Circular No. 01/2018/TT-BGTVT dated January 03, 2018 of the Ministry of Transport on publishing of seaport waters in Quang Ninh province and area under management of the maritime administration of Quang Ninh
Pursuant to the Vietnam Maritime Code No. 95/2015/QH13 dated November 25, 2015;
Pursuant to the Government’s Decree No. 12/2017/ND-CP dated February 10, 2017 on functions, tasks, power and organizational structure of the Ministry of Transport;
Pursuant to the Government’s Decree No. 58/2017/ND-CP dated May 10, 2017 specifying certain articles of the Vietnam Maritime Code on maritime operations management;
Pursuant to opinions of the People’s Committee of Quang Ninh province stated in the official dispatch No. 6557/UBND-XD2 dated August 31, 2017 and the People’s Committee of Hai Phong province stated in the official dispatch No. 5313/UBND-GT3 dated August 24, 2017;
At the request of the Director of Department of Legal Affairs and the Director of the Vietnam Maritime Administration;
The Minister of Transport promulgates a Circular on publishing of seaport waters in Quang Ninh province and area under management of the Maritime Administration of Quang Ninh.
Article 1. Publishing of seaport waters and marine areas in Quang Ninh province
Quang Ninh seaport waters in Quang Ninh province includes the following waters:
1. Quang Ninh seaport waters in Van Gia – Hai Ha area.
2. Quang Ninh seaport waters in Mui Chua area.
3. Quang Ninh seaport waters in Co To area.
4. Quang Ninh seaport waters in Cam Pha – Cua Doi area.
5. Quang Ninh seaport waters in Hon Gai area.
6. Quang Ninh seaport waters in Quang Yen area.
Article 2. Seaport waters in Quang Ninh province
Quang Ninh seaport waters in Quang Ninh province shall be identified by the highest tides.
1. Quang Ninh seaport waters in Van Gia – Hai Ha area shall be determined as follows:
a) Point VH1 (21o24 40.0’’N, 108o01 10.0’’E) connected by straight lines to points VH2 through VH4 with the following coordinates:
VH2: 21o22 20.0’’N, 108o01 10.0’’E;
VH3: 21o22 20.0’’N, 108o00 13.3’’E;
VH4: 21o23 51.0’’N, 108o00 13.3’’E.
b) Point VH4 running along the Northern shore of Vinh Thuc island to point VH5 (21o21 55.2”N, 107o49 31.6”E), point VH5 continuously connected by straight lines to points VH6 through VH13 with the following coordinates:
VH6: 21o20 27.4”N, 107o50 34.0’’E;
VH7: 21o14 10.5”N, 107o56 46.0’’E;

MC2: 21o17 12.6”N, 107o27 08.6”E;
MC3: 21o17 04.9”N, 107o27 18.6”E;
MC4: 21o16 47.6”N, 107o27 04.2”E;

b) Point MC5 running along the bank of Tien Yen river and the edge of Mui Chua wharf to point MC1.
3. Quang Ninh seaport waters in Co To area shall be determined as follows:
a) Point CT1 (20o58 14.3’’N, 107o45 40.8”E) running along the Western shore of Co To island to point CT2 (20o57 59.8”N, 107o45 34.7”E), point CT2 continuously connected by straight lines to points CT3 through CT4 with the following coordinates:
CT3: 20o58 06.6”N, 107o45 11.2”E;
CT4: 20o58 21.6”N, 107o45 17.2”E.
b) Point CT4 connected to point CT1 by a straight line.
4. Quang Ninh seaport waters in Cam Pha – Cua Doi area shall be determined as follows:
a) In Cam Pha area:
Point CP1 (21o02 04.5”N, 107o22 16.5”E) connected by straight lines to points CP2 through CP5 with the following coordinates:

Point CD2 running along the Western shore of Cao Lo island to point CD3 (20o58 16.6”N, 107o33 41.5”E), point CD3 continuously connected by straight lines to points CD4 thorough CD5 with the following coordinates:
CD4: 20o58 09.1”N, 107o33 25.8”E;
CD5: 20o59 05.1”N, 107o32 54.2”E.
Point CD5 to point CD1 connected together by a straight line.
5. Quang Ninh seaport waters in Hon Gai area shall be determined as follows:
a) Point HG1 (20o57 36.3’’N, 107o03 55.6"E) running along the Southwest shore of Hon Gai ward to point HG2 (20o56 46.1”N, 107o04 28.6”E).
b) Point HG2 connected by straight lines to points HG3 through HG22 with the following coordinates:
HG3: 20o56 18.1”N, 107o04 26.6”E;
HG4: 20o52 23.3’’N, 107o06 29.5”E;
HG5: 20o51 40.3’’N, 107o07 42.4”E;
HG6: 20o50 32.3’’N, 107o09 02.6”E;

HG25: 21o00 05.6”N, 107o02 56.2”E;
HG26: 20o59 31.6”N, 107o04 52.2”E;
HG27: 20o58 44.6”N, 107o04 17.2”E;

dd) Point HG28 connected to point HG1 by a straight line.
6. Quang Ninh seaport waters in Quang Yen area shall be determined as follows:
a) Point QY1 (20o50 07.8”N, 106o52 59.2”E) connected by straight lines to points QY2 through QY3 with the following coordinates:
QY2: 20o50 11.0’’N, 106o52 21.0’’E;
QY3: 20o50 06.0’’N, 106o52 04.6”E.
b) Point QY3 running along the left bank of Chanh river (from the sea) to point QY4 (20o54 33.6”N, 106o50 00.7”E), connected to point QY5 (20o54 45.6”N, 106o50 13.2”E).
c) Point QY5 running along the right bank of Chanh river (from the sea) to point QY6 (20o52 22.1”N, 106o51 31.7”E), connected to point QY7 (20o51 26.8”N, 107o52 37.7”E).
d) Point QY7 running along the Western shore of Cong island to point QY8 (20o50 50.2”N, 106o52 59.2”E), continuously connected to point QY1.
7. Waters boundaries of the Quang Ninh seaport in Quang Ninh province mentioned herein shall be determined on nautical charts issued by the Maritime Safety Assurance – North in 2015, including: Nautical charts No. VN30001, VN40001, VN40002, VN50003, VN50004, VN50005, VN50006, VN50007, VN50008, VN50047 and nautical charts issued by the Vietnam People s Navy, including: Nautical charts No. IA-25-15 published in 2010 and No. IA-25-10 issued in 1985. Coordinates of the points mentioned in Clauses 1, 2, 3, 4, 5 and 6 this Article and Clause 2 Article 3 herein shall be applied to the coordinate system of VN-2000 and converted into the WGS - 84 provided in the Appendix attached hereto.
Article 3. Areas for pilot embarkation and disembarkation, quarantine areas, anchorage, transshipment areas, storm shelters and water areas and other relevant waters
1. The Director of the Vietnam Maritime Administration shall publish areas of pilot embarkation and disembarkation, quarantine areas, storm shelters, anchorage, transshipment areas where vessels enter/leave the Quang Ninh seaport, water areas and other relevant waters.
2. Depending on actual conditions, vessels shall enter or leave the Hai Phong seaport but shall anchor to seek shelters from a storm, transship or reduce part of cargoes before anchoring to wharves of the Hai Phong seaport or transship to receive additional cargoes after receiving part of cargoes at wharves of the Hai Phong seaport in waters of Quang Ninh seaport and allocated in any of the following positions by the Maritime Administration of Quang Ninh:
a) Vessels seeking shelters from the storm shall be allocated in positions with the following coordinates:
HG1-1: 20o56 14.5”N, 107o04 10.7”E;
HG2-1: 20o56 20.5”N, 107o04 04.7”E;
HG3-1: 20o56 32.5”N, 107o04 04.7”E.
b) Vessels transporting cargoes that cause no contamination or toxic shall be allocated to transship in positions with the following coordinates:
HL3-1: 20o50 28.1”N, 107o07 55.2”E;
HL3-5: 20o51 51.6”N, 107o06 41.7”E;
HL3-6: 20o51 59.1”N, 107o06 15.9”E.
Vessels shall not be allowed to handle or transship bulk cargoes, such as: cement, clinker, woodchips or limestone with a size of not exceeding 4x6 cm at the points HL3-1, HL3-5 and HL3-6 mentioned above.
c) Vessels transporting cargoes that cause contamination or toxic shall be allocated to transship at the position of HN2-13 (20o56 04.3’’N, 107o16 41.4”E).
Allocation of vessels entering/leaving the Hai Phong seaport but required to mooring for transshipment specified in this Clause shall terminate when the Lach Huyen wharf of the Hai Phong seaport is announced to come into operation by a competent authority.
Article 4. Responsibilities of the Maritime Administration of Quang Ninh and relevant parties
1. Responsibilities of the Maritime Administration of Quang Ninh:
a) Perform duties and power in accordance with provisions of the Vietnam Maritime Code and relevant legal documents for maritime operations at wharves and seaport waters in Quang Ninh province and maritime operations related to planning, establishment or investment in construction of wharves in Yen Hung wharf (Chanh river, Bach Dang river, Nha Mac pond) in Quang Ninh province;
b) Appoint specific positions for vessels embarking or disembarking pilot, following quarantine, seeking shelters from storms, anchoring or transshipping in waters under regulations, ensuring marine security and environmental safety;
c) Appoint specific positions for vessels seeking shelters from storms, transship for vessels entering/leaving the Hai Phong seaport that have to seek for shelters or transship in the Quang Ninh seaport at the positions stated in Points a and b Clause 2 Article 3 herein and promptly report to the Maritime Administration of Hai Phong.
d) Provide the Maritime Administration of Hai Phong with names, nationalities, primary specifications and other necessary information of vessels that must announce or confirm arrival of vessels at the port within 4 hours before vessels arrive at positions of pilot embarkation and disembarkation of the Hai Phong seaport to enter waters of the Quang Ninh seaport in Quang Yen area;
dd) Provide the Maritime Administration of Hai Phong with names, nationalities, primary specifications and other necessary information of vessels that must announce departure of vessels from the port within 2 hours before vessels enter waters boundaries of the Hai Phong seaport when leaving waters of the Quang Ninh seaport in Quang Yen area.
e) Carry out state management of marine security and prevention of environmental pollution in the territorial waters of Quang Ninh province, apart from the scopes of waters mentioned in Article 2 herein.
2. Responsibilities of the Maritime Administration of Hai Phong:
a) Request the Maritime Administration of Quang Ninh to appoint specific positions for vessels to seek shelters from storms or transship at positions stated in Clause 2 Article 3 herein if required;
b) Provide the Maritime Administration of Quang Ninh with names, nationalities, primary specifications and other necessary information of vessels, types of cargoes, quantity of cargoes that need to be handled at the anchorage or transshipment areas of the Quang Ninh seaport within 4 hours before vessels enter waters boundaries of the Quang Ninh seaport;
c) Inform the Maritime Administration of Quang Ninh of maneuvering of vessels leaving for storm-sheltering or transshipment appointed by the Maritime Administration of Quang Ninh within 2 hours before leaving;
d) Follow procedures for entering and leaving the Hai Phong seaport provided that vessels are able to seek shelters from storms or transship in waters of the Quang Ninh seaport at the positions stated in Points a and b Clause 2 Article 3 herein;
dd) Cooperate with the Maritime Administration of Quang Ninh to maneuver vessels to enter or leave waters of the Quang Ninh seaport in Quang Yen area, ensuring marine security and prevention of environmental pollution.
3. Responsibilities of the Vietnam Inland Waterway Administration and the Department of Transport of Quang Ninh province:
a) Manage, maintain, ensure security and prevent environmental pollution on inland waterways routes in waters of Quang Ninh seaport.
b) Carry out state and transport management in port or inland waterways wharves under their management in waters of Quang Ninh seaport.
Article 5. Effect
1. This Circular takes effect on March 01, 2018.
2. The Circular No. 35/2014/TT-BGTVT dated August 19, 2014 by the Minister of Transport on publishing of seaport waters in Quang Ninh province and areas under management of the Maritime Administration of Quang Ninh shall be superseded by this Circular.

Chief of secretariat and chief of inspectorate of the Ministry of Transport, Directors, Director of the Vietnam Maritime Administration, Director of the Vietnam Inland Waterway Administration, Director of the Department of Transport of Quang Ninh province, Director of Department of Transport of Hai Phong province, Director of the Maritime Administration of Quang Ninh, Director of the Maritime Administration of Hai Phong, heads of authorities, organizations and individuals relevant shall implement this Circular.
