CIRCULAR

Repealing a number of legal documents promulgated by the Minister of Foreign Affairs

Pursuant to the Law on Promulgation of Legal Documents No. 64/2025/QH15, amended and supplemented under Law No. 87/2025/QH15;

Pursuant to the Law on Foreigners’ Entry into, Exit from, Transit through, and Residence in Vietnam No. 47/2014/QH13, amended and supplemented under Law No. 51/2019/QH14 and Law No. 23/2023/QH15;

Pursuant to Decree No. 79/2025/ND-CP of the Government on inspection, review, systematization and handling of legal documents, amended and supplemented under Decree No. 187/2025/ND-CP;

Pursuant to the Government's Decree No. 28/2025/ND-CP defining the functions, tasks, powers and organizational structure of the Ministry of Foreign Affairs, amended and supplemented under Decree No. 109/2025/ND-CP;

Pursuant to the Government's Decree No. 361/2025/ND-CP prescribing civil servant employment positions;

Pursuant to the Government's Decree No. 06/2005/ND-CP on the establishment and operation of representative offices of foreign cooperation and research organizations in Vietnam, amended and supplemented under Decree No. 62/2026/ND-CP;

Pursuant to the Prime Minister’s Decision No. 49/2025/QD-TTg on the dissolution and termination of operation of the Fund for Protection of Vietnamese Citizens and Legal Entities Abroad;

At the proposal of the Director of the Department of International Law and Treaties;

The Minister of Foreign Affairs hereby promulgates the Circular repealing a number of legal documents promulgated by the Minister of Foreign Affairs.

Article 1. Repeal of legal documents

To entirety repeal the following legal documents promulgated by the Minister of Foreign Affairs:

1. The Minister of Foreign Affairs’ Circular No. 769-NG/TT of April 17, 1993, guiding the implementation of the Government’s Decree No. 4-CP of January 18, 1993, detailing the execution of the Ordinance on Entry, Exit, Residence and Travelling of Foreigners in Vietnam.

2. The Minister of Foreign Affairs’ Circular No. 10/2005/TT-BNG of May 19, 2005, guiding Decree No. 06/2005/ND-CP on the establishment and operation of representative offices of foreign cooperation and research organizations in Vietnam.

3. The Minister of Foreign Affairs’ Circular No. 03/2025/TT-BNG of June 13, 2025, amending, supplementing and repealing a number of articles of the Minister of Foreign Affairs' Circular No. 10/2005/TT-BNG of May 19, 2005 guiding the implementation of a number of articles of the Government's Decree No. 06/2005/ND-CP of January 19, 2005 on the establishment and operation of representative offices of foreign cooperation and research organizations in Vietnam.

4. The Minister of Foreign Affairs’ Circular No. 01/2023/TT-BNG of March 30, 2023, guiding employment positions for civil servants performing specialized foreign affairs operations in agencies and organizations in the foreign affairs sector and field.

5. The Minister of Foreign Affairs’ Circular No. 02/2025/TT-BNG of June 13, 2025, amending and supplementing a number of articles of the Minister of Foreign Affairs’ Circular No. 01/2023/TT-BNG of March 30, 2023, guiding employment positions for civil servants performing specialized foreign affairs operations in agencies and organizations in the foreign affairs sector and field.

6. The Minister of Foreign Affairs’ Decision No. 1658/2006/QD-BNG of August 10, 2006, promulgating the Regulation guiding the implementation of commendation in the form of Commendation Certificates at the Ministry of Foreign Affairs.

7. The Minister of Foreign Affairs’ Decision No. 1801/2008/QD-BNG of July 17, 2008, promulgating the Regulation guiding the implementation of commendation in the form of Certificates of Merit of the Minister of Foreign Affairs.

8. The Minister of Foreign Affairs’ Decision No. 2985/2007/QD-BNG of November 29, 2007, on the organization and operation of the Fund for Protection of Vietnamese Citizens and Legal Entities Abroad.

9. The Minister of Foreign Affairs’ Decision No. 3266/2007/QD-BNG of December 17, 2007, correcting the Minister of Foreign Affairs’ Decision No. 2985/2007/QD-BNG of November 29, 2007.

10. The Minister of Foreign Affairs’ Decision No. 76/2009/QD-BNG of January 14, 2009, promulgating the Working Regulation of the Ministry of Foreign Affairs.

Article 2. To repeal Article 2 of the Minister of Foreign Affairs’ Circular No. 04/2025/TT-BNG of June 13, 2025, amending and supplementing a number of articles of the Minister of Foreign Affairs’ Circular No. 04/2016/TT-BNG of June 30, 2016, guiding procedures for grant of visas, extension of temporary residence duration and grant of temporary residence cards for foreigners in Vietnam under the competence of the Ministry of Foreign Affairs, and Decision No. 2985/2007/QD-BNG of November 29, 2007, promulgating the Regulation on organization and operation of the Fund for Protection of Vietnamese Citizens and Legal Entities Abroad.

Article 3. Effect

This Circular takes effect on July 01, 2026.

Article 4. Responsibility for implementation

The Director of the Department of International Law and Treaties, heads of units under the Ministry of Foreign Affairs, and related agencies, organizations and individuals shall implement this Circular./.
