CIRCULAR
Providing for the application of import tariff-rate quotas for raw tobacco and poultry eggs originating in the Eurasian Economic Union’s member states for the 2023-2027 period[1]
Pursuant to the 2017 Law on Foreign Trade Management;
Pursuant to the Government’s Decree No. 96/2022/ND-CP of November 29, 2022, defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;
Pursuant to the Government’s Decree No. 69/2018/ND-CP of May 15, 2018, detailing a number of articles of the Law on Foreign Trade Management;
In implementation of the Vietnam-Eurasian Economic Union Free Trade Agreement ratified by the President of the Socialist Republic of Vietnam;
At the proposal of the Director General of the Agency of Foreign Trade,
The Minister of Industry and Trade promulgates the Circular providing for the application of import tariff-rate quotas for raw tobacco and poultry eggs originating in the Eurasian Economic Union’s member states for the 2023-2027 period.
Article 1. Scope of regulation
To apply import tariff-rate quotas to raw tobacco and poultry eggs originating in the Eurasian Economic Union’s member states in accordance with the Vietnam-Eurasian Economic Union Free Trade Agreement for the 2023-2027 period.
Article 2. Subjects of application
This Circular applies to traders that import under tariff-rate quotas the raw tobacco and poultry eggs from the Eurasian Economic Union’s member states and other related agencies, organizations and individuals.
Article 3. Commodities and import tariff-rate quota volumes
1. HS codes and import tariff-rate quota volumes for commodity items subject to tariff-rate quotas specified in Article 1 of this Circular for the 2023-2027 period are provided in the Appendix promulgated together with this Circular.
2. Goods imported from the Eurasian Economic Union’s member states under the Vietnam-Eurasian Economic Union Free Trade Agreement must be accompanied by a certificate of origin (C/O, Form EAV) issued under current regulations.
Article 4. Subjects eligible for allocation of import tariff-rate quotas
1. Import tariff-rate quotas for raw tobacco shall be allocated to traders that possess cigarette production permits granted by the Ministry of Industry and Trade and wish to use imported raw tobacco for cigarette production.
2. Import tariff-rate quotas for poultry eggs shall be allocated to traders that have demand for import.
Article 5. Methods of allocation of import tariff-rate quotas
The allocation of import tariff-rate quotas for raw tobacco and poultry egg must comply with the Minister of Industry and Trade’s Circular No. 12/2018/TT-BCT of June 15, 2018, detailing a number of articles of the Law on Foreign Trade Management and the Government’s Decree No. 69/2018/ND-CP of May 15, 2018, detailing a number of articles of the Law on Foreign Trade Management.
Article 6. Effect
This Circular takes effect from April 10, 2023, through December 31, 2027.-

(*) The tariff-rate quota volumes for poultry eggs originating in the Eurasian Economic Union’s member states are separate from Vietnam’s tariff-rate quota volumes for poultry eggs under WTO commitments.
(**) The tariff-rate quota volumes for unmanufactured tobacco and tobacco refuse originating in the Eurasian Economic Union’s member states shall be applied in accordance with Vietnam’s international commitments and relevant domestic laws to products subject to these tariff-rate quotas.
