Circular No. 11/2013/TT-BLDTBXH of June 11, 2013, promulgating the list of light jobs allowed for employment of persons aged under 15 years
Pursuant to the June 18, 2012 Labor Code;
Pursuant to the Government’s Decree No. 106/2012/ND-CP of December 20, 2012, defining the functions, tasks, powers and organizational structure of the Ministry of Labor, War Invalids and Social Affairs;
At the proposal of the Director of the Occupational Safety Department,
The Minister of Labor, War Invalids and Social Affairs promulgates the Circular providing the list of light jobs allowed for employment of persons aged under 15 years.
Article 1.
1. To promulgate together with this Circular the list of light jobs allowed for employment of persons aged under 15 years.
2. This Circular applies to enterprises, agencies, organizations, cooperatives, households and individuals that hire or employ persons under labor contracts (below referred to as employers).
Article 2.
1. Responsibilities of employers
a/ To review jobs which persons aged under 15 years are doing; to employ persons aged under 15 years only in light jobs according to the list promulgated together with this Circular;
b/ When recruiting a person aged under 15 years, to obtain a certificate of a competent medical examination and treatment establishment that such person’s health is suitable to the intended job; to organize health check at least once every 6 months;
c/ To comply with provisions on employment of persons aged under 15 years in Clause 2, Article 162, Clauses 2 and 5, Article 163 and Clause 2, Article 164 of the Labor Code;
d/ To ensure occupational hygiene at workplace under current regulations and standards;
dd/ When recruiting persons aged under 15 years for the first time, to notify in writing to the Labor, War Invalids and Social Affairs Departments of provinces or centrally run cities (below referred to as provincial-level Labor, War Invalids and Social Affairs Departments) where their head offices are located, within 30 days after the recruitment, according to the form provided in the Appendix to this Circular;
e/ To annually send a report on the employment of persons aged under 15 years together with a report on occupational safety and hygiene to provincial-level Labor, War Invalids and Social Affairs Departments.
2. Responsibilities of provincial-level Labor, War Invalids and Social Affairs Departments:
a/ To coordinate with provincial-level Health Departments and local Labor Federations in regularly disseminating, examining and supervising the implementation of this Circular;
b/ To enhance inspection and promptly handle violations of the law on employment of persons aged under 15 years;
c/ To annually summarize and send a report on the implementation of this Circular together with a report on occupational safety and hygiene in their localities to the Ministry of Labor, War Invalids and Social Affairs.
Article 3.
1. This Circular takes effect on August 1, 2013.
2. To annul the Labor, War Invalids and Social Affairs Ministry’s Circular No. 21/1999/TT-BLDTBXH of September 11, 1999, providing the list of occupations, jobs and conditions for employment of children aged under 15 years on the effective date of this Circular.
3. Any problems arising in the course of implementation should be reported to the Ministry of Labor, War Invalids and Social Affairs for consideration and settlement.-

LIST OF JOBS ALLOWED FOR EMPLOYMENT OF PERSONS AGED UNDER 15 YEARS
(Promulgated together with the Labor, War Invalids and Social Affairs Minister’s Circular No. 11/2013/TT-BLDTBXH of June 11, 2013)
I. List of jobs allowed for employment of persons aged under 13 years
1. Actors and actresses; dancers; singers; circus actors and actresses, movie actors and actresses; theatrical actors and actresses, actors and actresses in classical drama, traditional operetta, reformed theater and puppeteers (except water puppetry)
2. Gifted athletes of: gymnastics, swimming, athletics (except chained dumbbell), table tennis, badminton, basketball, handball, billiards, football, martial arts, shuttlecock kicking, sepaktakraw, chess, Chinese chess and volleyball.
II. List of jobs allowed for employment of persons aged from full 13 years to under 15 years
1. Jobs allowed for employment of persons aged under 13 years.
2. Traditional jobs: drawing on ceramics, sawing clam shells, making lacquer paintings, making poonah papers, making conical hats, making incense, sewing conical hats, weaving mats, making drums, weaving brocade, making rice vermicelli, making bean sprouts, making rice papers, making Ke rice pancakes.
3. Handicraft: embroidery and lace making, fine art woodworking, making horn combs, weaving fishing nets, making Dong Ho paintings, making toy figurines (to he).
4. Weaving and making household items and handicrafts from natural materials such as rattan, bamboo, neohouzeaua, coconut, banana and water hyacinth.
5. Raising silkworms.
6. Packing coconut candy.-
