SUMMARY

National technical regulation on lubricating oils for internal combustion engines

Circular No. 06/2018/TT-BKHCN issued with the National technical regulation on lubricating oils for internal combustion engines by the Ministry of Science on May 15, 2018.

Accordingly, to issued with this Circular the QCVN 14:2018/BKHCN “National technical regulation on lubricating oils for internal combustion engines”.

In particular, the regulation prescribes that  kinematic viscosity grade of an engine oil must meet the manufacturer’s standard in conformity with SAE viscosity grade or national, regional or international standards. Additives used to prepare engine oils must comply with regulations on safety, health and environment and must not damage engines and system of storage, transport and distribution.

Declaration of conformity of engine oils that are produced, prepared and imported must be made in accordance with regulations. Such engine oils must bear the conformity mark (CR) before being marketed.

This Circular takes effect on July 30, 2018.

Pursuant to the Law on Technical Standards and Regulations dated June 29, 2006 and Government’s Decree No. 127/2007/ND-CP dated August 01, 2007 on elaboration of some Articles of the Law on Technical Standards and Regulations;

Pursuant to the Government’s Decree No. 95/2017/ND-CP dated August 16, 2017 defining functions, tasks, entitlements and organizational structure of the Ministry of Science and Technology;

At the request of the Director of the Directorate for Standards, Metrology and Quality and Director of the Department of Legal Affairs,

The Minister of Science and Technology hereby promulgates a Circular on “National technical regulation on lubricating oils for internal combustion engines”.

Article 1.To issue with the Circular theQCVN 14:2018/BKHCN “National technical regulation on lubricating oils for internal combustion engines”.

Article 2.This Circular takes effect on July 30, 2018.

Article 3.Transitionaltime

1. Lubricating oils for internal combustion engines that are produced, prepared and imported from December 15, 2018 shall apply QCVN 14:2018/BKHCN.

2. Lubricating oils for internal combustion engines that are produced, prepared, imported and sold before December 15, 2018 shall continue to be sold until June 15, 2020.

Article 4.The Director of theDirectorate for Standards, Metrology and Quality, heads of relevant organizations and individuals shall implement this Circular./.

NATIONAL TECHNICAL REGULATION ON LUBRICATING OILS FOR INTERNAL COMBUSTION ENGINES

FOREWORD

QCVN 14:2018/BKHCNis preparedDrafting Committee for national technical regulation on lubricating oils for internal combustion engines, submitted by the Directorate for Standards, Metrology and Quality for approval and promulgated together with the Circular No. 06/TT-BKHCN dated May 15, 2018 of the Minister of Science and Technology.

 

NATIONAL TECHNICAL REGULATION ON LUBRICATING OILS FOR INTERNAL COMBUSTION ENGINES

1. GENERAL PROVISIONS

1.1. Scope of adjustment

This document provides for maximum limits of specifications and requirements for control of quality of lubricating oils for internal combustion engine.

This document does not apply to lubricating oils for internal combustion engines used for security and defense purposes.

1.2. Subject of application

1.2.1. This document applies to organizations and individuals related to import, production, preparation, distribution and retail of lubricating oils for internal combustion engines in Vietnam.

1.2.2. Regulatory authorities and other relevant organizations and individuals.

1.3. Definitions

For the purposes of this document, the terms below shall be construed as follows:

1.3.1. “lubricating oil for internal combustion engines” (hereinafter referred to as “engine oils”) means an oil used for 4-stroke and 2-stroke internal combustion engines and includes:

- Mineral oil means an oil obtained from petroleum by distillation and treatment.

- Synthetic oil means an oil produced from chemical reactions of original compounds.

- Semi-synthetic oil means a mixture of mineral oil and synthetic oil.

1.3.2. “4-stroke engine oil” means an oil used for 4-stroke internal combustion engines (4-cycle engines)

1.3.3. “2-stroke engine oil” means an oil used for 2-stroke internal combustion engines (2-cycle engines)

1.3.4. “additives” mean inorganic or organic compounds or chemical elements that are added to engine oils to enhance or exhibit desirable properties.

1.4. Engine oil performance classification

In case engine oils used for 4-stroke and 2-stroke engines, petrol engines, diesel engines or both gasoline and diesel engines bear a symbol depicting the performance classification, such engine oils must meet the manufacturer’s standard (in conformity with national, regional or international standards).

2. TECHNICAL REQUIREMENTS

2.1.Viscosity grade: kinematic viscosity grade of an engine oil must meet the manufacturer’s standard (in conformity with SAE viscosity grade or national, regional or international standards).

2.2.Compulsory specifications and limits of engine oils are provided in the Section 1.3.1 of Table 1.

2.3.Additives

Additives used to prepare engine oils must comply with regulations on safety, health and environment and must not damage engines and system of storage, transport and distribution.

2.4. Labeling

Engine oils sold on the market shall be labeled in accordance with applicable regulations. Every pre-packaged engine oils shall carry a clear and readily legible label. The label should be durable and not tear or fade during transport.

A label shall contain at least:

+ Name of the engine oil (specify the type of engine for which it is intended);

+ Name and address of organization or individual responsible for the engine oil;

+ Origin of the engine oil;

+ Volume/ Mass:

+ Specifications (viscosity grade, performance classification);

+ Instructions for use, storage;

+ Warning.

2.5.In addition to the requirements set forth in Clauses 2.1, 2.2, 2.3 and 2.4, engine oils shall comply with requirements for specifications and characteristics in order not to threaten safety of people, animals, plants, environment and property.

3. TEST METHODS

3.1. Sampling

Samples used to determine the specifications specified in this document shall be taken according to TCVN 2715:1995 (ISO 3710:1988, ASTM D4057:1988)Petroleum liquids - Manual sampling.

3.2. Test methods:

Specifications for engine oils set forth in Section 2 of this document shall be determined using the following methods:

- TCVN 3171:2011 (ASTM D445-11)Standard test method for kinematic viscosity of transparent and opaque liquids (and calculation of dynamic viscosity);

4. REGULATORY REQUIREMENTS

4.1.Declaration of conformity of engine oils that are produced, prepared and imported must be made in accordance with Section 2 of this document. Such engine oils must bear the conformity mark (CR) before being marketed.

4.2.Declaration of conformity of engine oils that are produced, prepared and imported according to the specifications specified in Section 2 of this document shall be made according to the certification result given by a registered certification organization as prescribed in the Government’s Decree No. 107/2016/ND-CP dated July 01, 2016 or a recognized certification organization. Declaration of conformity shall be made as prescribed in the Circular No. 28/2012/TT-BKHCN dated December 12, 2012 of the Ministry of Science and Technology and Circular No. 02/2017/TT-BKHCN dated March 31, 2017 of the Ministry of Science and Technology.

Quality of imported engine oils shall be inspected as prescribed in Clause 3 Article 1 of the Circular No. 07/2017/TT-BKHCN dated June 16, 2017 of the Minister of Science and Technology.

4.3.Methods for conformity assessment and rules for application thereof are prescribed in Article 5 and Appendix II of the Regulation on declaration of standard conformity and technical-regulation conformity promulgated together with the Circular No. 28/2012/TT-BKHCN dated December 12, 2012 of the Ministry of Science and Technology.

4.3.1. Declaration of engine oils that are domestically produced and prepared shall be made using method 5 (Test on representative sample and assess the manufacturing process; carry out supervision by testing the sample collected from the manufacturing location or on the market in association with assessment of the manufacturing process) at the production and preparation facility. In case the production and preparation facility fails to satisfy quality assurance requirements according to method 5, it is required to apply method 7.

4.3.2. Regarding imported engine oils, each shipment of such imported engine oils shall have its conformity certified using method 7 (Test on and assess conformity of shipments). In case conformity is certified at the production and preparation facility at the request of the production facility, method 5 specified in Section 4.3.1 shall be applied.

5. RESPONSIBILITIES OF ORGANIZATIONS AND INDIVIDUALS

5.1.Every organization or individual that imports, produces or prepares engine oils shall publish applied standards in accordance with this document and ensure fulfillment of quality requirements laid down in this document and applied standards.

5.2.Every organization or individual that produces, prepares or imports engine oils shall submit declarations of conformity as prescribed in this document.

5.3.Every distributor or retailer of engine oils shall ensure quality of engine oils as prescribed in this document.

6. IMPLEMENTATIONORGANIZATION

6.1.The Directorate for Standards, Metrology and Quality shall instruct, inspect and cooperate with relevant authorities to organize the implementation of this document.

According to regulatory requirements, the Directorate for Standards, Metrology and Quality shall recommend the Ministry of Science and Technology to make amendments to this document.

6.2.In the cases where any of the legislative documents referred to in this document is amended or replaced, the newest one shall apply. In the cases where any of the standards referred to in this document is amended or replaced, guidelines laid down by the Directorate for Standards, Metrology and Quality shall be adhered to./.
