CIRCULAR

Providing a number of measures for implementation of the Law on Chemicals and the Government's Decree No. 25/2026/ND-CP detailing and providing measures for organization and guidance for implementation of a number of articles of the Law on Chemicals regarding development of the chemical industry and chemical safety and security

 

Pursuant to the Law on Chemicals No. 69/2025/QH15;

Pursuant to the Government’s Decree No. 40/2025/ND-CP defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade, amended and supplemented under Decree No. 109/2025/ND-CP and Decree No. 193/2025/ND-CP;

Pursuant to the Government's Decree No. 25/2026/ND-CP detailing and providing measures for organization and guidance for implementation of a number of articles of the Law on Chemicals regarding development of the chemical industry and chemical safety and security;

At the proposal of the Director General of the Vietnam Chemicals Agency;

The Minister of Industry and Trade hereby promulgates the Circular providing a number of measures for implementation of the Law on Chemicals and the Government's Decree No. 25/2026/ND-CP detailing and providing measures for organization and guidance for implementation of a number of articles of the Law on Chemicals regarding development of the chemical industry and chemical safety and security.

 

Article 1. Scope of regulation

This Circular provides a number of measures for implementation of the Law on Chemicals and the Government's Decree No. 25/2026/ND-CP detailing and providing measures for organization and guidance for implementation of a number of articles of the Law on Chemicals regarding development of the chemical industry and chemical safety and security, including:

1. Recording of codes of specialized chemical consultant certificates.

2. Forms used in the issuance, re-issuance, modification, and revocation of specialized chemical consultant certificates.

3. Contents of chemical incident prevention and response plans; measures for prevention and response to chemical incidents; measures for prevention and response to chemical incidents in transportation; provincial-level chemical incident prevention and response plans.

4. Forms used in the appraisal and approval of chemical incident prevention and response plans.

5. Contents, procedures, forms, and dossiers for drills for response to chemical incidents.

6. Decentralization of implementation of appraisal and approval of chemical incident prevention and response plans under the competence of the Ministry of Industry and Trade.

Article 2. Subjects of application

This Circular applies to agencies, organizations, and individuals carrying out activities related to chemicals within the territory of the Socialist Republic of Vietnam.

Article 3. Recording of certificate codes; forms used in the issuance, re-issuance, modification, and revocation of specialized chemical consultant certificates

1. Recording of codes of specialized chemical consultant certificates.

a) The code of a newly issued certificate shall be recorded according to the personal identification number for citizens of the Socialist Republic of Vietnam or the work permit number or the certification of exemption from work permit in Vietnam for foreigners;

b) The code of a modified certificate shall be recorded according to the structure: (Code of newly issued certificate).XX, in which XX is the ordinal number of times of modification;

c) The code of a re-issued certificate shall be recorded according to the code of the most recently issued certificate.

2. Forms used in the issuance, re-issuance, modification, and revocation of specialized chemical consultant certificates are prescribed in Appendix I to this Circular, including:

a) Form 01a: Application for issuance, re-issuance, or modification of a specialized chemical consultant certificate;

b) Form 01b: Certification of working experience;

c) Form 01c: Certification by the lawful representative of the project owner of the works completed by the individual;

d) Form 01d: Decision on revocation of a specialized chemical consultant certificate.

Article 4. Prevention of and response to chemical incidents

1. The contents of chemical incident prevention and response plans; measures for prevention of and response to chemical incidents; measures for prevention of and response to chemical incidents in transportation; and provincial-level chemical incident prevention and response plans shall be implemented in accordance with the guidance provided in Appendix II to this Circular.

2. Forms used in the appraisal and approval of chemical incident prevention and response plans are prescribed in Appendix III to this Circular, including:

a) Form 03a: Application for appraisal of a chemical incident prevention and response plan;

b) Form 03b: Record and notification of appraisal results of a chemical incident prevention and response plan;

c) Form 03c: Evaluation and assessment form of a chemical incident prevention and response plan by members of the Appraisal Council;

d) Form 03d: Report on results of implementation of requirements of the Appraisal Council;

dd) Form 03dd: Record and report on inspection results of the Appraisal Council;

e) Form 03e: Certification stamp template affixed to the cover page of the approved chemical incident prevention and response plan.

3. Vietnam Chemicals Agency shall appraise and approve chemical incident prevention and response plans in the civil sector for entities specified at Point a, Clause 2, Article 33 of Decree No. 25/2026/ND-CP.

Article 5. Drills for response to chemical incidents

1. Contents of drills for response to chemical incidents must include:

a) Time and location of organization of the drill;

b) Assumed drill scenarios;

c) Procedures for implementation of response to assumed scenarios;

d) Information on coordinating units, forces directly participating in the drill, and means and equipment serving the drill.

2. The process for organization of drills for response to chemical incidents shall be implemented as follows:

a) Formulating an overall scenario for organization of the drill, including the contents specified in Clause 1 of this Article;

b) After formulating the drill organization scenario, organizations and individuals conducting the drill shall develop specific practical exercises for forces participating in the drill in accordance with the overall scenario formulated;

c) Organizing training and rehearsal for forces participating in the drill where necessary;

d) Organizing the drill in accordance with the overall scenario formulated;

dd) Summarizing and drawing lessons;

e) Preparing a report on organization of the drill;

g) Updating drill dossiers on the specialized chemical database and retaining drill dossiers for at least 3 years from the date of completion of the drill.

3. A dossier of drills for response to chemical incidents must comprise:

a) Overall scenario for the drill for response to chemical incidents;

b) List of forces and means participating in the drill for response to chemical incidents;

c) Report on organization of the drill for response to chemical incidents in accordance with Form No. 04 prescribed in Appendix IV to this Circular.

Article 6. Effect

1. This Circular takes effect from January 17, 2026.

2. Any difficulties arising in the course of implementation should be reported to the Ministry of Industry and Trade (via the Vietnam Chemicals Agency) for consideration, amendment and supplement or timely guidance./.
