THE MINISTRY OF NATURAL RESOURCES AND ENVIRONMENT

Circular No.11/2015/TT-BTNMT dated March 31, 2015 of the Ministry of Natural Resources and Environment prescribing the national technical regulation on environment

Pursuant to the Law on Technical Standards and Regulations dated June 29, 2006;

Pursuant to the Law on Environment Protection dated June 23, 2014;

Pursuant to the Government s Decree No. 127/2007/NĐ-CP dated August 01, 2007 providing the specific regulation on the implementation of a number of articles of the Law on Technical Standards and Regulations;

Pursuant to the Government’s Decree No. 21/2013/NĐ-CP dated March 4, 2013 on defining the functions, tasks, powers and organizational structure of the Ministry of Natural Resources and Environment;

At the request of the Director General of the Vietnam Environment Administration, the Director of the Department of Science and Technology and the Director of the Department of Legal Affairs;

The Minister of Natural Resources and Environment hereby promulgates the Circular on stipulating the national technical regulation on environment:

Article 1.The National technical regulation on environment: QCVN 01-MT: 2015/BTNMT – National technical regulation on the effluent of natural rubber processing industry shall be issued together with this Circular.

Article 2.This Circular takes effect on June 1, 2015.

Article 3.The Director General of Vietnam Environment Administration, the Head of affiliates of the Ministry of Natural Resources and Environment, the Director of the Department of Natural Resources and Environment of central-affiliated cities or provinces, along with relevant organizations or individuals, shall be responsible for implementing this Circular./.

NATIONAL TECHNICAL REGULATION ON THE EFFLUENT OF NATURAL RUBBER PROCESSING INDUSTRY

Preface

QCVN 01-MT:2015/BTNMT is edited and revised from QCVN 01:2008/BTNMT by the editorial board for the national technical regulation on the effluent of natural rubber processing industry; The Environment Administration, the Department of Science and Technology, and the Department of Legal Affairs, shall submit this regulation for approval. This regulation shall be issued together with the Circular No. 11/2015/TT-BTNMT of the Minister of Natural Resources and Environment dated March 31, 2015.

 

NATIONAL TECHNICAL REGULATION ON THE EFFLUENT OF NATURAL RUBBER PROCESSING INDUSTRY

1. GENERAL PROVISIONS

1.1. Scope of application

This Regulation shall stipulate the maximum permissible value of parameters of pollutants in the effluent of the natural rubber processing industry discharged into the receiving waters.

1.2. Applicable entities

1.2.1. This Regulation shall particularly apply to the effluent of natural rubber processing industry. All organizations or individuals involving the discharge of the effluent of natural rubber processing industry into the receiving waters must comply with provisions laid down in this Regulation.

1.2.2. The effluent of natural rubber processing industry discharged into the collection system of centralized wastewater treatment plant must conform to regulations set forth by the organization in charge of managing and operating that centralized wastewater treatment plant.

1.3. Interpretation of terms

Terms used in this Regulation shall be construed as follows:

1.3.1.The effluent of natural rubber processing industryrefers to the industrial wastewater drained from factories or manufacturing facilities which employing methods for manufacturing and processing of natural rubber latex into products such as block, sheet, crepe rubber and latex concentrate used as materials to create rubber products.

1.3.2.New facilityrefers to natural rubber processing factories or facilities which operate after the effective date of this Regulation, including those which are under construction and have obtained the approval for the report on environmental impact assessment and make environment protection commitments before the effective date of this Regulation.

1.3.3.Existing facilityrefers to natural rubber processing factories or facilities that operate before the effective date of this Regulation.

1.3.4.Receiving waterrefers to the wastewater disposal system of an urban, residential area, industrial zone and industrial complex; rivers, streams, canals and channels; lake, pond or wetland; near-coastal waters used for definite purposes.

2. TECHNICAL REGULATION

2.1.This Regulation shall specify the maximum permissible value of parameters of pollutants in the effluent of the natural rubber processing industry discharged into the receiving waters.

2.1.1. The maximum permissible value of parameters of pollutants in the effluent of the natural rubber processing industry discharged into the receiving waters shall be calculated as follows:

Cmax= C x Kqx Kf

Where:

- Cmaxdenotes the maximum permissible value of parameters of pollutants in the effluent of natural rubber processing industry discharged into the receiving waters.

- C denotes the value of parameter of pollutants in the effluent of natural rubber processing industry stipulated in section 2.2;

- Kqdenotes the coefficient of the receiving water stipulated in section 2.3 equivalent to the flow of water in a river, stream, channel, canal or ditch; the volume of lake, bond and wetland; the use purpose of the near-coastal waters;

- Kfdenotes the discharge flow coefficient stipulated in section 2.4 equivalent to the aggregated flow of the effluent of natural rubber processing industry discharged into the receiving waters;

2.1.2. The maximum permissible value of Cmax= C (except for the coefficient Kqand Kf) shall be applied to the pH parameter.

2.1.3. The effluent of natural rubber processing industry discharged into the waste water disposal system of an urban or residential area where none of centralized wastewater treatment plants is developed shall apply the value Cmax= C stipulated at the column B, Schedule 1.

2.2. The value C used as the basis for calculating the maximum permissible value of parameters of pollutants

The column A of Schedule 1 displays the value C of parameters of pollutants in the effluent of natural rubber processing industry discharged into the water sources used for the purpose of supplying water to daily human activities;

The column B of Schedule 1 displays the value C of parameters of pollutants in the effluent of natural rubber processing industry discharged into the water sources which are not used for the purpose of supplying water to daily human activities;

The use purpose of the receiving water is determined at the wastewater receiving facility.

As from January 1, 2020, the statutory value applied to new facilities shall be so applied to all natural rubber processing facilities.

2.3.Coefficient of the receiving water Kq

2.3.1. The coefficient Kqequivalent to the flow of water in rivers, streams, channels, canals and ditches stipulated by Schedule 2 as follows:

Q is calculated by determining the mean value of the flow of the receiving water observed in 03 driest months of 03 successive years (data provided by the meteorology and hydrology center).

2.3.2. The coefficient Kqequivalent to the volume of the receiving water in lakes, ponds and wetlands stipulated in Schedule 3 as follows:

V is calculated by determining the average value of the volume of the receiving water in lakes, ponds and wetlands during 03 months when the lowest water level is recorded in 03 successive years (based on the data provided by the meteorology and hydrology center).

2.3.3. If the receiving water is not given the data about the flow of receiving water in rivers, streams, canals, channels and ditches, the coefficient Kq= 0.9 shall be applicable; If the receiving water is not given the data about the volume of receiving water in lakes, ponds and wetlands, the coefficient Kq= 0.6 shall be applicable.

2.3.4. The coefficient Kqfor the receiving water which is the near-coastal waters, or receiving waters in salt and brackish lagoons.

The near-coastal waters used for the purpose of aquatic life protection, water sports and entertainment services, the salt and brackish lagoon, shall take the coefficient value Kq= 1.

The near-coastal waters which are not used for the purpose of aquatic life protection, water sports and entertainment services shall take the coefficient value Kq= 1.3.

2.4. Coefficient of the discharge flow Kf

Coefficient of the discharge flow Kfis stipulated in the Schedule 4 as follows:

The discharge flow F is calculated on the basis of the maximum value of discharge flow shown in the report on environmental impact assessment, environment protection commitment, project and proposal, or the Certificate of completion of construction works, and measures for environmental protection approved by competent authorities.

If the discharge flow F changes and is not consistent with the coefficient value Kfcurrently applied, the natural rubber processing facility must report to competent authorities to have it adjusted.

2.5. Using the effluent for watering trees

The effluent drained from natural rubber processing facilities shall be reused to water trees if it meets the following requirements:

- The maximum permissible value of parameters, such as pH, BOD5and COD, must conform to statutory requirements stipulated in the column B of the Schedule 1 (Kq= 1; Kf= 1);

- The treated effluent shall be collected into the reservoir to serve the watering purpose. The reservoir must conform to technical requirements for environmental protection as follows:

- The Department of Natural Resources and Environment must be notified in writing of the watering plan or proposal in order to collaboration in performing their supervision tasks;

- Enterprises discharging the effluent shall only be permitted to use their effluent to water their own trees.

3.DETERMINATION METHOD

3.1. Method for sampling and determination of the value of parameters of factors in the effluent of natural rubber processing industry shall conform to the following standards:

3.2.Examination methods mentioned in the guidance provided in other national and international regulations which have proved their accuracy equal to or higher than those mentioned in regulations referred to at section 3.1 shall be accepted.

4.IMPLEMENTATION

4.1.This Regulation shall replace QCVN 01:2008/BTNMT - National technical regulation on the effluent of natural rubber processing industry issued together with the Decision No. 04/2008/QĐ-BTNMT of the Minister of Natural Resources and Environment dated July 18, 2008.

4.2.Environment-related regulatory agencies shall be responsible for providing guidance on, inspecting and supervising the implementation of this Regulation.

4.3.In case standards for examination methods referred to in this regulation have been changed, amended or replaced, the new standard shall be applicable.
