DECREE
Detailing a number of articles of, and providing measures to implement,
the Law on Vietnam Coast Guard
Pursuant to the Law on Organization of the Government dated June 19, 2015;
Pursuant to the Law on Vietnam Coast Guard dated November 19, 2018;
At the request of the Minister of National Defence;
The Government promulgates the Decree detailing a number of articles of, and providing measures to implement, the Law on Vietnam Coast Guard.
Chapter I
GENERAL PROVISIONS
Article 1. Scope of regulation
This Decree prescribes the organization; uniforms; banners, colors and signs for identification of vessels, canoes, aircraft; regimes and policies of the Vietnam Coast Guard; and responsibilities of ministers, heads of ministerial-level agencies and chairpersons of provincial-level People's Committees in operational coordination with the Vietnam Coast Guard.
Article 2. Subjects of application
This Decree applies to agencies, units, officers and soldiers of the Vietnam Coast Guard, and relevant agencies, organizations, and individuals.
Article 3. Execution of working measures of the Vietnam Coast Guard
When performing their tasks, agencies, units, officers, soldiers of the Vietnam Coast Guard may execute working measures in accordance with Article 12 of the Law on Vietnam Coast Guard and other related legal documents, and shall be responsible before law, their superiors and the Vietnam Coast Guard Commander for their operations.
Article 4. Legal titles of the Vietnam Coast Guard
1. Police officers, recon operators, and investigation officers are the legal titles of the Vietnam Coast Guard, tasked with preventing, deterring, detecting, and fighting against crimes and violations of law.
2. The titles of Vietnam Coast Guard police officers and recon operators include:
a) Junior police officers and recon operators;
b) Intermediate officers and recon operators;
c) Senior officers and recon operators;
3. The Minister of National Defence shall prescribe the conditions, criteria, order and procedures for appointment, relief from duty, dismissal, and forms of certifications of Vietnam Coast Guard police officers and recon operators.
4. The Vietnam Coast Guard Commander shall decide on the appointment, relief from duty, dismissal of the titles of police officers and recon operators; grant, revoke, and prescribe the management and use of certifications of Vietnam Coast Guard police officers and recon operators.
5. Investigation officers of the Vietnam Coast Guard, when mandated to investigate criminal cases in accordance with the Criminal Procedure Code and the Law on Organization of Criminal Investigation Bodies, must be responsible before law and their assigning superiors for the execution of their tasks and powers.
Article 5. Regime and policies for Vietnam Coast Guard officers and soldiers
Vietnam Coast Guard officers and soldiers may receive salaries based on ranks, grades, positions, and allowance regimes; and enjoy extra-salary bracket seniority allowances, pluralism allowances, regional allowances, special allowances, inducement allowances, mobility allowances, hazardous and toxic allowances, occupation-based seniority allowances, occupation-based responsibility allowances, job-based responsibility allowances, allowances for service in national defense and security, allowances for long-term work on vessels, seas or islands, seafaring allowances, and seafaring-specific allowances suitable to the sea or island working areas and in accordance with task requirements and other regimes and policies as those applicable to officers and soldiers of the armed forces as well as cadres, civil servants and public employees who work in the same conditions, working environment, geographical area, sea and island in accordance with the law provisions.
Article 6. Funding for the Vietnam Coast Guard
1. The High Command of the Vietnam Coast Guard has an account opened at the State Treasury; funding for the operations of the Vietnam Coast Guard shall be allocated by the state budget and earmarked as a separate item within the total budget of the Ministry of National Defence.
2. On an annual basis, the Ministry of National Defence shall coordinate with the Ministry of Planning and Investment and the Ministry of Finance in preparing the budget estimates to ensure funding for the operations of the Vietnam Coast Guard.
Chapter II
ORGANIZATION OF THE VIETNAM COAST GUARD
Article 7. Organizational system of the Vietnam Coast Guard
The organizational system of the Vietnam Coast Guard consists of:
1. The High Command of the Vietnam Coast Guard.
2. Units under the High Command of the Vietnam Coast Guard:
a) Coast Guard Region 1 Command; Coast Guard Region 2 Command; Coast Guard Region 3 Command; Coast Guard Region 4 Command;
b) Anti-Drug Special Task Unit No. 1; Anti-Drug Special Task Unit No. 2; Anti-Drug Special Task Unit No. 3; Anti-Drug Special Task Unit No. 4;
c) Reconnaissance Unit No. 1; Reconnaissance Unit No. 2;
d) Center for Professional Skill Training and Fostering of the Vietnam Coast Guard.
3. Focal and grassroots agencies and units under the units specified in Clause 2 of this Article.
Article 8. Agencies under the High Command of the Vietnam Coast Guard
Agencies under the High Command of the Vietnam Coast Guard consist of the General Staff, the Political Department, the Operations and Legal Department, the Logistics Department, the Technical Department, and other agencies directly under the Vietnam Coast Guard Command.
Article 9. Scope of operation and management areas
1. The Coast Guard Region 1 Command shall manage the maritime zone from the Bac Luan estuary of Quang Ninh province to Con Co island of Quang Tri province; The Coast Guard Region 2 Command shall manage the maritime zone from Con Co island of Quang Tri province to Cu Lao Xanh (Xanh islet) of Binh Dinh province; The Coast Guard Region 3 Command shall manage the maritime zone from Cu Lao Xanh (Xanh islet) of Binh Dinh province to the North bank of Dinh An estuary of Tra Vinh province; The Coast Guard Region 4 Command shall manage the maritime zone from the North bank of Dinh An estuary of Tra Vinh province to Ha Tien of Kien Giang province.
2. The scope of operation and management areas of the units specified at Points b, c, and d Clause 2, and Clause 3 of Article 7 hereof shall be determined by the Vietnam Coast Guard Commander.
Article 10. Competence to establish, reorganize, split, merge, rename, and dissolve agencies and units under the Vietnam Coast Guard
1. The establishment, reorganization, splitting, merging, renaming, and dissolution of the High Command of the Vietnam Coast Guard shall be decided by the competent authority.
2. The establishment, reorganization, splitting, merging, renaming, and dissolution of units specified at Point a Clause 2 Article 7 hereof shall be decided by the Prime Minister upon the proposal of the Minister of National Defence.
3. The establishment, reorganization, splitting, merging, renaming, and dissolution of other agencies and units of the Vietnam Coast Guard shall be decided by the Minister of National Defence.
4. The Commander, Political Commissar, Deputy Political Commissar, and Vice-Commanders of the Vietnam Coast Guard shall be appointed by the Prime Minister upon the proposals of the Minister of National Defence and the Minister of Home Affairs.
Chapter III
UNIFORMS OF THE VIETNAM COAST GUARD
Section 1. INSIGNIA, RANK BADGES, AND EMBLEMS OF THE VIETNAM COAST GUARD
Article 11. Insignia
1. The insignia of the Vietnam Coast Guard is round in shape, featuring a raised five-pointed yellow star in the center on a bright red background, surrounded by two yellow rice stalks on a blue background. Below the rice stalks is a half cogwheel in yellow, the outer edge of the insignia is yellow, and there are yellow pine branches on both sides of the insignia.
2. The insignia comes in four different diameters: 41 mm, 36 mm, 33 mm, and 28 mm, embossed with double yellow pine branches. At the bottom center of the double pine branch bow, there are red letters "CSB". For the 33 mm diameter insignia, the red letters "CSB" are placed on the half cogwheel in yellow.
Article 12. Rank badge
The rank badge of the Vietnam Coast Guard symbolizes the rank of officers, career servicemen, cadets, and non-commissioned officers - enlisted personnel of the Vietnam Coast Guard worn on the shoulder straps. The basic structure of the rank badge includes background, border, badge button, stars, and stripes (for officers and career servicemen), lines (for non-commissioned officers - enlisted personnel).
1. The rank badge for officers of the Vietnam Coast Guard
a) Shape: Two short leading sides and two long vertical sides;
b) The rank badge background is blue; the rank badge background of general officers has embossed bronze drum patterns, with the center of the drum at the position of the badge button;
c) The border color is yellow;
d) On the background, there are badge buttons, stripes, and stars in yellow. Badge buttons are round, embossed with patterns (national emblem for general officers; two rice stalks surrounding a yellow five-pointed star, for senior and junior officers). The rank badges have no horizontal stripes for general officers, two horizontal stripes for senior officers, and one horizontal stripe for junior officers. The star quantity is as follows:
Second Lieutenant, Major, Major General: 1 star;
Lieutenant, Lieutenant Colonel, Lieutenant General: 2 stars;
First Lieutenant, Colonel: 03 stars;
Captain, Brigadier: 04 stars.
2. The rank badge for career servicemen of the Vietnam Coast Guard
Adhering to the provisions in Clause 1 of this Article, but the rank badge background has a pink line 5 mm wide in the center running vertically.
3. The rank badge for non-commissioned officers - enlisted personnel of the Vietnam Coast Guard
a) Shape: Two short leading sides and two long vertical sides;
b) The rank badge background is blue;
c) The border color is yellow;
d) On the background, there are badge buttons, horizontal lines, or V-shaped lines in yellow. Badge buttons are embossed with patterns of two rice stalks surrounding a yellow five-pointed star. The quantity of horizontal lines or V-shaped lines are as follows:
Private: 1 V-shaped line;
First class private: 2 V-shaped lines;
Corporal: 1 horizontal line;
Sergeant: 2 horizontal lines;
Staff Sergeant: 3 horizontal lines.
4. The rank badge for cadets engaged in training courses of officers, non-commissioned officers, and technical specialists of the Vietnam Coast Guard
a) Shape: Two short leading sides and two long vertical sides;
b) The rank badge background is blue;
c) The border color is yellow. The border is 5 mm wide for cadets engaged in training courses of officers, and 3 mm wide for cadets engaged in training courses of non-commissioned officers and technical specialists;
d) On the background, there are badge buttons. Badge buttons are embossed with patterns of two rice stalks surrounding a yellow five-pointed star.
Article 13. Emblem
1. Background and shape of the emblem to be worn on the collar:
a) The emblem background is a blue parallelogram, featuring the yellow emblem of the Vietnam Coast Guard; the emblem background for general officers has yellow borders that are 5 mm wide on three sides.
b) The Vietnam Coast Guard emblem is yellow and shield-shaped, with two crossed swords behind the shield, containing an anchor inside, yellow rice stalks below, and a yellow five-pointed star above.
2. Yellow pine branches on the collar of formal uniforms and both sides of insignia
a) Single pine branches for general officers;
b) Single pine branches for senior and junior officers.
Article 14. Symbol
The symbol of the Vietnam Coast Guard is worn on the chest. It features a wave-shaped design, with a shield in the center on a blue background and yellow border. Behind the shield is two crossed swords and within the shield is a yellow anchor. On both sides, there are blue violet waves patterns.
Article 15. Nameplate
The nameplate of the Vietnam Coast Guard is worn on the chest. It is rectangular, measuring 2x8 cm, with a dark blue background and yellow border. The upper right corner has an image of the red flag with a yellow star. In the center of the nameplate, the name is imprinted in white.
Article 16. Logo
The logo of the Vietnam Coast Guard is shield-shaped, with a dark blue background, red outer border, and yellow inner border. In the center, there is a smaller shield with a red border, behind the shield is two crossed swords and within the shield is a yellow anchor. Below the emblem is yellow rice stalks, above the emblem is a yellow five-pointed star, with the inscription "CẢNH SÁT BIỂN VIỆT NAM" (VIETNAM COAST GUARD) immediately below, followed by the inscription "VIETNAM COAST GUARD". Below the rice stalks are a half cogwheel in yellow.
Article 17. Emblem combined with rank badge
The emblem combined with the rank badge of the Vietnam Coast Guard worn on the collar of combat uniforms consists of: Emblem background, emblem image, stars, stripes (for officers, career servicemen and cadets) or lines (for non-commissioned officers). The emblem has no stripes for general officers and no lines for enlisted personnel.
1. For general officers: The emblem background is a blue parallelogram with a 5 mm wide yellow border on three sides, attached with the emblem image, a five-pointed yellow star. The quantity of stars is as follows:
Major General: 01 star;
Lieutenant General: 02 stars.
2. For officers: The emblem background is a blue parallelogram, attached with the emblem image, a five-pointed star, vertical yellow stripes. The quantity of stars is as specified for officers' badges at Point d Clause 1 Article 12 hereof; The quantity of bars: two vertical stripes for senior officers and one vertical stripe for junior officers.
3. Career servicemen: The emblem combined with the rank badge of career servicemen is the same as the emblem combined with the rank badge of officers as specified in Clause 2 of this Article.
4. Non-commissioned officers and enlisted personnel
a) Non-commissioned officers: The emblem background is a blue parallelogram, attached with the emblem image, a five-pointed yellow star and a 3 mm wide bright yellow silk vertical line. The quantity of stars is as follows:
Corporal: 01 star;
Sergeant: 02 stars;
Staff Sergeant: 03 stars.
b) Enlisted personnel: The emblem background is a blue parallelogram, attached with the emblem image and a five-pointed yellow star. The quantity of stars is as follows:
Private: 01 star;
First class private: 02 stars.
5. Cadets
a) Cadets being officers: The emblem combined with the rank badge of cadets being officers is the same as the emblem combined with the rank badge of officers specified in Clause 2 of this Article;
b) Cadets engaged in training courses of officers: The emblem background is a blue parallelogram, attached with the emblem image, with a 5 mm wide bright yellow silk vertical stripe. The emblem has no stars;
c) Cadets engaged in training courses of non-commissioned officers or technical specialists: The emblem background is a blue parallelogram, attached with the emblem image, with a 3 mm wide bright yellow silk vertical stripe. The emblem has no stars;
Section 2. UNIFORMS AND FORMAL UNIFORMS OF THE VIETNAM COAST GUARD
Article 18. Uniforms and formal uniforms
1. Uniforms of the Vietnam Coast Guard include:
a) Casual uniforms;
b) Combat uniforms;
c) Operational uniforms;
d) On-duty uniforms.
2. Formal uniforms of the Vietnam Coast Guard include:
a) Winter formal uniforms;
b) Summer formal uniforms;
c) Uniforms for defense workers and employees;
d) Uniforms for honor guards and ceremonial guards.
Article 19. Casual uniforms, combat uniforms, operational uniforms, on-duty uniforms; anti-cold caps and jackets of the Vietnam Coast Guard
1. Casual uniforms for officers, career servicemen, cadets being officers, female non-commissioned officers - enlisted personnel, defense workers and employees include both winter and summer casual uniforms:
a) Winter casual uniforms include cap, trousers, coat, shirt, tie, belt, shoes, socks;
b) Summer casual uniforms include cap, trousers, shirt, belt, shoes, socks.
2. Casual uniforms for male non-commissioned officers - enlisted personnel; male cadets who are not yet officers and career servicemen; male cadets engaged in training courses of non-commissioned officers and technical specialists: Use a common uniform for both winter and summer, including cap, trousers, shirt, belt, shoes, socks.
3. Combat uniforms for officers, career servicemen, cadets being officers, and male non-commissioned officers - enlisted personnel include training helmet, combat helmet, soft combat cap, combat clothing, combat boots, combat belt.
4. Operational uniforms for officers and soldiers of the Vietnam Coast Guard engaged in ceremonial duties, bilateral patrols, foreign affairs, information lines, vessel operations, search and rescue, emergency response, and special tasks consist of two types of operational uniforms for winter and summer, including cap, clothing, shoes or boots, gloves, belt, lanyard.
5. On-duty uniforms for various specialized fields within the Vietnam Coast Guard, when carrying out special tasks, include cap, trousers, shirt, shoes or boots.
6. Officers and soldiers of the Vietnam Coast Guard are provided with anti-cold caps and jackets; officers and career servicemen are additionally provided with field coats; male non-commissioned officers - enlisted personnel on guard duty are also provided with guard coats.
7. The design and color of uniforms specified in this Article shall be implemented in accordance with the regulations of the Minister of National Defence.
Article 20. Winter formal uniforms for male officers, career servicemen, cadets being officers and cadets engaged in training courses of officers of the Vietnam Coast Guard.
1. Kepi
a) Design: The cap has an oval-shaped helmet; Cap pins and the national emblem embossed for general officers, a yellow five-pointed star embossed for senior and junior officers; In the middle of the front of the cap's forehead is an eyelet flange to wear the insignia, on the front of the visor is a cord, and below the visor is the image of two stalks.
b) Colors:
The top in navy blue.
The visor in blue.
The cap brim’s lining, visor cover and chin strap in black.
The cord and two rice stalks in yellow.
2. Trousers and jacket
a) Design:
Jacket: Long-sleeved V-neck style, the front body has four welt pockets, the hindquarters have a lower-slit posterior keel, and the shoulders have shoulder straps carrying rank badges, the jacket has lined body and sleeves. The left sleeve is attached the logo of the Vietnam Coast Guard as specified in Article 16 hereof.
Trousers: Long suit-style trousers, two diagonal pockets, open door with zipper.
b) Color: Navy blue.
3. Shirt: in loose style, worn tucked into trousers, long sleeves, stand collar, white.
4. Tie: Pre-tied style, matching jacket color.
5. Belt: Leather belt in black; for general officers, two layers of leather are sewn; for senior and junior officers, made of smooth leather on one side. Gold-colored metal belt buckle embossed with a five-pointed star inscribed in a circle.
6. Black leather shoes; for general officers, the shoes are plain-toed with fixed laces; for senior officers, the shoes have horizontal patterns on the toe with fixed laces; for junior officers, the shoes have horizontal patterns on the toe with laces.
7. Socks: Knitted style, matching the color of trousers.
Article 21. Winter formal uniforms for female officers, career servicemen, cadets being officers and cadets engaged in training courses of officers of the Vietnam Coast Guard.
1. Soft cap
a) Design: Made of fabric with a brim all around, folded on both sides of the ears and at the back of the neck, in the front of the cap's forehead is an eyelet flange to wear the insignia, on the front of the visor is a cord, and below the visor is the image of two stalks.
b) Colors: Navy blue. The cord and two rice stalks in yellow.
2. Trousers, jacket
a) Design:
Jacket: Long-sleeved V-neck style, the front body has two welt pockets, the hindquarters have a lower-slit posterior keel, and the shoulders have shoulder straps carrying rank badges. The left sleeve is attached the logo of the Vietnam Coast Guard as specified in Article 16 of this Decree.
Trousers: Long suit-style trousers, two diagonal pockets, open door with zipper.
b) Color: Navy blue.
3. Shirt: Loose-fitting shirt with waist darts, worn tucked into trousers, long sleeves, stand collar, white.
4. Tie: Pre-tied style, matching jacket color.
5. Black leather shoes: Plain square-toed style, high heels, with eyelets for threading decorative laces.
6. Socks: Knitted style, matching the color of trousers.
Article 22. Summer formal uniforms for male officers, career servicemen, cadets being officers and cadets engaged in training courses of officers of the Vietnam Coast Guard
1. Kepi, trousers, belt, leather shoes, socks: colors and design shall be as specified in Clauses 1, 2, 5, 6 and 7, Article 20 of this Decree.
2. Shirt
Design: Short-sleeved pseudo collar shirt, V-neck style, the front body has four welt pockets, the hindquarters have a lower-slit posterior keel, and the shoulders have shoulder straps carrying rank badges. The left sleeve is attached the logo of the Vietnam Coast Guard as specified in Article 16 hereof.
Color: Navy blue.
Article 23. Summer formal uniforms for female officers, career servicemen, cadets being officers and cadets engaged in training courses of officers of the Vietnam Coast Guard
1. Soft cap: Design and color shall be as specified in Clause 1, Article 21 hereof.
2. Skirt and shirt
a) Design:
Shirt: Short-sleeved pseudo collar shirt, V-neck style, the lower front body has two welt pockets, with shoulder and waist darts, the hindquarters have a lower-slit posterior keel, and the shoulders have shoulder straps carrying rank badges. The left sleeve is attached the logo of the Vietnam Coast Guard as specified in Article 16 hereof;
Skirt: Figure-hugging style, knee-length, with inner lining and a slit at the lower back.
b) Color: Navy blue.
3. Black leather boots: High-necked boots with a zipper and a collar across the calf, plain-toed, patterned anti-slip sole.
4. Stockings: Flesh-colored.
Article 24. Formal uniforms for defense workers and employees
1. Suits for male, traditional Vietnamese dress (Ao dai) for female, leather shoes, and socks.
2. Details regarding the design, and color of formal uniforms for defense workers and employees shall be implemented in accordance with the regulations of the Minister of National Defence.
Article 25. Formal uniforms for honor guards and ceremonial guards
1. Formal uniforms of honor guards and ceremonial guards of the Vietnam Coast Guard at the level of the High Command of the Vietnam Coast Guard, Coast Guard Region Command, Anti-Drug Special Task Unit, and Reconnaissance Unit consists of two types, for use in winter and summer.
2. Design
a) Kepi: The cap has an oval-shaped helmet, the edge has a round spring steel wire cage, with a 1.5 mm edge trim around the peak. The front of the forehead and cap brim are made of plastic. The top of the cap visor is covered with black faux leather, with a visor strap attached. The visor strap is embossed with two rice stalks and a bow tie in the center. The front of the visor has a cord made of metallic thread, with both ends of the strap attached to the cap with cap pins. The cap pins have a five-pointed star shape. In the middle of the front cap brim is an eyelet flange to wear the insignia with a diameter of 36 mm, with double pine branches; on both sides of the forehead, there are two air vents. The inner strap of the cap visor has adjustable length. The outer woven band of the cap has horizontal stripes;
Color: The cap top is navy blue; the cap body lining is blue; the cap body lining, visor cover, and chin strap are black; the cord and two rice stalks are yellow.
b) Jacket
Outer jacket: The outer jacket style is lined; the collar has a 3 mm blue trim, forming a V-shape. The collar lapel is perforated to wear double pine branches. The front body has four welt pockets, with a flap in the middle, the pocket bottom is angled, the flap has a sharp point fastening button, the upper pocket pin has a diameter of 18 mm, the lower pocket pin has a diameter of 22 mm, the jacket placket has four 22 mm diameter pins. The hindquarters have a lower-slit posterior keel. On both sides of the jacket, between the side seam and the back seam, there are side seams to hold the wide belt. The shoulders have shoulder straps carrying rank badges. The back shoulder (on the left side of the wearer) has a loop to attach the lanyard. The long sleeves have two cuffs that can be turned outwards, with two parallel trim lines inside in blue and outside in yellow, diagonally sewn up towards the back. The left sleeve is attached the logo of the Vietnam Coast Guard as specified in Article 16 hereof. The pins are sewn onto the jacket body. The front body (on the right side of the wearer) is perforated to wear the Vietnam Coast Guard emblem as specified in Article 14 of this Decree;
Shirt: in loose style, worn tucked into trousers, long sleeves, stand collar, white;
Waistcoat: Four plastic pins with a 15 mm diameter. The lower waist has a 2 cm wide elastic band. The inner lining is quilted in a square pattern;
Color: Navy blue;
c) Trousers: Long suit-style trousers, two diagonal pockets, open door with zipper. Each side of the front body has a pleat folded towards the side. Each side of the back body has a crease, with two back pockets. The waistband has a deep bottom for threading the belt. There are vertical stripes along the length of the trousers;
Color: Navy blue;
d) Tie: Pre-tied style, matching the jacket color;
dd) Jacket pins: Pins are slightly rounded with a spherical shape, the front surface is embossed with a design of two rice stalks and a five-pointed star in the middle. The back of pins has an integrated shank;
e) Cuff and trouser side trim: Embossed pattern band, 2 cm wide;
Color: Blue background and yellow side trim;
g) Black or white leather shoes (used for ceremonial purposes in ministries and departments): Designed with a round toe, with horizontal grooves. There are four pairs of eyelets for threading decorative laces, with elastic underneath the eyelet flanges. The shoe toe is made of cowhide. The back and insole lining are light yellow leather, the toe lining is specialized canvas. The sole and toe are bonded with specialized synthetic adhesive, the toe part is stitched, and the heel part is nailed. The sole is cast with a continuous heel profile, the sole surface has anti-slip patterns; bright yellow leather lining inside;
Black leather boots (used for welcoming international delegations): High-neck shoe style, plain-toed, the entire neck and toe are sewn together; the sole surface has anti-slip patterns, under the heel part of the sole has a steel plate to prevent abrasion; inside the horizontal ankle section is a thick foam pad to cushion the ankle when marching;
h) Belt
Belt with shoulder strap: The main belt body is 5 cm wide, with decorative stitching along the outer edge. The surface of the main belt is embroidered with decorative diamond shapes. The belt has four loops (two loops for attaching the shoulder strap, one adjustable loop for length adjustment, and one loop to secure the excess strap); the shoulder strap is 2 cm wide, with an adjustable length adjustment part. The shoulder strap is connected to the main belt by stainless steel loops. The belt buckle is brass plated in gold color, with a five-pointed star inscribed in a circle. Both ends have loops to attach to the two ends of the main belt. The large belt comes with a shoulder strap that includes a K59 short gun holster and an ammunition pouch carried on the right side of the main belt.
Belt without shoulder strap: Same specifications as the belt with shoulder strap, except the belt does not have a K59 short gun holster and an ammunition pouch.
Small belt: Consists of two main parts, the belt body and the buckle; the belt body is 3.3 cm wide, with the excess strap threaded out when in use, made of suede leather, smooth on one side; the buckle is a non-commissioned clasp, the center of the buckle face is embossed with a five-pointed star inscribed in a circle.
Color: The belt with shoulder strap and the belt without shoulder strap, K59 gun holster, ammunition pouch in white, and gold-colored belt buckle. The small belt is black, with a gold-colored buckle face.
i) Lanyard
The shoulder cord consists of a single cord with a diameter of 5 mm attached parallel to a braided cord. The braided cord is braided from three pairs of threads (in the style of plates).
The chest cord is a section of braided cord made from three single threads in the style of plates, one end of the cord is attached to the end of the braided cord of the shoulder cord, one end is connected to two mace cords;
Mace cords: Consist of two cords, each cord with a knot, one end of the cord is connected to the chest cord and one end is connected to the mace.
The two maces are cast from zinc alloy, plated in gold color on the outside, the body of maces is hollow to attach the cord, the mace top is spherical, with two rice stalks surrounding the five-pointed star.
Color: Lanyard and maces in gold color.
k) White gloves: The sleeve and palm are woven together, with elastic at the wrist. There are three decorative lines on the back of the palm to shape the glove. The glove has five fingers, the wrist part is knitted in a 1:1 rib pattern, the sleeve part is knitted in a 2:2 rib pattern, and the palm part is knitted plain.
l) Navy blue socks: Knitted style, the leg and footbed of socks are knitted in a 2:1 rib pattern. The toe, heel, and sole are knitted smooth on the right side. The toe and heel are knitted with 100% polyamide yarn to enhance abrasion resistance. The sock cuff is knitted in a 1:1 rib pattern with elastic.
3. Subjects and cases of use
a) Officers and career servicemen of the Vietnam Coast Guard shall wear formal uniforms for honor guards and ceremonial guards according to the season. In particular, the summer formal uniform jacket has no body and sleeve lining, and no waistcoat.
b) Non-commissioned officers and enlisted personnel of the Vietnam Coast Guard shall wear formal uniforms for honor guards and ceremonial guards according to the season. In particular, the formal uniform jacket does not have two lower pockets. The summer formal uniform jacket has no body and sleeve lining, and no waistcoat.
Article 26. Regulations on management and use of insignia, rank badges, emblems, and uniforms of the Vietnam Coast Guard
1. Insignia, rank badges, emblems, and uniforms of the Vietnam Coast Guard are used for officers and soldiers on the Vietnam Coast Guard’s payroll.
2. Insignia, rank badges, emblems, and uniforms of the Vietnam Coast Guard are allocated and used uniformly and closely in accordance with the law provisions. The use and withdrawal of insignia, rank badges, emblems, and uniforms for each individual serving or no longer serving in the Vietnam Coast Guard shall be carried out in accordance with the regulations of the Minister of National Defence.
3. It is strictly prohibited for agencies, units, organizations, and individuals to produce, counterfeit, imitate, possess, rent, borrow, exchange, buy, sell, give, donate, or unlawfully use the insignia, rank badges, emblem, and uniforms of the Vietnam Coast Guard. Depending on the nature and severity of the violation, disciplinary actions, administrative penalties, or criminal liabilities may be imposed in accordance with the law provisions.
4. The time and types of uniforms used by agencies and units under the Vietnam Coast Guard shall be uniformly implemented in accordance with the regulations of the Vietnam Coast Guard Commander.
5. When carrying out duties, officers and soldiers of the Vietnam Coast Guard must wear the insignia, rank badges, emblem, and uniforms as prescribed. In cases of involving in reconnaissance tasks, disguises, specialized operations, and criminal cases, they shall wear plain clothes as specified by the Vietnam Coast Guard Commander.
6. When performing duties of honor guards, ceremonial music teams, ceremonial guards, receiving delegations according to State protocols, or carrying out foreign affairs activities, officers and soldiers of the Vietnam Coast Guard shall wear attire as specified by the Minister of National Defence.
Chapter IV
BANNERS, COLORS AND SIGNS FOR IDENTIFICATION OF VESSELS, CANOES, AND AIRCRAFT OF THE VIETNAM COAST GUARD
Article 27. Banners
1. Banners of the Vietnam Coast Guard are triangular in shape, with a background of seawater blue, a height of 1.5 meters, a base side of 1.0 meter, featuring the national emblem in the center and a yellow arrow running horizontally behind; hung on a 2.5 – meter high pole at the stern of the vessel, or at the top rear mast for search and rescue vessels.
2. Vessels, canoes, and other vehicles of the Vietnam Coast Guard must fly the banners of the Vietnam Coast Guard when carrying out their duties. Civilian vessels mobilized or participating in, coordinating, collaborating, or supporting the Vietnam Coast Guard in patrol, inspection, and control duties must hoist the banners of the Vietnam Coast Guard as specified in Clause1 of this Article.
Article 28. Colors of vessels and canoes of the Vietnam Coast Guard
1. Search and rescue vessels
The hull is painted orange, the deck is painted green, in front of the symbol stripe is the hull number painted white, behind the symbol stripe is the inscription “VIETNAM COAST GUARD” in uppercase letters, painted white.
The cabin is painted white, with an orange border above the cabin, and on both sides of the cabin is the inscription “CẢNH SÁT BIỂN VIỆT NAM” (VIETNAM COAST GUARD) in uppercase letters, painted blue.
The smokestack is painted with a red flag with a yellow star.
2. Patrol vessels and other types of vessels
The hull is painted white, the deck is painted green, in front of the symbol stripe is the hull number painted blue, behind the symbol stripe is the inscription “VIETNAM COAST GUARD” in uppercase letters, painted blue.
The cabin is painted white, and on both sides of the cabin is the inscription “CẢNH SÁT BIỂN VIỆT NAM” (VIETNAM COAST GUARD) in uppercase letters, painted blue.
The smokestack is painted with a red flag with a yellow star.
The gun mount is painted grey.
3. Patrol canoes
The hull is painted white, in front of the symbol stripe is the canoe number painted blue, behind the symbol stripe is the inscription and the upper row is the inscription “CẢNH SÁT BIỂN VIỆT NAM” (VIETNAM COAST GUARD), the lower row is the inscription “VIETNAM COAST GUARD” in uppercase letters, painted blue.
The cabin is painted white.
4. The Vietnam Coast Guard Commander shall prescribe the specific dimensions of the number 1 stripe, the emblem of the Vietnam Coast Guard, the inscriptions “CẢNH SÁT BIỂN VIỆT NAM” (VIETNAM COAST GUARD) and “VIETNAM COAST GUARD”, the red flag with a yellow star on the smokestack, suitable for each type of patrol vessel or canoe of the Vietnam Coast Guard.
Article 29. Colors of aircraft of the Vietnam Coast Guard
1. Aircraft body
The lower part of the aircraft body is painted seawater blue (from below the bulging window line of the aircraft down to the belly of the aircraft up to the cockpit window).
The upper part of the aircraft body is painted white (from below the bulging window line of the aircraft up to the back of the aircraft up to the cockpit window and the wings of the aircraft).
2. Aircraft nose
The aircraft nose has two stripes, one orange-yellow and one white, painted on the seawater blue background of the lower part of the aircraft body. The first line is painted orange-yellow from the lower edge of the cockpit down to near the lower belly of the aircraft, at a 15° to 20° angle, with a width of 0.5m - 1.0m (depending on the size of the aircraft). In the middle, there is the emblem of the Vietnam Coast Guard. The second line is painted white, parallel and one-fourth the width of the first line.
The front part has two lines with the aircraft number in white.
The rear part has two lines with uppercase letters in white on the seawater blue aircraft body:
The upper row: CẢNH SÁT BIỂN VIỆT NAM (VIETNAM COAST GUARD)
The lower row: VIETNAM COAST GUARD
The aircraft nose is painted seawater blue.
3. Aircraft wings
Main wings and horizontal tail wings: The upper and lower parts of the wings are painted white.
Vertical tail wings: On the top of both sides of the vertical tail fin is painted with the Vietnamese flag, and underneath is the emblem of the Vietnam Coast Guard, the remaining parts on both sides of the vertical tail fin are painted white.
4. Aircraft engines
The outer casing of the two engines is painted white.
5. Colors, banners, and identification signs on other parts of each type of aircraft of the Vietnam Coast Guard shall be implemented in accordance with the regulations of the Minister of National Defence.
Article 30. Symbols
Symbols for patrol vessels and canoes of the Vietnam Coast Guard are specified as follows:
Three contiguous stripes on the upper sides of the hulls of vessels and canoes. The first stripe in orange is placed at the end point of the bow of vessels or canoes, aligned with the front point of the hull of vessels or canoes at a 30° - 40° angle, the center of the first stripe is attached with the emblem of the Vietnam Coast Guard. The second stripe is white, and the third stripe is blue. The width of the first stripe depends on the size of each type of vessels or canoes; the width of the second and third stripes is one-fourth of the first stripe. The length of stripes is equal to the height of the upper sides of the hulls of vessels or canoes.
Chapter V
COORDINATION
Article 31. Responsibilities of the Minister of National Defence
1. Coordinating with ministers, heads of ministerial-level agencies, chairpersons of provincial-level People's Committees in performing operational coordination among the Vietnam Coast Guard, agencies and units, functional forces of ministries, ministerial-level agencies and provincial-level People’s Committees as specified in Articles 22, 23, 24 of the Law on Vietnam Coast Guard.
2. Directly commanding and guiding the operations of the Vietnam Coast Guard in accordance with the Law on Vietnam Coast Guard and other relevant legal documents; guiding agencies, units, and functional forces under its management to coordinate with the Vietnam Coast Guard.
3. Directing the Vietnam Coast Guard and agencies, units, and functional forces under its management to coordinate with agencies, units, and functional forces under ministries, ministerial-level agencies, provincial-level People's Committees in creating favorable conditions for the Vietnam Coast Guard to fulfill its assigned functions, tasks, and authorities.
Article 32. Responsibilities of the Minister of Public Security
The Minister of Public Security shall be responsible for directing and guiding agencies, units, and functional forces under its management to coordinate with the Vietnam Coast Guard in:
1. Notifying the Vietnam Coast Guard of relevant and necessary information regarding protection of national security and social order and safety; necessary information for announcing or changing the maritime security level for port facilities and other information related to the functions and tasks of the Vietnam Coast Guard.
2. Preventing and fighting crimes and law violations; preventing and fighting piracy and armed robbery against vessels; transferring dossiers, subjects, means and exhibits in cases under the jurisdiction of the Vietnam Coast Guard; receiving dossiers, subjects, means and exhibits in cases under the jurisdiction of the functional forces under the Ministry of Public Security.
3. Assuming the prime responsibility for investigation and arrest of individuals violating the law at sea and those related to law violations at sea who are evading on land in accordance with the law provisions.
4. Training and enhancing the professional competence in safeguarding national security, and ensuring security, social order and safety for officers and soldiers of the Vietnam Coast Guard.
5. Performing international cooperation on prevention and fighting against crimes and law violations, and national security protection.
6. Disseminating and educating the law on security, social order and safety.
7. Carrying out other coordination activities in accordance with the Law on Vietnam Coast Guard, relevant laws, coordination regulations and plans between the two parties.
Article 33. Responsibilities of the Minister of Foreign Affairs
The Minister of Foreign Affairs shall be responsible for directing and guiding agencies and units under its management to coordinate with the Vietnam Coast Guard in:
1. Exchanging necessary information and documents on the Party's guidelines and State policies in diplomatic activities related to the activities of the Vietnam Coast Guard; information on the rights and obligations of Vietnam related to the activities of the Vietnam Coast Guard under international treaties to which the Socialist Republic of Vietnam is a member.
2. Guiding and supporting the Vietnam Coast Guard in resolving cases of foreign organizations and individuals violating Vietnamese law and relevant international treaties to which the Socialist Republic of Vietnam is a member in Vietnamese waters.
3. Guiding, supporting and coordinating with the Vietnam Coast Guard in carrying out international cooperation activities.
4. Carrying out other coordination activities in accordance with the Law on Vietnam Coast Guard, relevant laws, coordination regulations and plans between the two parties.
Article 34. Responsibilities of the Minister of Transport
The Minister of Transport shall be responsible for directing and guiding agencies, units and functional forces under its management to coordinate with the Vietnam Coast Guard in:
1. Timely notifying information on maritime security and safety; changes in the maritime signaling system, permissible depths for vessels entering and leaving channels and seaports, building or demolishing structures at sea and other obstacles in Vietnamese waters to ensure maritime safety.
Notifying about the issuance, suspension, extension, modification, revocation, or cancellation of documents and materials; standards, technical regulations related to the operations of vessels at sea.
Notifying the names, symbols, identification, routes, time, scope, area of operation and licensing of foreign vessels before operating at Vietnamese ports and maritime areas.
2. Coordinating the simulation of maritime security incident situations in Vietnamese waters; participating in maritime search and rescue operations; preventing and fighting prevent piracy and armed robbery against vessels.
3. Preventing and fighting against violations of maritime laws; transferring dossiers, subjects, means and exhibits in cases under the authority of functional forces of the Ministry of Transport; receiving dossiers, subjects, means and exhibits in cases under the jurisdiction of the Vietnam Coast Guard.
4. Guiding and supporting the Vietnam Coast Guard in specialized professional work to identify violations and the extent of damage caused by violations of maritime laws; supporting, guiding, facilitating the anchorage of violating vessels, the loading and unloading of violating goods seized and handled by the Vietnam Coast Guard in seaport waters.
5. Carrying out international cooperation activities on maritime affairs.
6. Disseminating and educating the law to organizations and individuals operating in Vietnamese waters.
7. Carrying out other coordination activities in accordance with the Law on Vietnam Coast Guard, relevant laws, coordination regulations and plans between the two parties.
Article 35. Responsibilities of the Minister of Finance
The Minister of Finance shall be responsible for directing and guiding agencies, units and functional forces under its management to coordinate with the Vietnam Coast Guard in:
1. Exchanging necessary information and documents in the fields of taxation and customs; types of invoices, documents and other necessary documents when transporting goods across Vietnamese waters.
2. Preventing and fighting against crimes and law violations; transferring dossiers, subjects, means and exhibits in cases under the jurisdiction of the Vietnam Coast Guard; receiving dossiers, subjects, means and exhibits under the authority of functional forces under the Ministry of Finance.
3. Guiding and supporting the Vietnam Coast Guard in specialized professional work to identify violations of tax and customs laws; preparing estimates and ensuring budget to carry out the tasks of the Vietnam Coast Guard.
4. Performing international cooperation activities in the fields of tax and customs.
5. Disseminating and educating the laws on tax and customs to organizations and individuals operating in Vietnamese waters.
6. Carrying out other coordination activities in accordance with the Law on Vietnam Coast Guard, relevant laws, coordination regulations and plans between the two parties.
Article 36. Responsibilities of the Minister of Planning and Investment
The Minister of Planning and Investment shall be responsible for directing and guiding agencies and units under its management to coordinate with the Vietnam Coast Guard in:
1. Consolidating the medium-term and annual investment plans of the Vietnam Coast Guard in accordance with the Law on Public Investment.
2. Monitoring, inspecting investment activities, proposing solutions to address issues arising in the process of forming and implementing investment projects; inspecting and evaluating the results of investment activities.
3. Carrying out other coordination activities in accordance with the Law on Vietnam Coast Guard, relevant laws, coordination regulations and plans between the two parties.
Article 37. Responsibilities of the Minister of Agriculture and Rural Development
The Minister of Agriculture and Rural Development shall be responsible for directing and guiding agencies, units and functional forces under its management to coordinate with the Vietnam Coast Guard in:
1. Providing necessary information and documents on fisheries and related activities at sea; types of licenses, documents and professional certificates related to marine fisheries activities.
Notifying the names, symbols, registration books, identification characteristics, itinerary, and operating areas of foreign vehicles and vessels; foreign vehicles and vessels hired for fishery and related activities in Vietnamese waters before these vessels enter Vietnamese waters.
Reporting on the situation of vehicles and vessels engaging in fishing activities that violate the exploitation, protection of aquatic resources in Vietnamese waters; the situation of Vietnamese fishing vessels and fishermen being detained by foreign countries; the situation of Vietnamese fishing vessels violating foreign waters by illegally fishing aquatic products.
2. Patrolling, inspecting, and controlling to protect sovereignty, sovereign rights, and national jurisdiction in Vietnamese waters; performing search and rescue at sea; preventing and fighting piracy and armed robbery against vessels.
3. Protecting the security and safety of activities concerning research and conservation of marine resources at sea.
4. Transferring dossiers, subjects, means and exhibits in cases under the jurisdiction of the Vietnam Coast Guard; receiving dossiers, subjects, means and exhibits under the authority of functional forces under the Ministry of Agriculture and Rural Development.
5. Guiding and supporting the Vietnam Coast Guard in professional work and specialized operations in exploiting and protecting aquatic resources to identify violations in the field of marine fisheries.
6. Fostering and improving professional qualifications in fisheries for officers and soldiers of the Vietnam Coast Guard.
7. Performing international cooperation activities in the field of exploitation and protection of marine resources.
8. Disseminating and educating the law on fisheries for organizations and individuals operating in the maritime areas of Vietnam.
9. Carrying out other coordination activities in accordance with the Law on Vietnam Coast Guard, relevant laws, coordination regulations and plans between the two parties.
Article 38. Responsibilities of the Minister of Natural Resources and Environment
The Minister of Natural Resources and Environment shall be responsible for directing and guiding agencies and units under its management to coordinate with the Vietnam Coast Guard in:
1. Notifying the situation of marine environmental incidents; violations of laws on marine and island resources and environment; related information on the protection of marine and island resources and environment; providing meteorological and hydrological data information at sea.
Notifying about the issuance of new regulations, changes in Vietnamese regulations, standards, or other necessary contents related to the protection of marine and island resources and environment.
2. Ensuring the safety and security of basic investigation, scientific research, resource exploitation and use, and environmental protection at sea.
3. Taking measures to prevent, detect, treat and remedy environmental pollution and degradation of marine and island ecosystems; monitoring, remedying and resolving the consequences of oil and toxic chemical spills at sea; controlling cross-border environmental pollution.
4. Transferring dossiers, subjects, means and exhibits in cases under the jurisdiction of the Vietnam Coast Guard; receiving dossiers, subjects, means and exhibits under the authority of functional forces under the Ministry of Natural Resources and Environment.
5. Providing support on professional work and specialized operations in marine and island resources and environment to identify violations in exploitation, use, and protection of marine and island resources and environment islands, remedying marine and island environmental problems; supporting, guiding and creating conditions for the Vietnam Coast Guard to sink dredged materials at Coast Guard ports.
6. Fostering and improving professional qualifications in marine and island resources and environment for officers and soldiers of the Vietnam Coast Guard.
7. Performing international cooperation activities in the field of marine and island resources and environment.
8. Disseminating and educating the law on marine resources and environment for organizations, individuals operating in the sea areas of Vietnam.
9. Carrying out other coordination activities in accordance with the Law on Vietnam Coast Guard, relevant laws, coordination regulations and plans between the two parties.
Article 39. Responsibilities of the Minister of Information and Communications
The Minister of Information and Communications shall be responsible for directing and guiding agencies and units under its management to coordinate with the Vietnam Coast Guard in:
1. Exchanging necessary information and documents on the use of radio frequencies; submarine cable routes and shore stations of submarine cable routes in Vietnam waters.
2. Protecting information safety and security; safety of submarine cable systems, shore stations of submarine cable routes, and information and communication facilities at sea; safety of radio frequency bands between information networks serving socio-economic, national defense and security.
3. Preventing, detecting, stopping, fighting against information and communication activities that violate the law.
4. Training, fostering and improving professional qualifications on use of radio frequency transmitters, and information technology for officers and soldiers of the Vietnam Coast Guard.
5. Being in charge of press information, radio, television and international cooperation in the field of information and communication.
6. Carrying out other coordination activities in accordance with the Law on Vietnam Coast Guard, relevant laws, coordination regulations and plans between the two parties.
Article 40. Responsibilities of the Minister of Industry and Trade
The Minister of the Ministry of Industry and Trade shall be responsible for directing and guiding agencies, units and functional forces under its management to coordinate with the Vietnam Coast Guard in:
1. Exchanging information and documents related to import-export activities, border trade, oil and gas trading, and market management related to the tasks and powers of the Vietnam Coast Guard.
2. Ensuring the safety and security of oil and gas survey, research, exploration, and exploitation; oil pipelines, offshore oil structures.
3. Preventing and fighting against crime and law violations; transferring dossiers, subjects, means and exhibits in cases under the jurisdiction of the Vietnam Coast Guard; receiving dossiers, subjects, means and exhibits under the authority of functional forces under the Ministry of Industry and Trade.
4. Disseminating and educating the law for organizations and individuals operating in Vietnamese waters.
5. Carrying out other coordination activities in accordance with the Law on Vietnam Coast Guard, relevant laws, coordination regulations and plans between the two parties.
Article 41. Responsibilities of chairpersons of provincial-level People's Committees
Chairpersons of provincial-level People's Committees shall be responsible for directing specialized agencies and district-level People's Committees to closely coordinate with agencies and units under the Vietnam Coast Guard in:
1. Carrying out search and rescue, disaster relief, and environmental incident response at sea.
2. Transferring, receiving, and utilizing manpower, vessels, and civilian vehicles mobilized to protect the sovereignty and sovereign rights of the maritime areas of the Socialist Republic of Vietnam.
3. Managing the areas related to the activities of the Vietnam Coast Guard; supporting and creating favorable conditions regarding land, housing, and facilities for military bases, shelters for repairing vessels, aircraft, warehouses, docks, and other conditions for the Vietnam Coast Guard to carry out their tasks.
4. Handling law violations related to their local citizens; disseminating, promoting and educating the law for local organizations and individuals; organizations, individuals operating in Vietnamese waters.
Article 42. Responsibilities of organizing coordination activities of ministries and ministerial-level agencies
The Ministry of National Defence shall assume the prime responsibility for, and coordinate with relevant ministries and ministerial-level agencies in, issuing regulations on coordination activities between the Vietnam Coast Guard and agencies, units, functional forces under ministries and ministerial-level agencies in accordance with the Law on Vietnam Coast Guard and this Decree.
Chapter VI
IMPLEMENTATION PROVISIONS
Article 43. Effect
1. This Decree takes effect from August 28, 2019.
2. The Government’s Decree No. 86/2009/ND-CP dated October 19, 2009, detailing a number of articles of the Ordinance on Vietnam Coast Guard; the Government’s Decree No. 96/2013/ND-CP dated August 27, 2013, amending and supplementing a number of articles of the Government’s Decree No. 86/2009/ND-CP dated October 19, 2009, detailing a number of articles of the Ordinance on Vietnam Coast Guard; the Government’s Decree No. 13/2015/ND-CP dated February 12, 2015, amending and supplementing Article 9 of the Government’s Decree No. 86/2009/ND-CP dated October 19, 2009, detailing a number of articles of the Ordinance on Vietnam Coast Guard; the Government’s Decree No. 66/2010/ND-CP dated June 14, 2010, promulgating the Regulations on coordination in state management regarding the Coast Guard’s activities and coordination activities among forces on the seas and continental shelf of the Socialist Republic of Vietnam cease to be effective from the effective date of this Decree.
Article 44. Transitional provisions
The Prime Minister’s Decision No. 25/2012/QD-TTg dated June 4, 2012, on a number of preferential regimes for officers, career servicemen, non-commissioned officers, enlisted personnel, defense workers and civil servants on the Vietnam Coast Guard’s payroll continues to be effective until repealed and replaced by other legal documents in accordance with the law provisions.
Article 45. Implementation responsibilities
1. The Minister of National Defence shall urge, inspect and guide the implementation of this Decree.
2. Ministers, heads of ministerial-level agencies, heads of governmental agencies, and chairpersons of People's Committees of provinces and centrally-run cities shall implement this Decree./.
