Establishment of the National Steering Committee for Civil Defense

THE PRIME MINISTER

Pursuant to the Law on Organization of the Government dated June 19, 2015;

Pursuant to the Government’s Decree No. 02/2019/ND-CP dated January 02, 2019, on civil defense

Pursuant to the Prime Minister’s Decision No. 34/2007/QD-TTg dated March 12, 2007, on promulgating the Regulation on establishment and organization of activities of inter-sectoral coordination organizations,

At the request of the Minister of National Defence.

DECIDES:

Article 1. To establish the National Steering Committee for Civil Defense (hereinafter referred to as the Steering Committee), including the following contents:

1. Position and functions of the Steering Committee

a) The Steering Committee is an inter-sectoral coordination organization, with the function of advising the Government and the Prime Minister in organizing, directing and operating civil defense activities nationwide, directly directing the civil defense steering committees of ministries, central sectors and provincial civil defense steering committees.

b) The Head of the Steering Committee uses the Government seal; the Deputy Heads and Members of the Steering Committee use the seals of the agencies and units they work for in performing their assigned tasks.

2. Duties and powers of the Steering Committee

The Steering Committee performs the tasks regulated in Clause 4, Article 20 of the Government’s Decree No. 02/2019/ND-CP dated January 02, 2019, on civil defense.

3. Structure and organization of the Steering Committee

a) Membership structure of the Steering Committee

- Head of the Steering Committee: Prime Minister

- Deputy Heads:

+ Permanent Deputy Heads: Deputy Prime Minister, Chairman of the National Committee for Incident and Natural Disaster Response, and Search and Rescue;

+ Minister of National Defence,

+ Minister of Public Security.

- Commissioners:

+ Ministers of the Ministries: Agriculture and Rural Development, Industry and Trade, Transport, Construction, Health, Natural Resources and Environment, Science and Technology, Culture, Sports and Tourism, Foreign Affairs, Information and Communications, Finance, Planning and Investment, Education and Training, Home Affairs, Justice, labor, Invalids and Social Affairs, Minister - Head of the Government Office;

+ General Director of Vietnam Television, General Director of Voice of Vietnam, General Director of Vietnam News Agency;

+ Based on work requirements: The Head of the Steering Committee decides to invite representatives - heads of relevant agencies and organizations: Central Committee of the Vietnam Fatherland Front, Central Committee of the Vietnam Women’s Union, Central Committee of the Ho Chi Minh Communist Youth Union, Central Committee of the Vietnam Red Cross Society and other relevant agencies and organizations to participate in the Steering Committee.

- Members of the Steering Committee operate on a part-time basis.

b) Standing agency and supporting apparatus of the Steering Committee

- The Ministry of National Defence is the standing agency of the Steering Committee, responsible for ensuring the operating conditions of the Steering Committee; using the apparatus of the Department of Rescue and Search/General Staff of the Vietnam People’s Army to perform the tasks of the Office of the National Steering Committee for Civil Defense. The Office of the National Steering Committee for Civil Defense has a seal for operation.

- Agencies and organizations with members participating in the Steering Committee use their existing apparatus (assigning 01 unit under their management to act as the focal point) to assist members of the Steering Committee in performing the assigned tasks and powers as assigned by the Head of the Steering Committee.

c) Working regime of the Steering Committee: The Steering Committee works in a democratic manner, giving prominence to the powers and responsibilities of the Members, promoting collective intelligence, and voting by majority.

d) Duties and powers of the Head of the Steering Committee in deciding specifically on the list of Steering Committee members and promulgating the Regulations on organization and operation of the Steering Committee: Based on the situation of civil defense activities in each period, the Head of the Steering Committee decides specifically on the list of Steering Committee members and promulgates the Regulations on organization and operation of the Steering Committee to ensure effective civil defense activities.

Article 2. Operating expenses of the Steering Committee

The State budget shall be covered and allocated in the annual State budget estimate of the Ministry of National Defence and other funding sources according to the provisions of the Law on the State Budget and applicable legal documents.

Article 3. Implementation provisions

1. This Decision takes effect from the date of its signing and promulgation.

2. The Minister of National Defence, Ministers, Heads of ministerial-level agencies, Heads of Government-attached agencies, Chairpersons of People’s Committees at all levels, relevant agencies, organizations and individuals shall implement this Decision./.
