CIRCULAR

Detailing a number of articles of the Law on Emulation and Commendation and the Government’s Decree No. 152/2025/ND-CP dated June 14, 2025 prescribing the decentralization and delegation of power regarding emulation and commendation; detailing, and guiding the implementation of, a number of articles of the Law on Emulation and Commendation for the education sector

 

Pursuant to Law No. 06/2022/QH15 on Emulation and Commendation;

Pursuant to the Government’s Decree No. 37/2025/ND-CP dated February 26, 2025 defining the functions, tasks, powers and organizational structure of the Ministry of Education and Training;

Pursuant to the Government’s Decree No. 152/2025/ND-CP dated June 14, 2025 prescribing the decentralization and delegation of power regarding emulation and commendation; detailing, and guiding the implementation of, a number of articles of the Law on Emulation and Commendation;

Pursuant to the Prime Minister’s Decision No. 01/2026/QD-TTg dated January 01, 2026 detailing a number of articles of the Law on Emulation and Commendation;

At the proposal of the Director of the Personnel and Organization Department;

The Minister of Education and Training hereby promulgates the Circular detailing a number of articles of the Law on Emulation and Commendation and the Government’s Decree No. 152/2025/ND-CP dated June 14, 2025 prescribing the decentralization and delegation of power regarding emulation and commendation; detailing, and guiding the implementation of, a number of articles of the Law on Emulation and Commendation for the education sector;

 

Chapter I

GENERAL PROVISIONS

 

Article 1. Scope of regulation

This Circular details Clause 4, Article 24; Clause 3, Article 26; Clause 3, Article 27; Clause 3, Article 28; Clause 3, Article 32; Clause 2, Article 71; Clause 6, Article 74; Clause 2, Article 75; Clause 3 and Clause 4, Article 76; Clause 6, Article 84 of the Law on Emulation and Commendation; prescribes the decentralization prescribed in Clause 2, Article 6 of the Government’s Decree No. 152/2025/ND-CP dated June 14, 2025 prescribing the decentralization and delegation of power regarding emulation and commendation; detailing, and guiding the implementation of, a number of articles of the Law on Emulation and Commendation for the education sector (hereinafter collectively referred to as the Circular).

Article 2. Subjects of application

This Circular applies to cadres, civil servants, public employees, employees, and teams in the education sector; learners, and teams of learners; Vietnamese teams, households, and individuals; teams and individuals of Vietnamese residing overseas; foreign teams and individuals related to the commendation of the education sector.

Article 3. Interpretation of terms

In this Circular, the terms below are construed as follows:

1. Units under the Ministry of Education and Training include departments, agencies, offices, specialized agencies in charge of advising and assisting the Party Committee of the Ministry of Education and Training, project management boards, and program management boards under the Ministry of Education and Training (hereinafter referred to as units under the Ministry for short).

2. Units affiliated with the Ministry of Education and Training include Education Times, Journal of Education, the Vietnam National Institute of Educational Sciences, Vietnam Education Publishing House (single-member limited liability company), Technical and Vocational Education and Training Equipment Single-member Co., Ltd., and public non-business units affiliated with the Ministry of Education and Training (hereinafter referred to as units affiliated with the Ministry for short).

3. Teams considered for emulation titles and commendations include faculties, divisions, and equivalent organizations or higher.

4. Teams of learners include classes and groups of learners.

 

Chapter II

RECOGNITION OF PERFORMANCE RATINGS OF INDIVIDUALS AND TEAMS

 

Article 4. Recognition of the performance ratings of individuals and teams under management

The performance ratings of individuals and teams under management shall be recognized in accordance with the regulations of the Party, the law regulations of the State, and the regulations of the Minister of Education and Training on evaluating and classifying the quality of teams, civil servants, public employees, and employees of the Ministry of Education and Training.

 

Chapter III

CRITERIA AND NOMINEES FOR EMULATION TITLES AND COMMENDATIONS

 

Article 5. Title of “Exemplary Employee”

1. The title of “Exemplary Employee” shall be awarded annually at the end of the school year or working year to individuals of units under the Ministry and units affiliated with the Ministry who meet the criteria prescribed in Clause 1, Article 24 of the Law on Emulation and Commendation.

2. Ad-hoc consideration for the title of “Exemplary Employee” shall comply with Clause 5, Article 2 of Circular No. 15/2025/TT-BNV dated August 04, 2025 of the Minister of Home Affairs prescribing measures to organize and guide the implementation of the Law on Emulation and Commendation and the Government’s Decree No. 152/2025/ND-CP dated June 14, 2025 prescribing the decentralization and delegation of power regarding emulation and commendation; detailing, and guiding the implementation of, a number of articles of the Law on Emulation and Commendation. For seconded officers of the Vietnam People’s Army and the People’s Public Security Forces, it shall comply with the law regulations.

Article 6. Title of “Emulation Flag of the Ministry of Education and Training”

1. Nominees for the title of “Emulation Flag of the Ministry of Education and Training” are teams leading the emulation movement of the emulation clusters and blocks organized by the Ministry of Education and Training, including:

a) Units under the Ministry and units affiliated with the Ministry;

b) Teams prescribed in Clause 3, Article 3 of this Circular of units under the Ministry and units affiliated with the Ministry;

c) Provincial-level Departments of Education and Training of provinces and centrally-run cities.

2. The title of “Emulation Flag of the Ministry of Education and Training” shall be awarded to teams meeting the criteria prescribed in Clause 1, Clause 2, Article 26 of the Law on Emulation and Commendation. To be specific, one must:

a) Attain outstanding achievements and exceed the emulation targets and tasks assigned to it during the year; lead the emulation clusters and blocks organized by the Ministry of Education and Training;

b) Maintain internal solidarity, well implement the guidelines of the Party, the policies and law regulations of the State; have its Party and mass organizations evaluated as having well fulfilled their duties or better.

Article 7. Title of “Excellent Team”

1. Nominees for the title of “Excellent Team” include:

a) Units under the Ministry and units affiliated with the Ministry;

b) Teams prescribed in Clause 3, Article 3 of this Circular of units under the Ministry and units affiliated with the Ministry.

2. The title of “Excellent Team” shall be awarded annually at the end of the school year or working year to teams meeting the criteria prescribed in Clause 1, Article 27 of the Law on Emulation and Commendation.

Article 8. Title of “Exemplary Team”

1. Nominees for the title of “Exemplary Team” include:

a) Units under the Ministry and units affiliated with the Ministry;

b) Teams prescribed in Clause 3, Article 3 of this Circular of units under the Ministry and units affiliated with the Ministry.

2. The title of “Exemplary Team” shall be awarded annually at the end of the school year or working year to teams meeting the criteria prescribed in Clause 1, Article 28 of the Law on Emulation and Commendation.

Article 9. Title of “Emulation Flag of the National University”

1. The Emulation Flags of the National University shall be awarded annually to teams that are the most outstanding exemplars leading the emulation movement of the emulation blocks and clusters organized by the National University and meeting the following criteria:

a) Comprehensively exceeding programs, plans, and tasks assigned to them in the year; having innovative ideas and new models that can be followed by units within the National University. In cases where they are production and business units, they must well implement the law regulations, and fulfill obligations to the State and the National University;

b) Maintaining internal solidarity; actively practicing thrift, avoiding wastefulness, preventing and combating corruption, wrongdoings, and other social vices;

c) Having Party and mass organizations evaluated as having well fulfilled their duties or better.

2. The Emulation Flags of the National University shall be awarded to teams that are outstanding exemplars leading the thematic emulation movements organized by the National University with an implementation period of 03 years or more upon final reviews thereof. The nominees and criteria for being awarded the flags shall be specifically prescribed by the National University depending on each emulation movement.

3. The number of Emulation Flags to be awarded to members, units under the National University, and its affiliates shall be prescribed by the Director of the National University, but shall be not more than 20% of the total number of leading teams of the emulation blocks and clusters organized by the National University.

4. The National University shall not award, and issue no decision on the awarding of, the Emulation Flag of the National University on any team that is awarded the Emulation Flag of the Ministry of Education and Training for the same achievement.

5. The “Emulation Flag of the National University” embroidery

The text on the flag shall be embroidered in yellow thread in uppercase, upright, and bold letters. The typeface and font size shall be adjusted depending on the specific content to ensure aesthetics and solemnity. It shall include the following main elements:

a) First line: “(name of the National University)”; in uppercase, upright, bold letters;

b) Second line: “AWARDS”, in uppercase, upright, bold letters;

c) Centered beneath the second line: A five-pointed yellow star;

d) Beneath the star: the text “(name of the unit awarded the Emulation Flag)” and either “THE UNIT LEADING THE EMULATION MOVEMENT IN THE YEAR” or “EMULATION MOVEMENT”. The year indicated shall be the year in which the unit attains the achievement for which it is awarded the title, and the emulation movement referred to shall be the one launched by the National University. This text shall be in uppercase, upright, bold letters.

Article 10. Commemorative Medal “For the Cause of Education”

The Commemorative Medal “For the Cause of Education” (hereinafter referred to as the Commemorative Medal for short) is a type of one-off commendation of the Ministry of Education and Training to be awarded to individuals, whether inside or outside the education sector, who have made numerous contributions to the cause of education and training, including:

1. Individuals who have 20 years of service or more in the education sector.

In cases where an individual working in the education sector is sent to pursue further studies or perform military service and subsequently returns to the sector, the time spent studying or performing military service shall be counted as part of his/her service in the education sector for the purpose of consideration for the Commemorative Medal. Any period during which an individual is subject to disciplinary action shall be excluded from his/her service for the purpose of consideration for the Commemorative Medal.

Any period of the individual’s service in the education sector in an extremely socio-economically disadvantaged area as prescribed by the Prime Minister shall be counted with a coefficient of 2 when calculating his/her service for the purpose of consideration for the Commemorative Medal.

2. Individuals outside the education sector who meet one of the following criteria:

a) Those who have held leadership or managerial positions for 05 years or more, or who are responsible for education and training within the socio-cultural divisions of commune-level People’s Committees and have 05 years of service or more in the education sector, during which they have made numerous contributions in leadership, direction, and task performance, contributing to the development of the education sector;

b) Those who have made numerous contributions to the formulation of mechanisms and policies; organized practical and effective activities for the development of the education sector; or provided financial or in-kind support for its development, as verified and nominated by the receiving units;

c) Vietnamese nationals residing overseas, Vietnamese citizens working for foreign organizations in Vietnam, and foreign individuals who have made significant contributions to the development of education and training in Vietnam, and to strengthening friendships and cooperation between Vietnam and other countries and international educational organizations.

3. An individual awarded the Commemorative Medal shall receive a cash reward of VND 300,000. A Vietnamese national, who resides overseas, or a foreign individual awarded the Commemorative Medal shall receive the physical medal, together with a memento worth VND 300,000.

Article 11. Certificate of Merit of the Ministry of Education and Training

1. The Certificates of Merit of the Ministry of Education and Training shall be awarded, whether anthumously or posthumously, to individuals who exemplarily comply with the guidelines of the Party, the policies and law regulations of the State, and meet one of the following criteria:

a) Having exemplarily outstanding achievements recognized upon preliminary or final review of emulation movements launched by the Prime Minister; or achievements attained in the course of performing political tasks assigned by the Party, the National Assembly, the Government, or the Prime Minister over a period of 03 years or more, thereby becoming influential role models in the education sector; or having outstanding achievements recognized annually or upon preliminary or final review of emulation movements launched by the Minister of Education and Training; or achievements attained in the course of performing tasks assigned by the Minister of Education and Training over a period of 05 years or more, thereby becoming influential role models in the education sector. The nominees and criteria for being awarded the certificates of merit in this case shall comply with the guidelines on commendation of each emulation movement or thematic campaign.

b) Attaining multiple achievements or outstanding extraordinary achievements, thereby becoming influential role models in the fields under the State-level governance by the Ministry of Education and Training or performing exceptionally meritorious actions such as heroically saving lives or protecting the property of the People and the State, participating in the prevention and relief of natural disasters, acts of public enemy, and epidemics, or combating wrongdoings, law violations, and social vices, thereby serving as role models and being recognized by their units and local authorities;

c) Having made numerous exceptionally outstanding contributions to the development of education and training, with significant social impact, and having provided practical and effective support to the education sector, as verified and nominated by the receiving units;

d) Having 08 years of service or more with their units, for individuals who do not hold leadership or managerial positions, or 05 years of service or more, for those who hold such positions. Attaining outstanding achievements during the aforementioned period of service, thereby contributing to the development of their agencies or units, and possessing professional reputation and influence within the sector, field, or at the provincial level; having been recognized as having well fulfilled their duties or better for 05 consecutive years immediately preceding the time of nomination, including at least 02 years recognized as having excellently fulfilled their duties. These individuals shall be nominated for the certificates of merit on the occasion of the founding anniversaries or traditional days (in round-number years) of their agencies or units.

dd) Individuals working in units under the Ministry or its affiliated entities who have been awarded the title of “Grassroots-level Emulation Fighter” in 02 consecutive instances, or have been recognized as having excellently fulfilled their duties for 02 consecutive years or more, during which they have had 02 initiatives recognized and effectively applied at the grassroots level, or 02 scientific studies or projects, or science and technology works or projects that have been accepted and effectively applied at the grassroots level;

e) Attaining outstanding achievements as specified by the charters and regulations of exams, contests, competitions, and sports festivals organized by the Ministry of Education and Training;

g) Being exemplary teachers selected in accordance with the regulations of the Minister of Education and Training.

2. The Certificates of Merit of the Ministry of Education and Training shall be awarded to teams that exemplarily and strictly comply with the guidelines of the Party, the policies and law regulations of the State, maintain internal solidarity, and meet one of the following criteria:

a) The criteria prescribed at Point a, Clause 1 of this Article;

b) Attaining outstanding extraordinary achievements that are influential in one of the fields under the State-level governance by the Ministry of Education and Training, or performing exceptionally meritorious actions such as saving lives or protecting the property of the People and the State, participating in the prevention and relief of natural disasters, acts of public enemy, and epidemics within their units and in their localities;

c) Having made numerous exceptionally outstanding contributions, and provided practical and effective support to the education sector, as verified and nominated by the receiving units;

d) Having been established and in continuous development for 10 years or more, with exceptionally outstanding achievements and contributions to the development of the education sector and the country’s socio-economic growth. In such cases, Certificates of Merit shall be awarded on the occasion of the founding anniversaries or traditional days (in round-number years) of their agencies or units;

dd) Having been recognized as having excellently fulfilled their duties or awarded the title of “Excellent Team” for 02 consecutive years, effectively implementing grassroots democracy, effectively organizing emulation movements, ensuring the material and spiritual well-being of their teams, practicing thrift and avoiding wastefulness; preventing and combating corruption and wrongdoings, applicable to teams prescribed in Clause 3, Article 3 of this Circular under units under the Ministry and units affiliated with the Ministry.

e) Attaining outstanding achievements as specified by the charters and regulations of exams, contests, competitions, and sports festivals organized by the Ministry of Education and Training.

3. The Certificates of Merit of the Ministry of Education and Training shall be awarded to households that exemplarily and strictly comply with the guidelines of the Party, the policies and law regulations of the State, and make numerous contributions in terms of effort, land, and property to the education sector, as verified by the receiving units.

4. In other cases, the awarding shall be considered and decided by the Minister of Education and Training based on the nominations of the standing body of the Emulation and Commendation Council of the Ministry of Education and Training after seeking opinions from relevant agencies and units.

Article 12. Certificate of Merit of the National University

1. The Certificates of Merit of the National University shall be awarded upon nomination, or posthumously awarded, to individuals who exemplarily comply with the guidelines and policies of the Party and the law regulations of the State in an exemplary manner, and meet one of the following criteria:

a) Attaining outstanding achievements as recognized in emulation movements launched by the Director of the National University;

b) Attaining numerous achievements that are influential in one of the fields under the National University, or performing meritorious actions such as saving lives or protecting the property, participating in the prevention and relief of natural disasters and epidemics, or combating wrongdoings, law violations, and social vices, thereby serving as role models and being recognized and honored by their units and local authorities;

c) Attaining outstanding achievements in study, training, and scientific research; overcoming difficulties to excel academically; actively and effectively participating in volunteer and charitable activities for the community, as verified by competent authorities;

d) Providing practical, effective support and contributions to the development of the National University.

2. The Certificates of Merit of the National University shall be awarded to teams that exemplarily and strictly comply with the guidelines and policies of the Party, and the law regulations of the State, and meet one of the criteria prescribed at Point a, Point b, and Point d, Clause 1 of this Article.

3. In other cases, the awarding shall be considered and decided by the Director of the National University based on the nominations of the standing body of the Emulation and Commendation Council of the National University.

4. The National University shall not issue any decision on the awarding of the Certificate of Merit of the National University to any team or individual that is awarded the Certificate of Merit of the Ministry of Education and Training for the same achievement.

Article 13. Certificates of Commendation of the heads of the departments under the Ministry, the Ministry’s Office, the Office of the National Council for Education and Human Resource Development, the Office of the State Council of Professorship, project management boards, and program management boards under the Ministry of Education and Training; certificates of commendation of the heads of units with legal entity status

1. The certificates of commendation of the heads of the departments under the Ministry, the Ministry’s Office, the Office of the National Council for Education and Human Resource Development, the Office of the State Council of Professorship, project management boards, and program management boards under the Ministry of Education and Training; certificates of commendation of the heads of units with legal entity status affiliated with the Ministry, provincial-level Departments of Education and Training, principals, directors or equivalent positions of higher education institutions, pedagogical colleges, and vocational education institutions shall be awarded to individuals and teams that exemplarily and strictly comply with the guidelines and policies of the Party, and the law regulations of the State, and meet one of the following criteria:

a) Attaining outstanding achievements as recognized in emulation movements launched by the heads of the units or while performing the tasks of the units;

b) Attaining numerous achievements or outstanding extraordinary achievements that are influential in the fields under the management of the agencies and units;

c) Attaining outstanding achievements in exams, contests, competitions, and sports festivals launched and organized by the Ministry of Education and Training or the units;

d) Attaining outstanding achievements and making contributions to the development of the units. In such cases, Certificates of Commendation shall be awarded on the occasion of the founding anniversaries or traditional days (in round-number years) of the units.

2. The certificates of commendation of the heads of the departments under the Ministry, the Ministry’s Office, the Office of the National Council for Education and Human Resource Development, the Office of the State Council of Professorship, project management boards, and program management boards under the Ministry of Education and Training; certificates of commendation of the heads of units with legal entity status affiliated with the Ministry, provincial-level Departments of Education and Training, principals, directors or equivalent positions of higher education institutions, pedagogical colleges, and vocational education institutions shall be awarded to households that exemplarily and strictly comply with the guidelines and policies of the Party, and the law regulations of the State, and make numerous contributions to their localities and to society regarding the fields under the management of the respective units.

3. The certificates of commendation of the directors of provincial-level Departments of Education and Training, principals, directors or equivalent positions of educational institutions shall be awarded to learners who possess good moral qualities, exemplarily and strictly comply with the guidelines and policies of the Party, the law regulations of the State, and school rules, and have well fulfilled their duties; shall be awarded to teams of learners that exemplarily and strictly comply with the guidelines and policies of the Party, the law regulations of the State, and school rules, and meet one of the following criteria:

a) Attaining outstanding or prominent achievements in study and training;

b) Attaining outstanding achievements in emulation movements organized by the units and educational institutions;

c) Attaining outstanding extraordinary achievements, thereby becoming the role models within the units and educational institutions;

d) Winning prizes in exams, contests, competitions, and sports festivals organized by the units and educational institutions.

 

Chapter IV

COMPETENCE TO DECIDE ON COMMENDATION AND NOMINATING TEAMS/INDIVIDUALS FOR EMULATION TITLES AND COMMENDATIONS

 

Article 14. Heads of agencies under the Ministry of Education and Training are competent to:

1. Submit nominations for the titles of “Ministry-level Emulation Fighter”, “Grassroots-level Emulation Fighter”, “Exemplary Employee”, “Emulation Flag of the Ministry of Education and Training”, “Excellent Team”, “Exemplary Team”, Certificates of Merit of the Ministry of Education and Training, and Commemorative Medals to the Minister of Education and Training.

2. Submit nominations to the Minister of Education and Training for consideration and onward submission to competent authorities for State-level commendation, in accordance with regulations.

Article 15. Heads of the departments under the Ministry, the Ministry’s Office, the Office of the National Council for Education and Human Resource Development, the Office of the State Council of Professorship, project management boards, and program management boards under the Ministry of Education and Training and the heads of units with legal entity status affiliated with the Ministry are competent to:

1. Recognize individuals and teams under their management with the titles of “Exemplary Team”, “Exemplary Employee”, “Grassroots-level Emulation Fighter”; consider awarding the Certificates of Commendation as prescribed in Article 13 of this Circular.

2. Submit nominations of units under and affiliated with the Ministry for the title of “Exemplary Team” to the Minister of Education and Training.

3. Submit nominations for the titles of “Emulation Flag of the Ministry of Education and Training”, “Excellent Team”, “Ministry-level Emulation Fighter”, Certificates of Merit of the Ministry of Education and Training, and Commemorative Medals to the Minister of Education and Training.

4. Submit nominations to the Minister of Education and Training for consideration and onward submission to competent authorities for State-level commendation, in accordance with regulations. This competence does not apply to the Director of the National University.

Article 16. Directors of provincial-level Departments of Education and Training are competent to:

1. Consider awarding the Certificates of Commendation as prescribed in Article 13 of this Circular.

2. Submit nominations of individuals and teams of educational institutions under their management prescribed at Point a, Point b, Point d, Point e, Point g, Clause 1, Article 11; Point a, Point b, Point d, Point e, Clause 2, Article 11 of this Circular for the Certificates of Merit to the Minister of Education and Training.

3. Submit nominations of individuals and teams prescribed at Point c, Clause 1, Point c, Clause 2, Article 11; and the Certificates of Merit to households prescribed in Clause 3, Article 11 of this Circular for the Certificates of Merit to the Minister of Education and Training.

4. Submit nominations of individuals under the direct management of the provincial-level Departments of Education and Training and the Chairpersons of the commune-level People’s Committees; to individuals prescribed in Clause 2, Article 10 of this Circular for the Commemorative Medals to the Minister of Education and Training.

Article 17. Chairpersons of provincial-level People’s Committees of provinces and Centrally-run cities are competent to:

1. Nominate individuals and teams of educational institutions affiliated with the provincial-level People’s Committees prescribed at Point a, Point b, Point d, Point e, Point g, Clause 1, Article 11; Point a, Point b, Point d, Point e, Clause 2, Article 11 of this Circular for Certificates of Merit awarded by the Minister of Education and Training.

2. Nominate individuals of educational institutions affiliated with the provincial-level People’s Committees for Commemorative Medals awarded by the Minister of Education and Training.

Article 18. Heads of ministries, committees, and sectoral authorities are competent to:

1. Nominate individuals and teams under their management prescribed at Point a, Point b, Point d, Point e, Point g, Clause 1, Article 11; Point a, Point b, Point d, Point e, Clause 2, Article 11, and Clause 3, Article 11 of this Circular for Certificates of Merit awarded by the Minister of Education and Training.

2. Nominate individuals and teams prescribed at Point c, Clause 1, Point c, Clause 2, Article 11 of this Circular for Certificates of Merit awarded by the Minister of Education and Training.

3. Nominate individuals under the management of ministries, committees, and sectoral authorities; and to individuals prescribed in Clause 2, Article 10 of this Circular for Commemorative Medals awarded by the Minister of Education and Training.

 

Chapter V

DOSSIERS AND PROCEDURES FOR CONSIDERING COMMENDATION UNDER THE COMPETENCE OF THE MINISTRY OF EDUCATION AND TRAINING AND UNITS UNDER AND AFFILIATED WITH THE MINISTRY OF EDUCATION AND TRAINING

 

Article 19. Regulations on dossiers and procedures for commendation under the competence of the Ministry of Education and Training

1. Dossiers of nomination for commendation by the Minister of Education and Training shall be duly prepared in full compliance with the prescribed requirements and submitted in a timely manner. Teams and individuals nominated for emulation titles and commendations shall fully comply with the regulations on dossiers, procedures, and deadlines for submission as prescribed in this Circular and relevant laws, and shall be legally accountable for the accuracy of the nomination dossiers.

2. The commendation of Vietnamese teams and individuals who resides overseas; foreign teams and individuals shall comply with the Law on Emulation and Commendation and relevant documents on commendation involving foreign elements.

3. Opinions from relevant authorities shall be sought by the standing body of the Emulation and Commendation Council of the Ministry of Education and Training before it submits the nominations to the Minister of Education and Training.

In cases where the time limit for responding to the written request for opinions from the Ministry of Education and Training has expired but the relevant authorities have not provided any opinion, or where the consulted authorities disagree with the nominations or provide differing opinions, the standing body of the Emulation and Commendation Council of the Ministry of Education and Training shall consolidate such opinions and report to the Minister for consideration and decision.

Within a time limit of 10 working days from the date it receives all opinions from the relevant authorities, the standing body of the Emulation and Commendation Council of the Ministry of Education and Training shall consolidate the opinions and report to the Minister for consideration and commendation in accordance with regulations.

4. The person competent to nominate, or submit nominations of, teams and individuals for emulation titles and commendations (excluding the Commemorative Medal “For the Cause of Education,” commendation for extraordinary achievements, and commendation under simplified procedures) shall publicly announce the list of such individuals and teams on the web portal of the agency or unit at least 05 working days prior to the meeting of the agency’s or unit’s Emulation and Commendation Council. The results of the public announcement (including any complaints or denunciations, if any) shall be reported to the Emulation and Commendation Council of the submitting unit before the nomination is submitted to the higher-level authority, and shall be recorded in the minutes of the commendation consideration meeting of the submitting unit.

5. The Council shall convene a meeting to vote on nominees for emulation titles and commendations. A nominee for the title “Ministry-level Emulation Fighter” must receive affirmative votes from 90% or more of the total members of the Council (if a Council member is absent, his/her opinion shall be obtained in writing). A nominee for any other emulation title or commendation must receive affirmative votes from 80% or more of the total members of the Council (if a Council member is absent, his/her opinion shall be obtained in writing and recorded in the minutes of the meeting). For departments under the Ministry and units without legal entity status, a general meeting shall be held to consider nominees for titles and commendations (if an individual or unit is absent, his/her/its opinion shall be obtained in writing and recorded in the minutes of the meeting).

6. Commendation nomination dossiers

For a Ministry-level emulation title or commendation, 01 nomination dossier (originals) shall be prepared; and their electronic versions (in Word and PDF formats) shall also be submitted to the Personnel and Organization Department under the Ministry of Education and Training (unless such documents contain state secrets).

7. A commendation nomination dossier shall comprise

a) A written nomination for the emulation title or commendation;

b) A report on achievements attained by the individual or team to be nominated;

c) Minutes of the meeting on emulation evaluation or commendation consideration;

d) Meeting minutes of the Exam Marking Council; a decision on recognition of award-winning individuals and teams and the list of individuals and teams nominated for commendation; proof of achievements in case of nomination for outstanding achievements in accordance with the charters and regulations of exams, contests, competitions, and sports festivals organized by the Ministry of Education and Training;

dd) A decision issued by the ministry, committee, sectoral authority, or province/centrally-run city recognizing or confirming an initiative that has been effectively applied and is replicable at the ministry or national level, or a scientific study or project, or science and technology work that has been accepted, effectively applied, and is influential at the ministry or national level, in case of nomination for the title of “Ministry-level Emulation Fighter” or “National-level Emulation Fighter”.

8. Procedures and deadlines for submitting commendation nomination dossiers

a) For commendation for meritorious service: Nomination dossiers shall be submitted to the standing body of the Emulation and Commendation Council of the Ministry of Education and Training before February 28 each year, or, in the case of State-level commendation, to the Ministry of Education and Training before April 30 each year;

b) For commendation upon preliminary and final reviews of emulation movements and thematic campaigns launched by the Prime Minister and the Minister of Education and Training, and for Exemplary Teachers: Comply with the separate guidelines of each emulation movement or thematic campaign, and the regulations on selection of Exemplary Teachers;

c) For commendation of outstanding achievements or outstanding extraordinary achievements: Nomination dossiers shall be sent to the standing body of the Emulation and Commendation Council of the Ministry of Education and Training immediately after the individual or team attain the outstanding achievement or outstanding extraordinary achievement;

d) For commendation on the occasion of a founding anniversary or traditional day: Nomination dossiers shall be submitted to the standing body of the Emulation and Commendation Council of the Ministry of Education and Training 30 working days prior to the scheduled date of the conference or celebration of the founding anniversary or traditional day of the agency or unit;

dd) For commendation of exams, contests, competitions, and sports festivals organized by the Ministry of Education and Training: Nomination dossiers shall be sent to the standing body of the Emulation and Commendation Council of the Ministry of Education and Training 20 working days after the end of the exams, contests, competitions, or sports festivals;

e) For Commemorative Medals: Nomination dossiers shall be sent to the standing body of the Emulation and Commendation Council of the Ministry of Education and Training before December 31 each year.

g) The deadlines for submitting commendation nomination dossiers in a unit shall be prescribed by the head of the unit.

9. Time limits for announcing appraisal and commendation results

a) In cases where the nominees meet the prescribed conditions and criteria for commendation, the Personnel and Organization Department under the Ministry of Education and Training shall carry out the procedures to submit the nominations to the Minister within 25 working days from the date it receives complete dossiers as prescribed;

b) In cases where the nominees fail to meet the conditions and criteria, the Personnel and Organization Department under the Ministry of Education and Training shall, within a time limit of 15 working days from the date it receives complete commendation nomination dossiers, notify the submitting units of such failure.

Article 20. Nomination dossiers and procedures for the titles of “Ministry-level Emulation Fighter”, “Grassroots-level Emulation Fighter” and other emulation titles under the competence of the Minister of Education and Training, heads of the departments under the Ministry, the Ministry’s Office, the Office of the National Council for Education and Human Resource Development, the Office of the State Council of Professorship, project management boards, and program management boards under the Ministry of Education and Training, and heads of units with legal entity status

1. Units under the Ministry of Education and Training shall prepare and submit nomination dossiers for the titles of “Ministry-level Emulation Fighter”, “Grassroots-level Emulation Fighter”, “Exemplary Employee”, “Emulation Flag of the Ministry of Education and Training”, “Excellent Team”, and “Exemplary Team” to the Minister of Education and Training for decision.

2. The advisory bodies in charge of emulation and commendation of units with legal entity status under the Ministry of Education and Training shall consolidate and appraise the dossiers, and report to the grassroots-level Emulation and Commendation Council; submit the nominations for the titles of “Grassroots-level Emulation Fighter”, “Exemplary Employee”, “Exemplary Team”, and “Excellent Team” within their competence prescribed in Clause 1, Article 80 of the Law on Emulation and Commendation and Article 14, Article 15 of this Circular to the heads of the units; submit nominations for the emulation titles and commendations within the competence of the Minister as prescribed in Clause 2, Article 79 of the Law on Emulation and Commendation and Article 14, Article 15 of this Circular to the Minister.

3. The Personnel and Organization Department under the Ministry of Education and Training shall appraise the dossiers, report to the Emulation and Commendation Council of the Ministry, and submit nominations of individuals and departments under the Ministry for the titles of “Grassroots-level Emulation Fighter”, “Exemplary Employee”, “Exemplary Team”, and “Excellent Team” to the Minister.

4. Based on the results of voting by the grassroots-level Emulation and Commendation Council or emulation clusters and blocks for the titles of “Ministry-level Emulation Fighter” and “Emulation Flag of the Ministry of Education and Training”, the Personnel and Organization Department under the Ministry of Education and Training shall appraise the dossiers and report to the Emulation and Commendation Council of the Ministry of Education and Training for onward submission to the Minister for consideration and decision.

5. Dossiers and procedures for nominating teams leading an emulation movement launched by the Minister of Education and Training for the “Emulation Flag of the Ministry of Education and Training” shall comply with the separate guidelines for the emulation movement.

Article 21. Nomination dossiers and procedures for the Certificates of Merit of the Ministry of Education and Training

1. Dossiers and procedures for commendation in emulation movements, and commendation on the occasion of the founding anniversaries or traditional days (in round-number years) of agencies and units

a) For provincial-level Departments of Education and Training: The agency or unit shall prepare a commendation nomination dossier; the Personnel and Organization Department under the Ministry of Education and Training shall appraise the dossier and submit it to the Ministry’s leaders for consideration. For commendations awarded to directors and deputy directors of provincial-level Departments of Education and Training and equivalent positions, the Personnel and Organization Department under the Ministry of Education and Training shall appraise the dossiers, seek opinions from relevant units, and submit them to the Ministry’s leaders for consideration and decision;

b) For units affiliated with the Ministry of Education and Training, higher education institutions, and vocational education institutions: The agency or unit shall prepare a commendation nomination dossier; the Personnel and Organization Department under the Ministry of Education and Training shall appraise such dossier and seek opinions from relevant units, and then submit it to the Ministry’s leaders for consideration and decision.

2. Nomination dossiers and procedures for commendations in thematic campaigns, exams, contests, competitions, and sports festivals

a) Before nominating teams and individuals for commendations in thematic campaigns, exams, contests, competitions, and sports festivals, units under the Ministry of Education and Training shall assume the prime responsibility for drafting the guidelines on commendation and forward them to the Personnel and Organization Department under the Ministry of Education and Training for finalization and submission to the Ministry’s leaders for approval;

b) In consideration of the criteria met by the teams and individuals, their agencies and units shall nominate them for appropriate commendations in accordance with Article 14, Article 15, Article 16, Article 17, and Article 18 of this Circular, and send the nominations to the Ministry of Education and Training (via the unit under the Ministry in charge of receiving commendation nomination dossiers);

c) After shortlisting teams and individuals with outstanding achievements, the in-charge unit under the Ministry shall send their nomination dossiers to the Personnel and Organization Department under the Ministry of Education and Training for appraisal and submission to the Minister for consideration and decision.

3. Dossiers and procedures for commendations for meritorious service

a) Based on the evaluation and classification of individuals and teams with respect to their fulfillment of their duties, and the results of consideration and recognition of the applicability, replicability, and influence of their initiatives or scientific studies or projects, or science and technology works, the head of the authority or unit shall convene a meeting to nominate individuals and teams under their management for emulation titles and commendations, and send the nominations to the Personnel and Organization Department under the Ministry of Education and Training;

b) In compliance with the regulations on criteria and conditions for commendation, the Personnel and Organization Department under the Ministry of Education and Training shall appraise the nominations and submit them to the Minister for consideration and decision.

Article 22. Nomination dossiers and procedures for the Commemorative Medals

1. A dossier of nomination for a Commemorative Medal shall comprise

a) A written nomination for the Commemorative Medal;

b) A list of nominees for the Commemorative Medal;

c) A summary of achievements of the individual nominated for the Commemorative Medal.

2. In consideration of the criteria met by the individuals, their agencies and units shall nominate them for the Commemorative Medals in accordance with Article 14, Article 15, Article 16, Article 17, and Article 18 of this Circular, and send the nominations to the standing body of the Emulation and Commendation Council of the Ministry of Education and Training for appraisal and onward submission to the Minister for consideration and decision.

Article 23. Nomination dossiers and procedures for the Certificates of Commendation of heads of units with legal entity status

1. Nomination dossiers and procedures for the Certificates of Commendation of heads of units with legal entity status (excluding learners and teams of learners)

a) In compliance with the regulations on conditions and criteria for being awarded the Certificate of Commendation, the head of the constituent unit of the unit with legal entity status shall prepare a commendation nomination dossier and send it to the advisory body in charge of emulation and commendation of the unit;

b) The advisory body in charge of emulation and commendation of the unit with legal entity status shall consolidate and appraise the dossiers, and submit them to the head of the unit for consideration and decision;

c) Quantity of dossiers: 01 dossier (original copies) and its electronic versions;

d) Such dossier shall comprise: A written nomination for the Certificate of Commendation, a summary report of achievements of the nominee.

2. Dossiers and procedures for nominating learners and teams of learners for the Certificates of Commendation of the heads of the departments under the Ministry, the Ministry’s Office, the Office of the National Council for Education and Human Resources Development, the Office of the State Council of Professorship, project management boards, and program management boards under the Ministry of Education and Training; the Certificates of Commendation of heads of units with legal entity status

In consideration of the achievements attained by learners and teams of learners, the homeroom teacher shall compile a list of learners and teams of learners meeting the criteria for being awarded Certificates of Commendation, and submit it to the head of the unit for consideration and decision; or the assigned person shall compile a list of learners and teams of learners meeting the criteria for being awarded Certificates of Commendation, and send it to the unit responsible for organizing a meeting to nominate and forward such nominations to the head of the unit for consideration and decision.

3. The deadlines for submitting commendation nomination dossiers in a unit shall be prescribed by the head of the unit.

Article 24. Nomination dossiers and procedures for the Emulation Flags and Certificates of Merit of the National University

The Director of the National University shall detail the nomination dossiers and procedures for the Emulation Flags and Certificates of Merit of the National University.

 

Chapter VI

ORGANIZATION AND OPERATION OF THE EMULATION AND COMMENDATION COUNCIL OF THE MINISTRY OF EDUCATION AND TRAINING AND GRASSROOTS-LEVEL EMULATION AND COMMENDATION COUNCILS

 

Article 25. The Emulation and Commendation Council of the Ministry of Education and Training

1. The Emulation and Commendation Council of the Ministry of Education and Training has the function of advising and consulting the Minister of Education and Training in directing and organizing emulation and commendation in the education sector, and shall:

a) Formulate and detail the guidelines of the Party, the policies and law regulations of the State on emulation and commendation in the education sector;

b) Launch emulation movements within the education sector under its competence; monitor and oversee the activities of emulation blocks and clusters within the sector and the Ministry; periodically evaluate and conduct preliminary and final reviews of emulation movements and commendation; recommend and propose guidelines and measures to promote emulation movements in each year and from time to time;

c) Inspect emulation movements and the implementation of guidelines, policies, and law regulations on emulation and commendation;

d) Award emulation titles and commendations under its competence or submit nominations of teams and individuals for emulation titles and commendations in accordance with the regulations to competent authorities.

2. Organization of the Emulation and Commendation Council of the Ministry of Education and Training

a) Composition of the Emulation and Commendation Council of the Ministry of Education and Training

The Chairperson of the Council is the Minister. The Chairperson of the Council shall decide on the Council members; and promulgate the Operation Regulations of the Council.

b) The standing body of the Emulation and Commendation Council of the Ministry of Education and Training is the Personnel and Organization Department under the Ministry of Education and Training.

3. Operation of the Emulation and Commendation Council of the Ministry of Education and Training

a) The Council operates on a collective basis and adheres to the principles of transparency and democracy, with decisions made by majority vote of its members;

b) The Council meets periodically once every 03 months. Extraordinary meetings of the Council may be convened by the Chairperson of the Council to address matters arising between periodic meetings;

c) The Chairperson of the Council chairs or authorizes the permanent Vice Chairperson of the Council to chair the meeting. A meeting of the Council shall only be convened when at least 2/3 of the total number of its members are present. Where necessary, the Chairperson may assign the Council’s standing body to obtain written opinions from Council members, then consolidate them into the minutes, and report to the Chairperson. The Chairperson of the Council may invite representatives of other units and mass organizations to attend meetings of the Council. Invited representatives may speak and participate in discussions but shall not be entitled to vote.

Article 26. Emulation and Commendation Councils of the departments under the Ministry, the Ministry’s Office, the Office of the National Council for Education and Human Resource Development, the Office of the State Council of Professorship, project management boards, program management boards under the Ministry of Education and Training, and units with legal entity status

1. Emulation and Commendation Councils of the departments under the Ministry, the Ministry’s Office, the Office of the National Council for Education and Human Resource Development, the Office of the State Council of Professorship, project management boards, program management boards under the Ministry of Education and Training, and units with legal entity status shall have the function of advising and consulting on the emulation and commendation of the respective units, and shall:

a) Implement the guidelines and policies of the Party, the State, and the Ministry of Education and Training on emulation and commendation;

b) Formulate guidelines on the emulation and commendation of teams and individuals under, and affiliated with, the unit;

c) Appraise nominations for emulation titles and commendations, nominate teams and individuals for emulation titles and commendations within the competence of the Minister, and submit nominations for emulation titles and commendations to competent authorities in accordance with the law regulations;

d) Resolve problems regarding the consideration, honoring, and nomination of teams and individuals under, and affiliated with, the unit for emulation titles and commendations.

2. Organization of the Council

a) The Chairperson shall serve as the head of the Council. The Council shall have no more than 02 Vice Chairpersons. The head of the advisory body in charge of emulation and commendation of the unit shall serve as a Vice Chairperson. The Chairperson shall decide on the Council’s members;

b) The standing body of the Emulation and Commendation Council is the advisory body in charge of emulation and commendation of the unit.

3. The Chairperson of the Council shall promulgate the Operation Regulations of the Council.

 

Chapter VII

PROCEDURES FOR REPLACEMENT OR RE-GRANT OF TOKENS OF COMMENDATION WITHIN THE COMPETENCE OF THE MINISTRY OF EDUCATION AND TRAINING PROCEDURES FOR ANNULLING DECISIONS ON AWARDING EMULATION TITLES AND COMMENDATIONS, WITHDRAWING TOKENS OF COMMENDATION AND CASH REWARD FOR EMULATION TITLES AND COMMENDATIONS UNDER THE COMPETENCE OF THE MINISTRY OF EDUCATION AND TRAINING AND UNITS UNDER, AND AFFILIATED WITH, THE MINISTRY OF EDUCATION AND TRAINING

 

Article 27. Dossiers and procedures for requesting replacement or re-grant of tokens of commendation under the competence of the Ministry of Education and Training

1. Tokens of commendation shall be replaced when they are damaged beyond use, damaged due to objective reasons such as natural disasters, floods, or fires, or incorrectly printed in case of certificates.

Tokens of commendation shall be re-granted when they are lost, misplaced, or damaged due to objective reasons such as natural disasters, floods, or fires.

2. A dossier of request for replacement or re-grant of a token of commendation shall comprise:

a) An official dispatch from the unit that originally nominated the individual/team for such commendation, requesting the replacement and re-grant of the token of commendation, together with relevant proof;

b) A written application from the requesting individual or team for replacement and re-grant of the token of commendation, together with relevant proof;

c) The token of commendation to be replaced.

3. Procedures for replacing or re-granting a token of commendation

a) The individual or team shall send a written application for replacement or re-grant, together with the token of commendation to be replaced, to the unit that originally nominated the individual/team for such commendation strictly in accordance with regulations on commendation;

b) The unit that originally nominated the individual/team for the commendation shall send an official dispatch requesting the replacement or re-grant, together with the token of commendation to be replaced, to the Personnel and Organization Department under the Ministry of Education and Training;

The Personnel and Organization Department under the Ministry of Education and Training shall then look up and verify the commendation, coordinate with the Ministry’s Office to replace the token of commendation, and retain the damaged token of commendation.

c) The Minister of Education and Training shall consider and decide on the replacement or re-grant of the token of commendation. A leader of the Personnel and Organization Department under the Ministry of Education and Training may, under authorization, sign the certificate of replacement and re-grant of the token of commendation.

4. The replacement of a Certificate signed by a former leader no longer holding office shall be made using the current templates as prescribed, containing: the sentence indicating the achievement, which shall be the same as written in the commendation decision; the seal and signature of the former leader who signed the replaced Certificate, pre-printed at the bottom right (such seal and signature are restored from the seal and signature on the replaced Certificate; the commendation decision; the document of the Office of the Ministry of Education and Training introducing the signature; or the document of the Ministry of Public Security recording the seal sample); and the lines “Commendation Decision No. ... dated ...(day, month, year)” and “Certificate of replacement dated ... (day, month, year)” or “Certificate of re-grant dated ... (day, month, year)”. Individuals and teams, when their Certificates are replaced or re-granted, will receive accompanying certificates of replacement or re-grant.

A Certificate signed by an incumbent leader, after the relevant information is confirmed to be accurate, shall be replaced by reprinting it and having it stamped with the seal by the Office.

5. Time limit for replacing or re-granting a token of commendation

a) The unit that receives the written application for replacement or re-grant of a token of commendation from an individual or team shall process it within a time limit of 15 working days;

b) The Minister of Education and Training shall consider and decide on the replacement or re-grant of the token of commendation within a time limit of 15 working days.

6. Tokens of commendation retained upon their replacement or re-grant shall be destroyed by the Ministry of Education and Training.

Article 28. Dossiers and procedures for annulling decisions on awarding emulation titles or commendations, withdrawing tokens of commendation and cash reward for emulation titles and commendations under the competence of the Ministry of Education and Training

1. For teams and individuals committing the acts prescribed in Clause 2, Article 93 of the Law on Emulation and Commendation, the decisions on awarding emulation titles or commendations to them shall be annulled, and the tokens of commendation and cash reward, which they have received, shall be withdrawn.

2. Based on the conclusion of the competent authority determining that the team or individual has committed the violation prescribed in Clause 2, Article 93 of the Law on Emulation and Commendation, the unit that originally nominated the individual/team for the commendation shall submit a request to the Minister of Education and Training to issue a decision annulling the decision awarding the emulation title or commendation, and withdrawing the token of commendation and cash reward.

3. A dossier of request for annulment of a decision on awarding an emulation title or commendation shall comprise:

a) An official dispatch requesting withdrawal for each emulation title or commendation of the individual or team;

b) A summary report from the unit that originally nominated the individual/team for the commendation, detailing the reason for proposing the competent authority the annulment of the decision awarding the emulation title or commendation (enclosed with such decision).

4. The standing body of the Emulation and Commendation Council of the Ministry of Education and Training shall appraise the dossiers and submit them to the Minister for consideration and decision on annulling the decision on awarding emulation titles or commendations under the competence of the Ministry of Education and Training within 10 working days from the date it receives complete dossiers as prescribed.

5. Withdrawal of tokens of commendation and cash rewards granted by the Ministry of Education and Training

a) Within 15 working days from the date of receiving the decision annulling the decision awarding the emulation title or commendation, the team or individual shall hand over the token of commendation and cash reward in full to the unit that originally submitted the commendation nomination for such team or individual;

b) The unit that originally submitted the commendation nomination shall urge the team or individual to promptly hand over the token of commendation and cash reward. Within a time limit of 15 working days from the date the token of commendation and cash reward are withdrawn, the unit that originally submitted the commendation nomination shall send such token of commendation to the standing body of the Emulation and Commendation Council of the Ministry of Education and Training, and send the withdrawn cash reward to the emulation and commendation fund of the unit.

Article 29. Dossiers and procedures for annulling decisions on awarding emulation titles or commendations, withdrawing tokens of commendation and cash rewards for emulation titles and commendations under the competence of departments under the Ministry, the Ministry’s Office, the Office of the National Council for Education and Human Resource Development, the Office of the State Council of Professorship, project management boards, program management boards under the Ministry of Education and Training and units with legal entity status

1. For teams and individuals committing the acts prescribed in Clause 2, Article 93 of the Law on Emulation and Commendation, the decisions on awarding emulation titles or commendations to them shall be annulled, and the tokens of commendation and cash reward, which they have received, shall be withdrawn.

2. Based on the conclusion of the competent authority determining that the team or individual has committed the violation prescribed in Clause 2, Article 93 of the Law on Emulation and Commendation, the standing body of the Emulation and Commendation Council of a department under the Ministry, the Ministry’s Office, the Office of the National Council for Education and Human Resource Development, the Office of the State Council of Professorship, a project management board, or a program management board under the Ministry of Education and Training, or an unit with legal entity status, which originally nominated the individual/team for the commendation, shall submit a request to its head to issue a decision annulling the decision awarding the emulation title or commendation, and withdrawing the token of commendation and cash reward.

3. A dossier of request for annulment of a decision on awarding an emulation title or commendation shall comprise:

a) An official dispatch requesting withdrawal for each emulation title or commendation of the individual or team;

b) A summary report from the unit that originally nominated the individual/team for the commendation, detailing the reason for proposing the competent authority the annulment of the decision awarding the emulation title or commendation (enclosed with such decision).

4. The standing bodies of the Emulation and Commendation Councils of the departments under the Ministry, the Ministry’s Office, the Office of the National Council for Education and Human Resource Development, the Office of the State Council of Professorship, project management boards, program management boards under the Ministry of Education and Training, and units with legal entity status shall appraise the dossiers, submit them to the heads of the respective units for consideration and decision on annulling the decisions on awarding emulation titles or commendations under their competence within 10 working days from the date they receives complete dossiers as prescribed.

5. Withdrawal of tokens of commendation and cash rewards granted by departments under the Ministry, the Ministry’s Office, the Office of the National Council for Education and Human Resource Development, the Office of the State Council of Professorship, project management boards, program management boards under the Ministry of Education and Training and units with legal entity status

a) Within 15 working days from the date of receiving the decision annulling the decision awarding the emulation title or commendation, the team or individual shall hand over the token of commendation and cash reward in full to the unit that originally submitted the commendation nomination for such team or individual;

b) The unit that originally submitted the commendation nomination shall urge the team or individual to promptly hand over the token of commendation and cash reward.

 

Chapter VIII

ORGANIZATION OF IMPLEMENTATION

 

Article 30. Tasks and powers of organizations and individuals regarding emulation and commendation

1. The Personnel and Organization Department under the Ministry of Education and Training, as the standing body of the Emulation and Commendation Council of the Ministry of Education and Training, shall assume the prime responsibility for advising on emulation and commendation; assist the Minister in launching emulation movements; formulate programs, plans, organizing measures, and details of emulation within the education sector; guide, oversee, inspect, and conduct preliminary and final reviews of emulation movements and the emulation and commendation practices; replicate exemplars and role models within the sector; and appraise dossiers and submit them to the Minister of Education and Training for decisions on commendation within their competence, or submit commendation nominations to competent authorities.

2. The International Cooperation Department shall assume the prime responsibility for summarizing nomination dossiers for commendations of Vietnamese teams and individuals residing overseas, Vietnamese nationals working for Vietnam-based foreign organizations, and foreign teams and individuals with exemplarily outstanding achievements and contributions to the cause of education and training; assume the prime responsibility for seeking opinions from the Ministry of Public Security, the Ministry of Foreign Affairs, and relevant agencies and units; and forward the dossiers to the Personnel and Organization Department for appraisal and onward submission to the Minister of Education and Training for consideration and decision.

3. Heads of units under the Ministry, units affiliated with the Ministry, directors of provincial-level Departments of Education and Training, principals, directors or equivalent positions of educational institutions shall coordinate with mass organizations at the same level to elaborate the regulations, criteria, and measures for organizing emulation movements and inspecting their implementation; conduct preliminary and final reviews of such movements and replicate exemplary models; identify teams and individuals with exceptionally outstanding achievements and contributions to the development of education and training, and promptly nominate them for commendations by competent authorities and persons commensurate with their achievements; and make recommendations to innovate emulation and commendation practices.

4. Information, press, and publishing agencies under the Ministry of Education and Training, provincial-level Departments of Education and Training, and educational institutions shall be responsible for regularly disseminating the guidelines of the Party, and the policies and the law regulations of the State on emulation and commendation; actively participating in the identification of teams and individuals with outstanding achievements and contributions to the education sector; popularizing and honoring exemplars and role models; and combating manifestations of chasing after achievements and violations of the law regulations on emulation and commendation.

Article 31. Transitional provisions

1. Nomination dossiers for emulation titles and commendations that have been sent to the Ministry of Education and Training before the effective date of this Circular shall comply with Circular No. 29/2023/TT-BGDDT dated December 29, 2023 of the Minister of Education and Training detailing a number of articles of the Law on Emulation and Commendation for the education sector.

2. For individuals who meet the criteria and conditions for the Commemorative Medal “For the Cause of Education” but have not yet been awarded it, their units may nominate them for it using the dossier prescribed in this Circular.

Article 32. Effect and responsibilities for implementation

1. This Circular takes effect from April 02, 2026. This Circular supersedes Circular No. 29/2023/TT-BGDDT dated December 29, 2023 of the Minister of Education and Training detailing a number of articles of the Law on Emulation and Commendation for the education sector and Circular No. 10/2024/TT-BGDDT dated August 26, 2024 of the Minister of Education and Training prescribing the “Emulation Flag of the National University”.

2. In cases where the legal documents referenced in this Circular are amended, supplemented, or superseded by other documents, such other documents shall prevail.

3. Ministries, ministerial-level agencies, agencies under the Government; People’s Committees of provinces and centrally-run cities; Chief of Office of the Ministry, Director of the Personnel and Organization Department, heads of units under, and affiliated with, the Ministry; directors of provincial-level Departments of Education and Training; directors of universities and academies; principals of educational institutions, and relevant organizations, units, and individuals are responsible for the implementation of this Circular./.
