CIRCULAR
Providing “National technical regulation on LED lighting products”

Pursuant to the Law on Standards and Technical Regulations dated June 29, 2006;
Pursuant to the Government’s Decree No. 127/2007/ND-CP dated August 01, 2007 on detailing the implementation of a number of Articles of the Law on Standards and Technical Regulations and the Government’s Decree No. 78/2018/ND-CP dated May 16, 2018 on amending and supplementing a number of Articles of the Decree No. 127/2007/ND-CP;
Pursuant to the Government’s Decree No. 95/2017/ND-CP dated August 16, 2017 on defining the functions, tasks, powers and organizational structure of the Ministry of Science and Technology;
At the proposal of the General Director of the Directorate for Standards, Metrology and Quality and the Legal Department;
The Minister of Science and Technology hereby promulgates the Circular providing “National technical regulation on LED lighting products”.
Article 1.To issue with this Circular the National technical regulation on LED lighting products (QCVN 19:2019/BKHCN).
Article 2.This Circular takes effect on December 31, 2019.
Article 3.Transitional provisions
Products specified in Appendix attached to the National technical regulation QCVN 19:2019/BKHCN that are produced and imported before the roadmap as prescribed in Clauses 1 and 2 Article 4 shall continue to be circulated on market until June 01, 2022.
Article 4.Roadmap for applying the National technical regulation
1. From June 01, 2020, products manufactured domestically and imported in the Appendix attached to the National technical regulation QCVN 19:2019/BKHCN must meet requirements for safety and limit of electromagnetic interference (EMI) as prescribed in Sections 2.1.1; 2.1.2; 2.1.3 and 2.2.1 of this National technical regulation before circulating on market.
2. From June 01, 2021, products specified in the Appendix attached to the National technical regulation QCVN 19:2019/BKHCN must fully meet requirements as prescribed in Section 2 of this National technical regulation before circulating on market.
3. Enterprises, organizations and individuals manufacturing and importing LED lighting products are encouraged to comply with the National technical regulation QCVN 19:2019/BKHCN from the effective date of this Circular.
Article 5.Organization of implementation
1. The General Director of the Directorate for Standards, Metrology and Quality shall be responsible for the organization, instruction and implementation of this Circular.
2. Ministers, heads of ministerial-level agencies and government-attached agencies, chairmen of provincial/municipal People’s Committees and relevant organizations and individuals shall be responsible for the implementation of this Circular.
3. Any difficulty arising in the course of implementing this Circular shall be promptly reported to the Ministry of Science and Technology in writing for instruction or consideration, amendment and supplement./.

NATIONAL TECHNICAL REGULATION
ON LED LIGHTING PRODUCTS
1. GENERAL PROVISION
1.1. Scope of regulation
This technical regulation specifies requirements for safety, electromagnetic compatibility and management requirements for common lighting products using light-emitting diode (LED) technology (hereinafter referred to as LED lighting products) are specified in the Appendix of this National Technical Regulation.
This technical regulation does not apply to:
LED lighting products used on means of transport specified in the QCVN 35:2017/BGTVT;
LED lighting products used in lighting construction specified in the QCVN 07-7:2016/BXD;
LED lighting products used for outdoor advertising media specified in the QCVN 17:2018/BXD.
1.2. Subjects of application
This national technical regulation applies to organizations and individuals that manufacture, import and trade LED lighting products as specified in the Appendix of this National Technical Regulation, and related state management authorities, organizations, individuals.
1.3. Interpretation of terms
In this National Technical Regulation, the terms below are construed as follows:
1.3.1. LED technology: is a light-emitting technology that uses diodes that can emit light wavelengths when electricity is passed, which can be infrared, ultraviolet or visible light.
1.3.2. LED light bulb: is a collection of components into a device using LED technology for lighting, with or without integrated controllers, designed to connect to the power source through an integrated standard lamp head.
1.3.3. Self-ballasted LED bulbs: is an unit that, when removed, will be permanently damaged, fitted with the lamp head, and combined with the LED light source and additional elements necessary for the stable operation of the light sources.
1.3.4. LED light source: is a collection of components into a device that uses LED technology for lighting.
1.3.5. LED luminaires: is a complete device consisting of one or more LED light sources, LED control units, light distribution parts, parts for fixing and protecting lamps and parts for connection with power source and other parts.
1.3.6. Common LED luminaires: is a LED luminaires which not designed with intension for special purposes. For example: LED electric light used for filming, photographing, swimming pool, farming, fishing, lights on vehicles.
1.3.7. Fixed common LED lamp: is a LED luminaires for lighting purposes and designed to be removed only by support tools or used out of reach.
1.3.8. Mobile common LED luminaires: is a LED luminaires that is used for lighting purposes and can be moved from one position to another while still connected to power source.
1.3.9. LED lighting products: are the common names for the products specified in the Appendix of this Technical Regulation
2. TECHNICAL REQUIREMENTS
LED Lighting Products as prescribed in Appendices of this Regulation shall have to meet the national (TCVN) and international standards respectively as follow:
2.1. Safety requirements
2.1.1. LED luminaires (including fixed common LED luminaires and mobile common LED luminaires) shall have to comply with the regulations in the TCVN 7722-1:2017 (IEC 60598-1:2014/AMD1:2017)Luminaires - Part 1: General requirements and tests).At the same time, depending on the use of design, each type of LED luminaires must comply with the corresponding part of the TCVN 7722-2 I (EC 60598-2)()Luminaires - Part 2:Specific requirements.
In case there is no corresponding section, the most appropriate part of the TCVN 7722-2 (IEC 60598-2) shall applies. When the design of an LED luminaires can apply two or more parts of the TCVN 7722-2 (IEC 60598-2), the LED luminaires shall comply with both or all applicable items.
2.1.2. Self-ballasted LED lamps for general lighting purposes shall comply with the provisions of the TCVN 8782:2017 (IEC 62560:2011+AMD1:2015) Self-ballasted LED lamps for common lighting for use at voltages greater than 50 V.Safety regulations.
2.1.3. Double-headed LED lamps designed to replace straight tube fluorescent lamps shall comply with the provisions of the TCVN 11846:2017 (IEC 62776:2014) Double-headed LED lamps designed to replace straight tube fluorescent lamps.Safety regulations.
2.1.4. LED lighting products specified in the Appendix of this National Technical Regulation must be listed in the Exempt group without the risk of biotechnology or Risk Group 1 without the risk of bio-optics in normal use when testing, evaluating and classifying according to IEC 62471:2006 Photobiological safety of lamps and lamp systems.
2.2. Electromagnetic compatibility requirement (EMC)
2.2.1. LED lighting products specified in the Appendix of this National Technical Regulation must ensure that electromagnetic interference (EMI) does not exceed the limits specified in the TCVN 7186:2018 (CISPR 15:2018). Limitation and test method for the radio frequency interference of lighting equipment and the like.
2.2.2. LED lighting products specified in the Appendix of this National Technical Regulation must ensure electromagnetic immunity (EMS) in accordance with the provisions of IEC 61547:2009 Ed 2.0 Equipment for general lighting purposes - EMC immunity requirements.
3. MANAGEMENT REQUIREMENTS
3.1.LED lighting products specified in the Appendix to this National Technical Regulation must announce the conformity in compliance with the technical regulations in Section 2 of this National Technical Regulation, affix conformity marking (CR mark) and labeling the goods before circulating in market.
3.2.Domestic-manufactured LED lighting products must proceed declaration of conformity as prescribed in the Circular No. 28/2012 / TT-BKHCN of December 12, 2012 of the Minister of Science and Technology stipulate Declaration of standard conformity, Declaration of national standard conformity and methods of assessing the conformity with national standards, national technical regulations (hereinafter referred to as the Circular No. 28/2012 / TT- BKHCN) and the Circular No. 02/2017/TT-BKHCN dated March 31, 2017 of the Ministry of Science and Technology amending and supplementing a number of articles of the Circular No. 28/2012/TT-BKHCN (hereinafter referred to as the Circular No. 02/2017/TT- BKHCN).
3.3.Imported LED lighting products must register for state inspection of quality of imported goods as prescribed in the Circular No. 27/2012/TT-BKHCN regulating the state quality inspection of imported goods under management responsibility of the Ministry of Science and Technology (hereinafter referred to as the Circular No. 27/2012/TT-BKHCN) and the Circular No. 07/2017/TT-BKHCN amending and supplementing a number of articles of the Circular No. 27/2012/TT-BKHCN.
3.4.Declaration of Conformity
3.4.1. The declaration of conformity must be based on the certification results of the certification organization registered for operating scope in accordance with the Government’s Decree No. 107/2016/ND-CP of July 1,2016 regulation on business of conformity assessment services (hereinafter referred to as the Decree No. 107/2016/ND-CP), the Decree No. 154/2018/ND-CP dated November 09, 2018 of the Government on amending, supplementing and abolishing a number of regulations on investment and business conditions in the scope of state management of the Ministry of Science and Technology and a number of specialized inspection regulations (hereinafter referred to as the Decree No. 154/2018/ND-CP) or recognized under the provisions of the Circular No. 27/2007/TT-BKHCN dated October 31, 2007 of the Ministry of Science and Technology, on guiding the signing and implementation of Mutual Recognition Agreements for results of conformity assessment (hereinafter referred to as the Circular No. 27/2007/TT-BKHCN).
3.4.2. Conformity certification
a) Conformity Certification is carried out according to method 1 (typical sample test) specified in Appendix II of the Circular No. 28/2012/TT-BKHCN and the Circular No. 02/2017/TT-BKHCN.
b) Testing for certification purposes must be conducted by designated testing organizations according to the provisions of the Decree No. 107/2016/ND-CP, the Decree No. 154/2018/ND-CP or accredited in accordance with the Circular 27/2007/TT-BKHCN. The testing scope of testing organizations must meet the requirements prescribed by this National Technical Regulation.
c) Validity of the conformity certificate shall not exceed 3 years.
3.4.3. Use conformity mark
The regulation conformity marking must comply with Clause 2, Article 4 of the "Regulation on standard conformity certification, standard conformity certification and standard conformity announcement" promulgated together with the Circular No. 28/2012/TT-BKHCN.
3.5.Order, procedures and records of regulation conformity announcement
The order, procedures and dossiers for declaration of conformity applies for domestic manufactured and imported electrical and electronic product shall comply with the Circular No. 28/2012/TT-BKHCN and the Circular No. 02/2017/TT-BKHCN.
3.6.For self-ballasted LED lamps, if they have been certified for conformity of electromagnetic compatibility (EMC) according to this National Technical Regulation, it is not required to certify conformity according to the QCVN 9:2012/BKHCN on EMC for electrical appliances, consumer electronics and similar purposes.
4. RESPONSIBILITIES OF ORGANIZATION AND INDIVIDUAL
4.1.Enterprises producing and trading LED lighting products must ensure the quality prescribed by the Law on Product and Goods Quality.
4.2.Manufacturing and trading enterprises must meet the requirements specified in Section 2, and comply with the provisions of Section 3 of this National Technical Regulation.
4.3.Enterprises producing LED lighting products, after obtaining conformity certificate, must register the declaration of conformity form at the Department of Standards, Metrology and Quality or competent state authority where they register their business according to specified in the Circular No. 28/2012/TT-BKHCN and the Circular No. 02/2017/TT-BKHCN.
4.4.Enterprises importing LED lighting products after obtaining conformity certificate must register for product quality inspection at the inspection authority as prescribed in the Circular No. 27/2012/TT-BKHCN and the Circular No. 07/2017/TT-BKHCN.
4.5.Enterprises are responsible for providing evidence of conformity of products to this National Technical Regulation upon request or when being inspected in accordance with regulations on goods circulated on the market.
5. Organization of implementation
5.1.The Directorate for Standards, Metrology and Quality is responsible for guiding, auditing and inspecting the implementation of this National Technical Regulation.
5.2.In case the standards referred to in this Technical Regulation are changed, supplemented or replaced, the guidance of the Ministry of Science and Technology shall be complied with.
5.3.5.3 In case of changes in legal documents, technical regulations cited in this Technical Regulation, the current prevailing documents will be applied./.
