DECISION

Stipulating the structure of the electricity retail tariff

 

Pursuant to the Law on Organization of the Government dated February 18, 2025;

Pursuant to the Electricity Law dated November 30, 2024;

At the proposal of the Minister of Industry and Trade;

The Prime Minister promulgates the Decision stipulating the structure of the electricity retail tariff.

 

Article 1. Scope of regulation and subjects of application

1. This Decision regulates the structure of the electricity retail tariff; suitable electricity price mechanism for electricity consumers groups; support mechanism for electricity bills for residential use for poor households and social policy households; electricity prices in rural, mountainous, border, and island areas not connected to the national grid as prescribed at Point a, Clause 13, Article 5; Point b and Point c, Clause 3, Article 50 of the 2024 Electricity Law.

2. This Decision applies to:

a) Vietnam Electricity (EVN);

b) Power Corporations under Vietnam Electricity;

c) Electricity retail units purchasing electricity from Power Corporations under Vietnam Electricity;

d) Electricity retail units operating in rural, mountainous, border, and island areas not yet connected to the national power grid;

dd) Agencies, organizations, and individuals using electricity.

Article 2. The structure of the electricity retail tariff

1. The structure of the electricity retail tariff is a table of percentages (%) of the average electricity retail price to calculate specific electricity retail prices for each group of electricity consumers.

2. The percentage (%) of the electricity retail price for each electricity consumer group compared to the average electricity retail price is adjusted according to the authority as prescribed in the mechanism for adjusting the average electricity retail price, specified in detail in the Appendix issued with this Decision. 

3. In the event of a change in the electricity consumption structure, based on the average electricity retail price adjusted under competence, electricity retail prices for customer groups may be adjusted within a margin of ±2% by the percentage specified in the Appendix issued with this Decision.

4. The electricity retail prices for customer groups are determined based on the average electricity retail price adjusted under competence and the structure of the electricity retail tariff prescribed in Clause 2 and Clause 3 of this Article.

Article 3. Electricity retail prices

1. Electricity retail prices are specified in detail for each group of electricity consumers encompassing production, business, administration and non-business, and residence.

2. Electricity retail prices according to voltage levels: high voltage is the nominal voltage level above 35kV (including voltage levels above 35kV to below 220kV and voltage level 220kV), medium voltage is the nominal voltage level above 01kV to 35kV, low voltage is the nominal voltage level up to 01kV applied to groups of electricity consumers for production, business, administrative and non-business purposes.

3. Electricity retail prices based on time-of-use for production and business purposes at various voltage levels shall apply to electricity consumers meeting the prescribed eligibility conditions.

4. The electricity retail price for the residential electricity consumers group includes 5 levels with increasing prices to encourage economical and efficient use of electricity.

5. Applying the electricity price for areas connected to the national grid for electricity consumers in rural, mountainous, border, and island areas not yet connected to the national grid.

The cost difference incurred by the electricity unit due to the application of a uniform nationwide electricity retail price lower than the cost of electricity generation and business operations shall be included in the nationwide average electricity price applicable to areas where electricity is sold by Vietnam Electricity; for areas not served by EVN, the cost difference is handled by regulations issued by the Prime Minister.

6. For the retail electricity price consists of multiple components applicable to consumer groups, in case where the technical conditions permit, the regulations of the Prime Minister shall be complied with.

Article 4. Electricity bill support

1. Poor households, as defined by relevant law regulations at each period, are provided with electricity bill support for residential purposes, with a monthly support amount equivalent to the electricity used for 30 kWh calculated at the current level-1 residential electricity retail price.

2. Social policy households according to the criteria prescribed by the Prime Minister (other than poor households eligible for electricity bill support according to Clause 1 of this Article) and whose monthly electricity consumption does not surpass 50 kWh shall be entitled to an electricity bill support equivalent to the electricity consumption of 30 kWh calculated according to the current level-1 residential electricity retail price.

3. Electricity bills support funding for poor households, and social policy households are allocated from the state budget and other legal financial sources as prescribed by laws. The central budget provides support to localities for electricity bill supports based on the principle of targeted support from the central budget to local budgets for the implementation of social welfare policies, as decided by competent authorities from time to time.

Article 5. Organization of implementation

1. The Ministry of Industry and Trade shall prescribe and guide the implementation of electricity retail prices for groups of electricity consumers; and electricity prices for electricity retailers. The Minister of Industry and Trade shall issue an official written decision on the peak hours, off-peak hours, and normal hours on the electricity usage situation of the power system in each period.

2. The Ministry of Health shall take the prime responsibility for and coordinate with the Ministry of Finance, the Ministry of Industry and Trade and other relevant agencies to formulate criteria for social policy households eligible for support as prescribed in Clause 2, Article 4 of this Decision.

3. The Ministry of Finance shall allocate state budget funds to implement electricity bill support in accordance with the law on the state budget and other relevant laws.

4. The Ministry of Culture, Sports and Tourism shall provide guidance on the certification of tourist accommodation establishments as a basis for applying electricity retail prices in accordance with this Decision, within 30 days from the effective date of this Decision.

5. The People’s Committees of provinces and centrally-run cities shall:

a) Organize the implementation of electricity bill support for poor households and social policy households;

b) Direct relevant agencies and units to implement the electricity bill support policy for poor households and social policy households in accordance with regulations;

c) Inspect and supervise the implementation of the electricity bill support policy for poor households and social policy households within their respective localities.

Article 6. Transitional provisions

The Prime Minister’s Decision No. 28/2014/QD-TTg dated April 7, 2014, on structure of electricity retail tariff, shall remain in effect from the effective date of this Decision until the date of the nearest adjustment of the average electricity retail price following the effective date of this Decision.

Article 7. Effect

1. This Decision takes effect from the date of signing and issuance, and replaces the Prime Minister’s Decision No. 28/2014/QD-TTg dated April 7, 2014, on structure of electricity retail tariff, and is applied from the date of the nearest adjustment of the average electricity retail price following the effective date of this Decision.

2. Ministers, heads of ministerial-level agencies, heads of agencies under the Government, chairpersons of People's Committees of provinces and centrally-run cities, Vietnam Electricity and relevant agencies, organizations, and individuals shall implement this Decision.
