CIRCULAR

Providing for forms in copyright registration and related rights registration activities

Pursuant to the Law on Intellectual Property No. 50/2005/QH11, amended and supplemented under Law No. 36/2009/QH12, Law No. 42/2019/QH14, Law No. 07/2022/QH15, Law No. 93/2025/QH15 and Law No. 131/2025/QH15;

Pursuant to the Government’s Decree No. 17/2023/ND-CP dated April 26, 2023, detailing a number of articles of, and providing measures to implement, the Law on Intellectual Property regarding copyright and related rights, amended and supplemented under Decree No. 134/2026/ND-CP;

Pursuant to the Government's Decree No. 43/2025/ND-CP dated February 28, 2025, defining the functions, tasks, powers and organizational structure of the Ministry of Culture, Sports and Tourism;

At the proposal of the Director of the Copyright Office of Vietnam;

The Minister of Culture, Sports and Tourism hereby promulgates the Circular providing for forms in copyright registration and related rights registration activities.

Article 1. Scope of regulation

This Circular details provisions of Clause 4 Article 50 and Clause 4 Article 51 of the Law on Intellectual Property No. 50/2005/QH11 as amended and supplemented under Law No. 36/2009/QH12, Law No. 42/2019/QH14, Law No. 07/2022/QH15, Law No. 93/2025/QH15 and Law No. 131/2025/QH15 regarding forms in copyright registration and related rights registration activities.

Article 2. Subjects of application

This Circular applies to agencies, organizations, and individuals participating in copyright registration and related rights registration activities.

Article 3. Forms promulgated together with the Circular

1. Forms of declarations for copyright registration and related rights registration prescribed in Appendix I to this Circular include:

a) Form No. 01: Declaration requesting issuance of a certificate of copyright registration for literary and scientific works; lectures, speeches and other addresses; data compilations; press works; folklore and folk-art works; and other works expressed in written language or other characters;

b) Form No. 02: Declaration requesting issuance of a certificate of copyright registration for works of applied art;

c) Form No. 03: Declaration requesting issuance of a certificate of copyright registration for computer programs;

d) Form No. 04: Declaration requesting issuance of a certificate of copyright registration for musical works;

dd) Form No. 05: Declaration requesting issuance of a certificate of copyright registration for fine-art works and photographic works;

e) Form No. 06: Declaration requesting issuance of a certificate of copyright registration for cinematographic works and stage works;

g) Form No. 07: Declaration requesting issuance of a certificate of copyright registration for textbooks and teaching materials;

h) Form No. 08: Declaration requesting issuance of a certificate of copyright registration for architectural works, sketches, diagrams, maps and drawings related to topography, architecture and scientific works;

i) Form No. 09: Declaration requesting issuance of a certificate of related rights registration;

k) Form No. 10: Declaration requesting re-issuance of a certificate of copyright registration;

l) Form No. 11: Declaration requesting re-issuance of a certificate of related rights registration;

m) Form No. 12: Declaration requesting renewal of a certificate of copyright registration;

n) Form No. 13: Declaration requesting renewal of a certificate of related rights registration;

o) Form No. 14: Declaration requesting invalidation of a certificate of copyright registration/certificate of related rights registration.

Appendices:

- Author’s/co-authors’ undertaking on the creation of the work (in case the author/co-authors are not simultaneously the signatory in the declaration requesting issuance of a certificate of copyright registration accompanying Form No. 01, 02, 03, 04, 05, 06, 07 or Form No. 08 of this Appendix);

- Description and undertaking on the use of artificial intelligence systems supporting the process of creation of the work (in case artificial intelligence systems are used in the process of creation of the work accompanying Form No. 01, 02, 03, 04, 05, 06, 07 or Form No. 08 of this Appendix);

- Description and undertaking on the use of artificial intelligence systems supporting the process of fixation or performance of performances/phonograms, video recordings/broadcast programs (in case artificial intelligence systems are used in the process of fixation or performance of performances/phonograms, video recordings/broadcast programs accompanying Form No. 09 of this Appendix).

2. Forms of certificates of copyright registration and forms of certificates of related rights registration prescribed in Appendix II to this Circular:

a) Form No. 01: Certificate of copyright registration;

b) Form No. 02: Certificate of related rights registration;

c) Form No. 03: Certificate of copyright registration (in case of renewal or re-issuance);

d) Form No. 04: Certificate of related rights registration (in case of renewal or re-issuance).

The forms prescribed in this Clause are designed for use on A4-size paper.

Article 4. Effect

1. This Circular takes effect from the date of its signing.

2. Circular No. 08/2023/TT-BVHTTDL dated June 02, 2023, of the Minister of Culture, Sports and Tourism, providing for forms in copyright registration and related rights registration activities, Article 12 and Appendix 1a of Circular No. 21/2025/TT-BVHTTDL dated December 26, 2025, of the Minister of Culture, Sports and Tourism, amending and supplementing a number of articles of Circulars on administrative procedures related to production and business activities under the Ministry of Culture, Sports and Tourism’s management, cease to be effective from the effective date of this Circular.

Article 5. Transitional provisions

1. Dossiers for copyright registration or related rights registration submitted to competent state agencies before the effective date of this Circular, shall continue to be processed in accordance with the legal documents in force at the time of dossier submission.

2. Certificates of copyright registration and certificates of related rights registration issued before the effective date of this Circular shall remain valid.

Article 6. Implementation organization

1. The Copyright Office of Vietnam, agencies, organizations, and individuals participating in copyright registration and related rights registration activities shall implement this Circular.

2. Any difficulties arising in the course of implementation should be promptly reported to the Ministry of Culture, Sports and Tourism (through the Copyright Office of Vietnam) for review and settlement./.
