and Departments affiliated to the Ministry of Transport shall:

a) Implement this Circular;

b) Review the List of products and goods under the management;

c) Coordinate with the Vietnam Register in proposing the Ministry of Transport to consider amending and supplementing the List of potentially unsafe products and goods subject to the management.

2. Any difficulties arising in the course of implementation should be promptly reported to the Ministry of Transport for consideration and settlement.

Article 7. Implementation organization

Chief of the Ministry Office, Chief Inspector of Ministry, Directors, Director General of Directorate for Roads of Vietnam, Director General of Vietnam Inland Waterway Administration, Director General of the Vietnam Maritime Administration, Director General of Vietnam Railway Authority, Director General of Civil Aviation Authority of Vietnam, heads of relevant agencies, units and individuals shall implement this Circular./.
