CIRCULAR
Prescribing architectural design dossiers and the form of architectural practice certificate[1]
Pursuant to the June 13, 2019 Law on Architecture;
Pursuant to the Government’s Decree No. 81/2017/ND-CP of July 17, 2017, defining the functions, tasks, powers and organizational structure of the Ministry of Construction;
At the proposal of the Director of the Planning-Architecture Department;
The Minister of Construction promulgates the Circular prescribing architectural design dossiers and the form of architecture practice certificate.
Chapter I
GENERAL PROVISIONS
Article 1. Scope of regulation and subjects of application
This Circular prescribes the contents of architectural design dossiers and the form of architectural practice certificate applicable to domestic and foreign organizations and individuals involved in architectural design activities in the territory of the Socialist Republic of Vietnam.
Article 2. General provisions on architectural design dossiers
1. Architectural design dossiers constitute a component of construction design dossiers, which shall be appraised and approved in accordance with the Law on Construction.
2. Architectural design dossiers are classified into the following types:
a/ Preliminary architectural design dossier, which is the architectural content of the preliminary design at the stage of making the prefeasibility study report;
b/ Basic architectural design dossier, which is the architectural content of the basic design at the stage of making the feasibility study report;
c/ Architectural engineering design, which is the architectural content of the engineering design at the stage after the basic design is completed;
d/ Construction drawing architectural design, which is the architectural content of the construction drawing design at the stage after the basic design is completed;
dd/ Architectural design dossiers of other design steps (if any) according to international practices, corresponding to construction design steps decided by the investment decider when making investment decision.
3. Architectural design dossiers in particular work construction investment projects must comply with the Law on Construction.
4. Architectural design dossiers in urban planning, rural planning and urban design must comply with the Law on Construction and the Law on Urban Planning.
5. In case an architectural design is modified, an adjusted architectural design dossier must be made, comprising modified drawings satisfying the following requirements:
a/ Clearly stating the content, time and numbers of adjustment, which must be agreed upon by the design manager and the project owner;
b/ Having the designing organization and the project owner, that shall take responsibility before law for the modified contents, signed for certification in the title blocks.
Chapter II
CONTENTS OF ARCHITECTURAL DESIGN DOSSIERS
Article 3. Specifications of architectural design dossiers
1. An architectural design dossier must comprise drawings and explanatory components.
2. An architectural design dossier must satisfy the following requirements:
a/ Specifications and scales of drawings comply with Vietnam Standard TCVN 5671:2012 on the system of building design documents - documents for architectural design;
b/ The title blocks of drawings comply with Vietnam Standard TCVN 5571:2012 on the system of design documents for construction - construction drawings - title blocks.
3. The person responsible for architectural practice of the design organization or at-law representative or authorized person of the design contractor shall sign and affix the design contractor’s seal as prescribed by law.
4. Design managers whose names are stated in design dossiers shall:
a/ Directly organize the implementation of design tasks, have professional qualifications and take the highest responsibility for the contents and quality of architectural designs, and control other sections so as to ensure coordination and unity with the architectural section;
b/ The design manager may be either the author of the architectural plan or the person directly organizing the realization of the author’s ideas.
5. The architectural design chair whose name is stated in the design dossier:
a/ Must be capable of taking charge of making or verifying the architectural design and shall take responsibility for the contents of the architectural design;
b/ May play the role of the design manager if so authorized by latter.
Article 4. Preliminary architectural design dossier
1. The drawings must include:
a/ Location map of the construction land plot, data on the size and nature of the project, current state and boundary of the land plot, planning information, direction and route of existing technical infrastructure works and works under approved master plans (if any), existing works and surrounding landscape architecture, and traffic connection analysis;
b/ The architectural concept drawings presenting the functional relationship diagram, shapes, lines, colors and lights on the general plan, perspective, plan, elevation and section drawings, interior and exterior, and the relationship with the architectural space of the shared landscape of the area.
2. The explanatory component must cover:
a/ Explanations for the contents specified in Clause 1 of this Article;
b/ Orientations on structural solutions, the equipment and technical infrastructure system, and operation and exploitation management;
c/ A list of applicable technical regulations and standards;
d/ Appendices to legal documents concerning the legality of the formulation of the preliminary architectural design dossier.
Article 5. Basic architectural design dossier
1. The drawings must include:
a/ The drawings specified in Clause 1, Article 4 of this Circular;
b/ Drawings showing architectural solutions combined with structural solutions and the equipment and technical infrastructure systems.
2. The explanatory component must cover:
a/ Brief introduction of the construction site, size and nature of the project; explanations about architectural concepts, architectural design solutions and to-be-used materials;
b/ General plan design solutions, location and construction scale of work items and technical infrastructure facilities in the area;
c/ A list of applicable technical regulations and standards;
d/ Appendices to legal documents concerning the legality of the formulation of the basic architectural design dossier.
Article 6. Technical architecture design dossiers
1. The contents of a technical architecture design dossier must conform to the basic design appraised and approved by competent authorities and clarify specifications, materials, dimensions and specific technical calculations for production, construction and installation.
2. The drawings must include:
a/ Location map of the construction land plot, map showing the current state and boundary of the land plot, and planning information according to approved master plan;
b/ A general plan drawing showing items of the construction investment project, clearly defining items to be built, renovated or embellished on the basis of existing items in the land plot, and determining red-line boundaries, construction demarcation, entrances, exits, traffic divergence, and technical criteria regarding the area of the land plot, construction area, construction density, total floor area, land use coefficient, area of each item, number of floors, internal traffic system, identification of boundaries and location of underground works;
c/ Drawings showing the position of the work, floor plans, elevations, sections, relationship diagrams and spatial organization;
d/ Illustrative drawings: overall perspective, corner perspective, and basic interior and exterior drawings;
dd/ Drawings showing dimensions and types and number of doors and staircases; statistics of area, designation of materials, architectural colors of elevations, sanitary areas, floor covering, and the list of finishing materials;
e/ Drawings of ancillary works and exterior constructions, fences, trees and garden.
3. The explanatory component must:
a/ Express calculation and selection of technical plans, technological lines, and material properties, clarify parameters which are not fully shown in the drawings, and ensure sufficient grounds for making total cost estimates of the work and construction design;
b/ Include the contents specified in Clause 2, Article 5 of this Circular.
Article 7. Construction drawing architecture design dossiers
1. Contents of construction drawing architecture design dossiers must conform with basic designs and technical designs appraised and approved by competent authorities; show all parts of the works and structures in detail with all sizes, materials and specifications and clearly indicate instructional contents in the drawings to be constructed according to the design.
2. The drawings must include:
a/ The drawings specified in Clause 2, Article 6 of this Circular;
b/ Detailed structures of construction parts;
c/ Detailed structures of auxiliary works, garage, fence gate, garden, flower basin, underground water tank, drainage ditch, landscape lighting; pavements and footpaths;
d/ Ceiling designs, lighting equipment, sound equipment and equipment attached to the work.
3. The explanatory component must cover:
a/ Explanations about all contents that cannot be shown in the drawings so that the construction unit may implement designs and technical instructions, thus ensuring the implementation of construction designs after the basic design is completed;
b/ The contents specified in Clause 3, Article 6 of this Circular.
Article 8. Interior design dossiers
1. An interior design dossier that is not part of the construction drawing architecture design dossier specified in Article 7 of this Circular shall be made at the request of the project owner and the design contractor.
2. The drawings must include:
a/ Drawings showing the current state, ground plan and position of the interior design space, and a diagram analyzing the relationship with other functional spaces;
b/ To-be-implemented plans and elevations, flooring, and interior and electrical equipment arrangements;
c/ Details of models of furniture and equipment;
d/ Illustrative perspective drawings.
3. The explanatory component must cover a list and statistics of equipment, regulations on materials, instructions for construction contractors to comply with the design, and warranty and maintenance technical process.
Article 9. Exterior and landscape architecture design dossier
1. The exterior and landscape architecture design dossier shall be made separately, not included in the construction design dossier, and made at the request of the project owner and the design contractor.
2. The drawings must show:
a/ The current state of the landscape, plan, elevations, and exterior and garden arrangements;
b/ Architectural details, types of trees, tree tubs, miniatures, exterior furniture, paths, lakes, and designation of materials related to the design;
c/ Designation of finishing of exterior and garden decoration, statistics and designation of specifications of to-be-installed equipment;
d/ The overall perspective drawings of the garden, details, highlights and miniatures.
3. The explanatory component must include a list and statistics of materials, trees and equipment, instructions for construction contractors to comply with the design, and warranty and maintenance technical process.
Chapter III
FORM OF ARCHITECTURAL PRACTICE CERTIFICATE
Article 10. Contents of architectural practice certificates
1. Management of serial numbers of practice certificates: The serial number of a practice certificate is composed of 2 groups of symbols, linked together by a dash (-) and shall be prescribed as follows:
The first group: 3 characters representing the place of certificate issuance as specified in Appendix I to this Circular;
The second group: the code of the practice certificate.
2. The main contents of an architectural practice certificate include: Basic information of the certificate grantee: 4cm x 6cm photo, full name, date of birth and number of people’s identity card (citizen identity card or passport);
Name of issuing agency, signature and seal;
Field(s) of practice and duration of practice in each field.
3. The format and main contents of practice certificates must comply with the form provided in Appendix II to this Circular.
Chapter IV
ORGANIZATION OF IMPLEMENTATION
Article 11. Transitional provisions
Architectural design dossiers of construction investment projects for which construction design contracts have been signed before the effective date of this Circular may continue to be performed in conformity with design contracts.
Article 12. Effect
This Circular takes effect on September 15, 2020.-
