CIRCULAR
GUIDING THE PRIME MINISTER’S DECISION No. 242/1999/QD-TTg OF DECEMBER 30, 1999 ON IMPORT-EXPORT MANAGEMENT IN 2000
In furtherance of the Prime Minister’s Decision No. 242/1999/QD-TTg of December 30, 1999 on import-export management in 2000; After consulting and reaching agreement with the Ministry of Trade in Official Dispatch No. 1131/TM-XNK of March 20, 2000, the General Department of Post and Telecommunications hereby guides the implementation of Article 9 on import and export of goods on the list of items subject to post and telecommunications specialized management as follows:
I. GENERAL PROVISIONS ON THE MANAGEMENT OF IMPORT-EXPORT POST AND TELECOMMUNICATIONS GOODS, EQUIPMENT AND SUPPLIES
1. Post and telecommunications goods, equipment and supplies on the list subject to post and telecommunications specialized management include those used exclusively on the public and special-use post and telecommunications networks.
2. Import goods, equipment and supplies on the list subject to post and telecommunications specialized management stipulated in this Circular must fully satisfy the conditions, technical standards and usage properties already defined and promulgated by the General Department of Post and Telecommunications.
3. The General Department of Post and Telecommunications shall neither grant permits nor ratify import/export goods items, quantities and value.
4. Import goods, equipment and supplies on the list subject to post and telecommunications specialized management must be those in service of post and telecommunications operations and services, which are permitted to be used, exploited and supplied in Vietnam.
5. Import goods, equipment and supplies on the list subject to post and telecommunications specialized management must ensure:
- The compatibility with Vietnamese technologies, post and telecommunications networks as well as the technical norms and standards promulgated or permitted for application by the State and/or the General Department of Post and Telecommunications;
- The State of the Socialist Republic of Vietnam’ regulations on social order, safety, security and national defense;
- The State’ and General Department of Post and Telecommunications’regulations on conditions for import, export and trading of post and telecommunications goods;
- The users’interests.
II. LIST AND STANDARDS OF IMPORT GOODS, EQUIPMENT AND SUPPLIES SUBJECT TO POST AND TELECOMMUNICATIONS SPECIALIZED MANAGEMENT

Notes:
- ITU: International Telecommunication Union
- TCN 68 means the post and telecommunications standards, for example: TCN 68-134: 1994 is the technical standard for automatic telephones (fixed) promulgated by the General Department of Post and Telecommunications in 1994.
In addition to the above-listed goods, units and enterprises that have registered their business with suitable business lines and import/export enterprise codes may import goods according to their demands.
The export of goods items on the list subject to post and telecommunications specialized management at the foreign partners’ requests as agreed upon under conditions in the import contracts shall not have to satisfy all conditions, technical standards and usage properties defined and promulgated by the General Department of Post and Telecommunications.
II.2. Postage stamps:

- Prepaid envelopes
- Philately first-day cover (FDC)
- Prepaid postcards

3. Stamp articles: Documents illustrated with postage stamps, objects using postage stamps.
III. IMPORT-EXPORT CONDITIONS
III.1. Post and telecommunications goods, equipment and supplies
- Before an importation, a standard compatibility certificate issued by the General Department of Post and Telecommunications according to the standards mentioned in Section II.1 is required. The procedures for standard compatibility certificate issuance shall comply with the General Department of Post and Telecommunications’ regulations.
- For import goods being radio transmitters, receiver-transmitters, radar, radio support equipment and radio remote control equipment, their frequencies or frequency channels must be approved by the General Department of Post and Telecommunications in strict compliance with the frequency planning under the Prime Minister’s Decision No.85/1998/QD-TTg of April 16, 1998 ratifying the plan on radio frequency allocation for professional operations in Vietnam and they must have technical properties compatible with the ITU standards as well as the General Department of Post and Telecommunications’ approval reflected in the standard compatibility certificate.
- For the import of post and telecommunications goods, equipment and/or supplies into Vietnam for display and/or demonstration, accompanying foreign delegations on visits to Vietnam at the official invitations of Vietnamese agencies or organizations, the standard compatibility certificate is not required, but there must be approval of the General Department of Post and Telecommunications or the competent State bodies.
III.2. Postage stamps
1. Postage stamps used for postal service business, philatelic stamps being the live ones (without cancellation seal):
- Only units and enterprises licensed to trade in postal services may import and/or export such stamps
- Before the importation or exportation, a written consent of the General Department of Post and Telecommunications is required.
2. For philatelic stamps (with cancellation seal), except for the live ones stipulated at Point 1 of this Section, the licensed business units and enterprises may import them according to their demands.
3. Postage stamps and stamp articles banned from import and export:
- Postage stamp articles which have been suspended from issuance or withdrawn by order of the General Department of Post and Telecommunications
- Postage stamp articles banned from circulation by the General Department of Post and Telecommunications
- Postage stamp articles with unhealthy contents that incite or cause hostility between nationalities, contrarily to the Vietnamese customs and laws.
- Postage stamp articles already warned of by the Universal Postal Union (UPU), the International Philatelic Federation (FIP) or the Asian Philatelic Federation (FIAP) and banned from participation in international stamp exhibitions.
The General Department of Post and Telecommunications shall promptly issue documents related to the contents of this Section.
IV. IMPLEMENTATION PROVISION
This Circular takes effect as from April 1st, 2000; in the course of implementation, if any problems arise, the relevant State management agencies as well as the post and telecommunications goods importers/exporters should promptly report them to the General Department of Post and Telecommunications for consideration and settlement.
