Decree 157/2024/ND-CP amend Decree 105/2015/ND-CP detailing the Ordinance on Environmental Police

DECREE

Amending and supplementing a number of articles of the Government’s Decree No. 105/2015/ND-CP dated October 20, 2015, on detailing a number of articles of the Ordinance on Environmental Police

Pursuant to the Law on Organization of the Government dated June 19, 2015; Law on Amending and Supplementing a Number of Articles of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;

Pursuant to the Ordinance on Environmental Police dated December 23, 2014;

At the request of Minister of Public Security;

The Government promulgates the Decree amending and supplementing a number of articles of the Government’s Decree No. 105/2015/ND-CP dated October 20, 2015, on detailing a number of articles of the Ordinance on Environmental Police.

Article 1. Amending and supplementing a number of articles of the Government’s Decree No. 105/2015/ND-CP dated October 20, 2015, on detailing a number of articles of the Ordinance on Environmental Police

1. To amend and supplement Clause 3 Article 6 as follows:

“3. Competence to request provision of information, documents and objects; explanation for acts showing signs of crimes or administrative violations:

a) The Director of Police Department for Environmental Crime Prevention and Combat;

b) Directors of provincial-level Public Security Departments;

c) Heads of Police Divisions for Investigation of Corruption, Economic, Smuggling and Environmental Crimes of provincial-level Public Security Departments;

d) Heads of district-level Public Security Divisions.”.

2. To amend and supplement Clause 2 Article 7 as follows:

“2. Competence to issue examination decisions:

a) The Director of Police Department for Environmental Crime Prevention and Combat;

b) Directors of provincial-level Public Security Departments;

c) Heads of Police Divisions for Investigation of Corruption, Economic, Smuggling and Environmental Crimes of provincial-level Public Security Departments;

d) Heads of district-level Public Security Divisions.”.

3. To amend and supplement Clause 2 Article 8 as follows:

“2. Competence to issue examination decisions:

a) The Director of Police Department for Environmental Crime Prevention and Combat;

b) Directors of provincial-level Public Security Departments;

c) Heads of Police Divisions for Investigation of Corruption, Economic, Smuggling and Environmental Crimes of provincial-level Public Security Departments;

d) Heads of district-level Public Security Divisions.”.

4. To amend Clause 1 Article 10 as follows:

“1. The competent persons defined in Clause 3, Article 6; Clause 2, Article 7; Clause 2, Article 8 of this Decree may authorize their deputies to exercise their competence.”.

Article 2. To replace and repeal a number of words, phrases, clauses and articles of the Government’s Decree No. 105/2015/ND-CP dated October 20, 2015, on detailing a number of articles of the Ordinance on Environmental Police

1. To replace the following phrases:

a) To replace the phrase “Environmental Police Force” with the phrase “Environmental Crime Prevention and Combat Police Force” in Article 1; Clauses 3 and 4, Article 12; Point b, Clause 1, Article 14; Clauses 2, 3, 4, 5, 6, 7 and 8, Article 14; Point b, Clause 9, Article 14; Point c, Clause 10, Article 14; Clause 1, Article 15; Clauses 1 and 3, Article 16; Clause 2, Article 18.

b) To replace the phrase “Environmental Police” with the phrase “Environmental Crime Prevention and Combat Police Force” in Article 2; the title of Chapter II; Article 4; Article 5; Clause 1, Article 6; Clause 1, Article 7; Clause 1, Article 8; Clause 1, Article 9; Clause 1, Article 11; Clause 10, Article 13; Point a, Clause 2, Article 14; the title of Chapter IV; Clauses 1 and 2, Article 15; the title of Article 16; Clause 2, Article 16; Clauses 1 and 2, Article 17; the title of Article 18; Points a and c, Clause 1, Article 18; Clause 2, Article 18.

2. To repeal Clause 2 Article 9.

Article 3. Effect

This Decree takes effect on December 20, 2024.
