CIRCULAR

Promulgating the “National technical regulation on protective helmets for motorcycle and moped users”

Pursuant to the Law on Standards and Technical Regulations dated June 29, 2006;

Pursuant to the Government’s Decree No. 127/2007/ND-CP dated August 01, 2007, on detailing the implementation of a number of articles of the Law on Standards and Technical Regulations and the Government’s Decree No. 78/2018/ND-CP dated May 16, 2018, on amending and supplementing a number of articles of the Decree No. 127/2007/ND-CP;

Pursuant to Government's Decree No. 95/2017/ND-CP dated August 16, 2017, defining the functions, tasks, powers and organizational structure of the Ministry of Science and Technology;

At the proposal of the Director General of the Directorate for Standards, Metrology and Quality and the Director of the Department of Legal Affairs;

The Minister of Science and Technology hereby issues the Circular promulgating the “National technical regulation on protective helmets for motorcycle and moped users”.

Article 1. To promulgate together with this Circular the National technical regulation on protective helmets for motorcycle and moped users (QCVN 2:2021/BKHCN).

Article 2. Roadmap for application

1. From January 01, 2024, imported and domestically-manufactured protective helmets for motorcycle and moped users must meet requirements provided in QCVN 2:2021/BKHCN before being circulated on the market.

2. Enterprises, organizations and individuals manufacturing or importing protective helmets for motorcycle and moped users are encouraged to apply requirements provided in QCVN 2:2021/BKHCN from the effective date of this Circular.

Article 3. Effect

1. This Circular takes effect from August 01, 2021.

2. From the effective date of this Circular, the following provisions shall cease to be effective:

a) The Minister of Science and Technology's Decision No. 04/2008/QD-BKHCN dated April 28, 2008, on promulgation and implementation of the “National technical regulation on protective helmets for motorcycle and moped users”;

b) The Minister of Science and Technology's Circular No. 02/2014/TT-BKHCN dated March 31, 2014, amending and supplementing Article 2 of the Minister of Science and Technology's Decision No. 04/2008/QD-BKHCN dated April 28, 2008, on promulgation and implementation of the “National technical regulation on protective helmets for motorcycle and moped users”.

Article 4. Transitional provisions

Imported and domestically-manufactured protective helmets for motorcycle and moped users that have been certified and announced technical regulation conformity in accordance with provisions of the QCVN 02:2008/BKHCN to the Minister of Science and Technology's Decision No. 04/2008/QD-BKHCN dated April 28, 2008, and circulated before January 01, 2024 may continue to be circulated on the market until the end of December 31, 2024.

Article 5. Implementation organization

1. Director General of the Directorate for Standards, Metrology and Quality shall be responsible for guiding, disseminating, propagandizing and implementing this Circular.

2. Ministers, heads of ministerial-level agencies, heads of government-attached agencies, chairpersons of People’s Committees of provinces and centrally-run cities, and related organizations and individuals shall implement this Circular.

3. Any difficulties arising in the course of implementation should be promptly reported in writing to the Ministry of Science and Technology for guidance, or review, amendment and supplementation./.
