Circular 08/2026/TT-NHNN amending Circular 22/2019/TT-NHNN on limits and prudential ratios for banks and foreign bank branches

CIRCULAR

Amending and supplementing Point a, Clause 4, Article 20 of Circular No. 22/2019/TT-NHNN of November 15, 2019, of the Governor of the State Bank of Vietnam, prescribing limits and prudential ratios in the operation of banks and foreign bank branches^[1]

Pursuant to Law No. 46/2010/QH12 on the State Bank of Vietnam;

Pursuant to Law No. 32/2024/QH15 on Credit Institutions, which is amended and supplemented by Law No. 96/2025/QH15;

Pursuant to the Government’s Decree No. 26/2025/ND-CP of February 24, 2025, defining the functions, tasks, powers and organisational structure of the State Bank of Vietnam;

At the proposal of the Director of the Department of Credit Institution System Security;

The Governor of the State Bank of Vietnam promulgates the Circular amending and supplementing Point a, Clause 4, Article 20 of Circular No. 22/2019/TT-NHNN of November 15, 2019, of the Governor of the State Bank of Vietnam, prescribing limits and prudential ratios in the operation of banks and foreign bank branches.

Article 1. To amend and supplement Point a, Clause 4, Article 20 as follows:

 “a/ Deposits of domestic and foreign institutions (including also deposits of other credit institutions and foreign bank branches), except:

 (i) Marginal deposits and specific-purpose deposits of clients;

(ii) Demand deposits of the State Treasury;

(iii) Eighty per cent of the balance of term deposits of the State Treasury.”

Article 2. Effect

1. This Circular takes effect on May 15, 2026.

2. To annul Clause 1, Article 1 of Circular No. 26/2022/TT-NHNN of December 31, 2022, amending and supplementing a number of articles of Circular No. 22/2019/TT-NHNN of November 15, 2019, of the Governor of the State Bank of Vietnam, prescribing limits and prudential ratios in the operation of banks and foreign bank branches.

Article 3. Organisation of implementation

Heads of the units under the State Bank of Vietnam, banks, foreign bank branches, related organisations and individuals shall organise the implementation of this Circular.-
