Circular 02/2023/TT-BCT repeal a number of regulations of Circular 57/2020/TT-BCT on method to determine electricity generation prices

On repealing a number of regulations defined in the Circular No. 57/2020/TT-BCT dated December 31, 2020 of the Minister of Industry and Trade on providing method to determine electricity generation prices and power purchase agreement

Pursuant to the Law on Promulgation of Legal Documents dated June 22, 2015; the Law on Amending and Supplementing a Number of Articles of the Law on Promulgation of Legal Documents dated June 18, 2020;

Pursuant to the Electricity Law dated December 03, 2004; the Law on Amending and Supplementing a Number of Articles of the Electricity Law dated November 20, 2012;

Pursuant to the Government’s Decree No. 96/2022/ND-CP dated November 29, 2022, defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;

Pursuant to the Government’s Decree No. 137/2013/ND-CP dated October 21, 2013, detailing a number of articles of the Electricity Law and the Law Amending and Supplementing a Number of Articles of the Electricity Law;

At the proposal of the Director of Electricity Regulatory Authority of Vietnam;

The Minister of Industry and Trade promulgates the Circular on repealing a number of regulations defined in the Circular No. 57/2020/TT-BCT dated December 31, 2020 of the Minister of Industry and Trade on providing method to determine electricity generation prices and power purchase agreement.

Article 1. Repealing a number of regulations defined in the Circular No. 57/2020/TT-BCT dated December 31, 2020 of the Minister of Industry and Trade on providing method to determine electricity generation prices and power purchase agreement

1. To repeal Clause 1 Article 17.

2. To repeal the phrase “before the date of commencement of construction of works” Clause 1 Article 25.

3. To repeal the phrases “With regard to natural gas domestically exploited through a system of natural monopoly collection, transportation and distribution pipelines, the charges for gas collection, transportation and distribution must be approved by competent state agencies.” and “In case the gas storage and distribution item is natural monopoly, the charges for gas storage, recycling and distribution must be approved by a competent state agency.” in Clause 1 Article 26.

4. To repeal Clause 5 Article 28.

Article 2. Implementation provisions

This Circular takes effect on January 19, 2023.

Article 3. Implementation responsibility

Heads of units under the Ministry, People’s Committees of provinces and centrally-run cities, related organizations and individuals shall take responsibility for the implementation of this Circular./.
