Circular No. 11/2018/TT-BTTTT dated October 15, 2018 of the Ministry of Information and Communications on detailing List of used information technology products prohibited from import with their HS codes
Pursuant to the Law on Information Technology dated June 29, 2006;
Pursuant to the Law on Foreign Trade Management dated June 12, 2017;
Pursuant to the Government’s Decree No. 69/2018/ND-CP dated May 15, 2018 on guidelines of the Law on Foreign Trade Management;
Pursuant to the Government’s Decree No. 17/2017/ND-CP dated February 17, 2017 on defining the functions, tasks, powers and organizational structure of the Ministry of Information and Communications;
At the request of the Director of the Department of Information Technology,
The Minister of Information and Communications hereby promulgates a Circular on detailed list of used information technology products prohibited from import with their HS codes.
Article 1. Scope of adjustment and subjects of application
a) Scope of adjustment
This Circular provides a detailed List of used information technology products prohibited from import with their HS Codes (hereinafter referred to as “the List”).
b) Subjects of application
This Circular applies to regulatory authorities, organizations and individuals involved in or related to the import of used IT products.
Article 2. Rules for compilation and regulations on application of the List
1. Rules for compilation of the List
a) The List is compiled according to the Circular No. 65/2017/TT-BTC dated June 27, 2017 of the Minister of Finance on promulgating the List of Vietnam’s posts and exports.
b) The List is amended according to the development and other regulations in each specific period.
2. Regulations on application of the List
a) If a 4-digit code is stated, all 8-digit codes thereof are included. If a 6-digit code is stated, all 8-digit codes thereof are included. If 8-digit codes are specified, only those 8-digit codes are included.
b) Used parts, accessories and knock-down kits of the articles on the List are also prohibited from import.
c) Color digital printers or photocopy machines that are imported shall comply with regulations of law on printing. Used digital printers and monochrome digital photocopying apparatus whether or not combined with other functions with their HS Codes on the List, having ability to print/copy A0 papers or having printing/copying speed of 35 copies of A4 or larger papers per minute and used laser printer cartridges (HS Code 8443.99.20) are not prohibited from import.
d) A refurbished IT product refers to the used IT product that has been repaired, has its parts replaced or undergone other refurbishing processes so that it can function like a new one; its label is in either Vietnamese or foreign language but must clearly indicate that this is a refurbished product; warranty policy of a refurbished IT product is same as that of a new product of the manufacturer. Refurbished IT products with their HS Codes on the List provided in the Appendix hereof are prohibited from import.
Article 3. Effect
1. This Circular takes effect on November 30, 2018.
2. This Circular replaces Article 3 and Appendix 01 of the Circular No. 31/2015/TT-BTTTT dated October 10, 2015 of the Minister of Information and Communications guiding a number of articles of Decree No. 187/2013/ND-CP dated November 20, 2013 of the Government on the export and import of used information technology products.
Article 4. Implementation organization
1. Heads of affiliates of the Ministry of Information and Communications, organizations and individuals mentioned in Article 1 are responsible for the implementation of this Circular.
2. Difficulties that arise during the implementation of this Circular should be promptly reported to the Ministry of Information and Communications (the Department of Information Technology) for guidance./.
