CIRCULAR

ISSUING "NATIONAL TECHNICAL REGULATION ON ELECTROMAGNETIC COMPATIBILITY OF ELECTRONIC EQUIPMENT AND ELECTRICAL APPLIANCES AND OTHER SIMILAR PURPOSES”

 

Pursuant to the Law on Standards and Technical Regulations dated June 29, 2006;

Pursuant to the Decree No.127/2007/ND-CP dated August 01, 2007 of the Government detailing the implementation of some Articles of the Law on Standards and Technical Regulations;

Pursuant to the Decree No.28/2008/ND-CP dated March 14, 2008 of the Government regulating functions, duties, powers and organizational structure of Ministry of Science and Technology;

At the Proposal of the General Director of Directorate for Standards, Metrology and Quality,

Minister of Science and Technology issues The National Technical Regulations on electromagnetic compatibility of electric equipment and electronic appliances and other similar purposes.

Article 1.Issue together with this Circular the National Technical Standards on electromagnetic compatibility of electric equipment and electronic appliances and other similar purposes (QCVN 9:2012/BKHCN).

Bulbs with Ballast assembled together This Circular shall take effect from June 01, 2012.

Article 3.Since June 01, 2013, the electrical and electronic equipment from No.1 to No.2 stated in Annex QCVN 9:2012/BKHCN is required to apply the provisions of this National Technical Regulation.

Since June 01, 2014, the electrical and electronic equipment from No.3 to No.7 stated in Annex QCVN 9:2012/BKHCN is required to apply the provisions of this National Technical Regulation.

Article 4.From the effective date of this Circular to the time specified in Article 3 of the Circular, the agencies, organizations and individuals engaged in activities related to the manufacture, import, distribution and retail of electrical and electronic equipment must prepare the necessary conditions to apply the provisions of this National Technical Regulation.

Article 5.General Director of Directorate for Standards, Metrology and Quality, heads of concerned agencies, organizations and individuals shall implement this Circular.

In the process of implementation, if any problem arises, the agencies, organizations and individuals should promptly report to the Ministry of Science and Technology for study, amendment and supplement./.

NATIONAL TECHNICAL REGULATION

ON ELECTROMAGNETIC COMPATIBILITY OF ELECTRONIC EQUIPMENT AND ELECTRICAL APPLIANCES AND OTHER SIMILAR PURPOSES

Preamble

QCVN 9: 2012/BKHCN was compiled by the drafting committee of national technical regulation on electromagnetic compatibility of electrical and electronic equipment, was submitted for approval by the Directorate for Standards, Metrology and Quality and was issued under the Circular No.11/2012/TT-BKHCN dated April 12, 2012 by the Minister of Science and Technology.

 

NATIONAL TECHNICAL REGULATION

ON ELECTROMAGNETIC COMPATIBILITY OF ELECTRONIC EQUIPMENT AND ELECTRICAL APPLIANCES AND OTHER SIMILAR PURPOSES

1. GENERAL PROVISIONS

1.1. Scope of governing

This Technical Regulation specifies the technical requirements and management requirements for emission limits of electromagnetic interference emitted from electrical equipment and electronic appliances and other similar purposes.

This Technical Regulation does not provide for immunity of electrical and electronic equipment.

List of electrical and electronic equipment under the scope of this Technical Regulation is specified in Appendices of this Technical Regulation and may be amended, supplemented, annulled by decision of the Minister Ministry of Science and Technology.

1.2. Subjects of application

This Regulation applies to:

1.2.1. Organizations and individuals producing, importing, distributing and retailing (hereinafter referred to as the enterprises) electrical and electronic equipment within the scope specified in 1.1;

1.2.2. The State management agencies and other concerned organizations and individuals.

1.3. Interpretation of terms

In this Regulation, the following terms are construed as follows:

1.3.1. Electrical equipment and electronic appliances and other similar purposes mean the devices which are directly connected or connected through the socket or through circuit breaker to the low voltage power, used in household, in trade and in the places where have similar use purposes.

1.3.2. Electromagnetic compatibility (EMC) means the ability of satisfactory operation of the equipment or system in the electromagnetic environment without introducing excessive electromagnetic interference affecting the proper function of other equipment in that environment.

1.3.3. Electromagnetic Interference means a certain electromagnetic phenomena that can degrade the performance of a structure, device, equipment, or system.

Electromagnetic Interference includes conductivity interference and radiation interference.

1.3.4. Degradation of performance means an undesirable variation on the working features of structure, equipment or system compared with desired features.

1.3.5. Low voltage power source means AC source of 50 Hz frequency and voltage not exceeding 1,000 V or DC source with voltage not exceeding 1,500 V.

2. TECHNICAL REQUIREMENTS

2.1. The electrical and electronic equipment specified in the Appendices required ensuring electromagnetic interference emitted by them not exceeding the limits specified in the respective national standards as follows:

2.1.1. Vacuum cleaners, washing machines, refrigerators, freezers, air conditioners for household use, hand-held driller operated by motor, electric tools heating instantaneous water according to TCVN 7492-1 (CISPR 14-1 ), Electromagnetic compatibility - Requirements for electrical household appliances, electric tools and similar devices - Part 1: Emission.

2.1.2. Bulbs with Ballast assembled together according to the TCVN 7186 (CISPR 15), Limits and method of measuring radio frequency interference characteristic of lighting equipment and similar devices.

2.2.Test methods to determine the limits on electromagnetic interference for each electric and electronic device must conform to the methods specified in the respective national standards mentioned above.

3. MANAGEMENT REQUIREMENTS

3.1. Conditions for circulation in the market

The electrical and electronic equipment circulating on the market are required to have goods labels as prescribed by law on goods labeling; to perform regulation conformity certification, bring regulation conformity mark (mark CR) and subject to inspection on market of the goods quality inspection agency.

3.2. Certification of regulation conformity on EMC

3.2.1. Regulation conformity certification method

The electric and electronics equipment of domestic production, import and sales must be certified regulation conformity on EMC under the method 1 (the typical sample test) prescribed in Appendix II of the "Regulations on certification of standards conformity, certification of regulation conformity and publication of standards conformity, publication of regulation conformity" issued together with the Decision No.24/2007/QD-BKHCN dated September 28, 2007 of the Minister of Science and Technology.

Testing must be performed by laboratories designated or recognized by third party.

Effect of certificate of regulation conformity shall not exceed 3 years.

3.2.2. The regulation conformity certification organizations

The certification of regulation conformity shall be performed by certification organizations designated or recognized.

The designation of regulation conformity certification organizations on EMC for electrical and electronic equipment shall comply with the provisions in the Circular No.09/2009/TT-BKHCN dated April 08, 2009 by the Minister of Science and Technology guiding technology requirements, order and procedures for designating organizations to assess the conformity.

3.2.3. Use of the regulation conformity mark

Regulation conformity mark must comply with clause 2 of Article 4 of the "Regulations on certification of standards conformity, certification of regulation conformity and publication of standards conformity, publication of regulation conformity" issued together with Decision No.24/2007/QD-BKHCN dated September 28, 2007 of the Minister of Science and Technology.

3.3. Register

3.3.1. After enterprises producing electrical and electronic equipment have been certified regulation conformity, they must register the written publication of regulation conformity at the Branches for Standards, Metrology and Quality where the enterprises registered their business as prescribed in the Decision No.24/2007/QD-BKHCN of September 28, 2007 of the Minister of Science and Technology.

3.3.2. After enterprises importing electrical and electronic equipment have been certified regulation conformity, they must register for quality control at the inspection agencies in accordance with provisions in the Circular No.17/2009/TT-BKHCN dated June 18, 2009 by Minister of Science and Technology guiding order, procedures for quality inspection of imported goods.

3.3.3. Registration dossier comprises:

- An written registration for the publication of regulation conformity (for electrical and electronic equipment produced domestically) in the form prescribed in the Decision No.24/2007/QD-BKHCN dated September 28, 2007 of the Minister of Science and Technology; or an written registration for quality control (for imported electrical and electronic equipment) in the form prescribed in the Circular No.17/2009/TT-BKHCN dated June 18, 2009 of the Minister of Science and Technology;

- A written description of the product (name, use features, the basic parameters, list or invoices of key materials, components ...);

- The overall color images of the outside, including the photos of: the panorama, the front, the top and the sides, plug (if any); trademark (if any), labels (with the basic parameters);

- Use instruction;

- Copy of certificate of regulation conformity;

- Notification of changes relating to design, materials, manufacturing technology (if any) from the registered dossier.

4. RESPONSIBILITIES OF ORGANIZATIONS AND INDIVIDUALS

4.1. Responsibilities of the enterprises

Enterprises manufacturing, importing, distributing, retailing electrical and electronic equipment must ensure quality according to relevant regulations of the Law on Quality of Products and Goods.

Manufacturing, importing enterprises must ensure electromagnetic interference limits according to the technical regulations at Article 2, implement the regulations on management at Article 3 of this Technical Regulation.

Before selling the electrical and electronic equipment on the market, the enterprises should be responsible for affixing regulation conformity mark to electrical and electronic equipment which has been certified regulation conformity in accordance with the provisions at clause 2 of Article 4 of the "Regulations on certification of standards conformity, certification of regulation conformity and publication of standards conformity, publication of regulation conformity" issued together with the Decision No.24/2007/QD-BKHCN dated September 28, 2007 of the Minister of Science and Technology.

The enterprises are responsible for providing evidence when requested or be tested under the provisions for goods circulated on the market.

During the period of validity of the certificate of regulation conformity, the enterprises with electrical and electronic equipment which has been certified regulation conformity shall promptly notify in writing to the organization of regulation conformity certification for the changes of EMC-related essential parts of electrical and electronic equipment which has been certified.

Enterprises must record dossier not less than 10 years from the outgoing date of the final product of the design, type already registered.

4.2. Responsibilities of regulation conformity certification organizations

The regulation conformity certification organizations must perform the obligations as stipulated in the Circular No.09/2009/TT-BKHCN dated April 08, 2009 and the Circular No.11/2011/TT-BKHCN dated June 30, 2011 of the Minister of Science and Technology on amendment and supplement of some provisions of the Circular No.09/2009/TT-BKHCN.

The regulation conformity certification organizations must receive and handle notices on the enterprises’ changes of goods and products related to EMC.

The regulation conformity certification organizations must keep records of certification not less than 6 years from the date of expiry of the certificate of regulation conformity.

4.3. Responsibility of the agencies inspecting the quality of products and goods

The agencies inspecting the quality of products and goods take responsibility under the provisions of Chapter IV of the Law on Quality of Products, Goods and the related regulations.

5. ORGANIZATION OF IMPLEMENTATION

5.1.The Directorate for Standards, Metrology and Quality are responsible for guiding and supervising the implementation of this Technical Regulation.

5.2.In case the standards, documents referenced in this Technical Regulation have the changes, additions, or replacement, comply with provisions at the new documents.

5.3.In case Vietnam has signed bilateral or multilateral agreements, then comply with the provisions at such agreements./.
