On promulgation and guidance the use and management of model nationality books and forms of papers on nationality

Pursuant to the Law on Vietnamese Nationality No. 24/2008/QH12 dated November 13, 2008;

Pursuant to the Law on Amending and Supplementing a Number of Articles of the Law on Vietnamese Nationality No. 56/2014/QH13 dated June 24, 2014;

Pursuant to the Decree No. 16/2020/ND-CP dated February 03, 2020 on detailing a number of articles and implementation of the Law on Vietnamese Nationality;

Pursuant to the Decree No. 96/2017/ND-CP dated August 16, 2017 of the Government on defining the function, task, power and organization structure of the Ministry of Justice;

At the request of the Director of the Department of Civil registry, nationality and authentication;

The Minister of Justice hereby promulgates the Circular on promulgation and guidance the use and management of model nationality books and forms of papers on nationality.

Article 1. Scope of regulation

This Circular promulgates and guides the use and management of model of book of handle dossier on nationality-related matters, register book for Vietnamese nationality recognition, book of issuance the certificate of having Vietnamese nationality, book of issuance the certificate of being Vietnamese descent (hereinafter referred to as nationality books) and forms of papers on nationality.

Article 2. User of model nationality books and forms of papers on nationality

1. Vietnam citizen and foreigner with demand on solving nationality related matters;

2. Diplomatic missions, consular offices or other agencies authorized to perform the consular functions of Vietnam in foreign countries, the State Committee on overseas Vietnamese;

3. The Department of Justice in provinces and municipal cities;

4. The People s Committee in provinces and municipal cities;

5. The Ministry of Foreign Affairs

6. The Ministry of Justice

Article 3. To promulgate 04 models of nationality book

Article 4. To promulgate 15 models of nationality papers

Article 5. Printing and use of model nationality books and forms of papers on nationality

1. Model nationality books and forms of papers on nationality prescribed in the Table in Article 3 and of this Circular shall be posted on the website of the Ministry of Justice (at the address: Www.moj.gov.vn), the authorities competent in handling dossier of nationality related matters allowed to access and print out to use.

2. People with demand on nationality related matters (hereinafter referred to as requester) shall access the website of the Ministry of Justice to print out and use forms of Application, Curriculum vitae, Declaration. In case the requester unable to print those papers, the competent authority handles the dossier shall take responsibility to print out the papers and provide freely for the requester.

Article 6. Principle of using the Book of nationality

1. Officer implement nationality work of the Department of Justice, diplomatic officer, consulate officer implement nationality work in the diplomatic missions, consular offices or other agencies authorized to perform the consular functions of Vietnam in foreign countries (hereinafter referred to as officer implement nationality work) must write in the Book of Nationality by themselves. The written content must be accurate; the letters must be clear with sufficient stroke, must not be abbreviated or erased; not to use many colors in a book, not to use red ink.

In case of using technology to print the Book of nationality by printing machine, the printing ink must be the fine one, in black color, printed letter must not be blur, lost strokes or faded.

In case of handling and resolving nationality-related matters according to the single-window mechanism or inter-agency single-window, the officer who receipt the dossier at the office shall write in to the Book of nationality.

2. The book of nationality must be stamped continuously at the beginning of book open. The book must be written continuously in page order and must not be vacated. In case of apply information technology, in annually period, the book must be printed out and stamped continuously from the first page to the last page.

3. Book of handle dossier on nationality-related matters (model TP/QT-2020-STLHSQT) shall be use to record of matters related to register of naturalized, restoration and renunciation of Vietnamese nationality.

Article 7. Principles of using models of nationality papers

1. The officer implement nationality works shall write the sufficient information in to the Notice of receipt and reply of the dossier, the copy of registration for Vietnamese nationality recognition, the certificate of having Vietnamese nationality, the certificate of being Vietnamese descent.

In case of handling and resolving nationality-related matters according to the single-window mechanism or inter-agency single-window, the officer who receipt the dossier at the office shall write in to the Notice of receipt and reply of the dossier.

2. Up on each case, the requester shall have to fully and accurately fill the information in to column and section in the form of Application, Curriculum vitae and Declaration.

3. The requester shall take responsibility for information indicated in the Application, Curriculum vitae and Declaration; in case of deliberately declare untruthful information, up on the violation level shall be imposed sanction in accordance with law provisions.

Article 8. Generate the statistic of handled and solved cases in the year; storage of the Book on nationality

1. In the end of the year, the writer of the book on nationality shall clearly indicate the total number of cases written in the book in one year; in case of using more than one book for a year, the total number of books and cases written in the books must be clearly indicated; sign and full name and report to the head of the agency to sign for conform and seal.

2. The book on nationality shall be stored for eternity and be preserved in accordance with law provisions on archives.

Article 9. Effect

This Circular takes effect on May 24, 2020 and replace the Circular No.  08/2010/TT-BTP dated March 25, 2010 of the Ministry of Justice on guiding of forms of papers on nationality and model of nationality books.
