Circular No. 11/2012/TT-BTTTT of July 17, 2012, promulgating a list of used information technology appliances banned from import
1. Scope of regulation
a/ Promulgated together with this Circular is a list of used information technology appliances banned from import (below referred to as the import ban list);
b/ Provisions of this Circular are applicable to the import ban list.
2. Subjects of application
This Circular applies to agencies, organizations and individuals involved in importing commodities on the list of commodities banned from import in Vietnam.
1. Service of repair, renewal or remanufacture of information technology appliances means the replacement of parts, assembly, repair, functional restoration or upgrading or renewal of used information technology machinery and equipment.
2. Refurbished, renewed or remanufactured information technology appliance means a used appliance which has been repaired, had its parts replaced or its functions and appearance restored to be like the brand-new appliance of the same type.
1. The list is established based on the list of commodities and HS codes in the Import and Export Tariff.
The list bans the import of only commodities with 8-digit HS codes. The 4- and 6-digit HS codes in the list are solely intended to clarify information on the categories of commodities banned with 8-digit HS codes.
2. Used parts, accessories and assemblies of used parts and accessories of products on the import ban list are also banned from import.
3. This list will be supplemented or amended to suit the development of information technology and other relevant laws.
4. A refurbished and renewed product must have a sign and label in Vietnamese (tan trang, tai san xuat, lam moi, tai su dung) or English (refurbished, remanufactured, renewed, recycled, reused) in its wrapping.
5. The import under Clause 1, Article 4 of this Circular must comply with the following regulations:
a/ All products, after being repaired, renewed or remanufactured, must be re-exported. Discarded materials and stuffs from the production must be processed under the environmental law or re-exported together with products;
b/ Annually, organizations and individuals shall report on the quantity of imports, re-exports and stocks (according to the form provided in Appendix 2 to this Circular - not translated) and send copies of import and export declarations to the Ministry of Information and Communications;
c/ The Ministry of Information and Communications shall coordinate with related agencies in conducting regular or extraodinary inspection in the course of implementation.
6. The import under Clause 8, Article 4 of this Circular must comply with the following regulations:
a/ Annually, organizations and individuals shall report on the quantity of imports, exports, domestically distributed goods or stocks (according to the form provided in Appendix 3 to this Circular - not translated) and send copies of import and export declarations to the Ministry of Information and Communications;
b/ The Ministry of Information and Communications shall coordinate with related agencies in conducting regular or extraodinary inspection in the course of implementation.
1. Those imported for provision of repair, renewal or remanufacture services and re-exported after production.
2. Those imported for use as direct production means or samples for designing, and research and development (R&D).
3. Those re-imported after being brought abroad for warranty, maintenance, repair or renewal.
4. Those imported in the form of transfer of production means within an agency or organization.
5. Import of special-use information technology appliances with special functions for specific purposes such as measurement and automation for use as medical and biological equipment or other purposes, which are within 3 years from the date of manufacture to the date of making customs declarations.
6. Those imported for use as production means, control, operation, exploitation and checking of part or the whole of production systems or chains.
7. Import of refurbished, renewed or remanufactured information technology appliances for production under specific projects, which bring about socio-economic benefits or serve security and defense purposes.
8. Import of used printer cartridges which will be repaired, renewed or remanufactured for supply and distribution in the domestic market or re-export.
9. Import for other special purposes must comply with specific guidance of the Ministry of Information and Communications.
1. This Circular takes effect on September 1, 2012.
2. This Circular replaces the Minister of Information and Communications’ Circular No. 43/2009/TT-BTTTT of December 30, 2009, promulgating a list of used information technology appliances banned from import and other previous guiding documents of the Ministry of Information and Communications which are contrary to this Circular.
3. Organizations and individuals that violate regulations on import of used information technology appliances shall be fined under the law on violations in import and export.
1. Heads of agencies and units of the Ministry of Information and Communications and agencies, organizations and individuals specified in Article 1 shall implement this Circular.
2. Any problems arising in the course of implementation should be promptly reported to the Ministry of Information and Communication for timely settlement.-
