RESOLUTION

ON THE RECEIPT, CLASSIFICATION AND PROCESSING OF CITIZENS' COMPLAINTS, DENUNCIATIONS AND PETITIONS SENT TO THE NATIONAL ASSEMBLY, NATIONAL ASSEMBLY STANDING COMMITTEE, THE COUNCIL FOR ETHNIC MINORITIES AND COMMITTEES OF THE NATIONAL ASSEMBLY

THE NATIONAL ASSEMBLY STANDING COMMITTEE OF THE SOCIALISTREPUBLIC OF VIETNAM

 

Pursuant to the 1992 Constitution of the SocialistRepublic of Vietnam which was amended and supplemented under Resolution No 51/2001/QH10;

Pursuant to the Law on Organization of the National Assembly which was amended and supplemented under Law No. 83/2007/QH11;

Pursuant to Law No. 05/2003/QH11 on Supenvisory Activities of the National Assembly;

Pursuant to the Law on Complaints and Denunciations which has been amended and supplemented under Laws No. 26/2004/QH11 and No. 58/2005/QH11;

Pursuant to the National Assembly's Resolution No. 26/2004/QH11 promulgating the Regulation on operation of the National Assembly Standing Committee and Resolution No. 27/2004/NQ-QH11 promulgating the Regulation on operation of the Council for Ethnic Minorities and Committees of the National Assembly;

At the proposal of the head of the People's Aspirations Board,

RESOLVES:

Article 1. This Resolution provides for the receipt, classification and processing of citizens' complaints, denunciations and petitions sent to the National Assembly, the National Assembly Standing Committee and the National Assembly's agencies.

The Council for Ethnic Minorities and Committees of the National Assembly, the People's Aspirations Board and the Deputies' Affairs Board of the National Assembly Standing Committee shall receive and process citizens' complaints, denunciations and petitions in the domains under their respective management according to their tasks and powers.

Article 2.-

1. Citizens" complaints, denunciations and petitions sent to the National Assembly, the National Assembly Standing Committee, the National Assembly Chairman, the National Assembly vice chairmen, the National Assembly Office and the People's Aspirations Boards shall be received,

classified and forwarded by the People's Aspirations Board to the Council for Ethnic Minorities, the National Assembly's Committees or the Deputies' Affairs Board according to their respective management domains.

2. Citizens' complaints, denunciations and petitions sent to the Council for Ethnic Minorities and the National Assembly's Committees shall be processed as follows:

a/ The Council for Ethnic Minorities and the National Assembly's Committees shall process complaints, denunciations and petitions in the domains under their respective management according to their competence;

b/ Complaints, denunciations and petitions in other domains shall be forwarded to the Council for Ethnic Minorities, other Committees of the National Assembly, the Deputies' Affairs Board or the People's Aspirations Board for processing according to their competence.

Article 3.- The Council for Ethnic Minorities shall process the following complaints, denunciations and petitions:

1. Petitions and complaints concerning the implementation of socio-economic development programs and projects in mountainous areas and ethnic minority regions: the training, re-training and employment of ethnic minority officials, and petitions and complaints in other domains under its management:

2. Denunciations against agencies', organizations' and individuals' illegal acts in domains specified in Clause 1 this Article.

Article 4.- The Law Committee shall process the following complaints, denunciations and petitions:

1.  Petitions and complaints concerning property concerning the implementation of the socialist transformation policy; government bonds, public debts and borrowings owed to citizens during resistance wars; disputes over administrative boundaries: handling of administrative violations: and petitions and complaints in other domains under its management;

2. Denunciations against agencies , organizations" and individuals' illegal acts in domains specified in Clause 1, this Article.

Article 5.- The Judicial Committee shall process the following complaints, denunciations and petitions:

1. Petitions and complaints concerning court judgments and rulings on criminal, civil, family and marriage, business, commercial, labor and administrative cases; judgment enforcement and judicial assistance; compensation in the judicial domain; arrest, search and confiscation of property, custody, detention, institution of criminal cases, investigation, prosecution and trial by judicial agencies; request for commutation of imprisonment terms and death penalties; application of judicial measures; and complaints and denunciations in other domains under its management;

2. Denunciations against and information on crimes;

3. Denunciations against corrupt acts as prescribed in Article 3 of the Anti-Corruption Law:

4. Denunciation on agencies, organizations and individuals committing illegal acts in domains specified in Clauses 1, 2 and 3 of this Article.

Article 6.- The Economic Committee shall process the following complaints, denunciations and petitions:

1. Petitions and complaints concerning economic, monetary and banking management; production and business activities; houses, land and assets attached to land falling within the settling competence of state administrative agencies; compensation upon land recovery, and petitions and complaints in other domains under its management;

2. Denunciations against agencies', organizations' and individuals' illegal actsin domains specified in Clause 1 of this Article.

Article 7.- The Financial and Budgetary Committee shall process the following complaints, denunciations and petitions:

1. Petitions and complaints concerning financial and budgetary issues, tax, customs, securities and audit and petitions and complaints in other domains under its.management;

2. Renunciations against agencies', organizations' and individuals' illegal acts in domains specified in Clause 1 of this Article.

Article 8.- The Defense and Security Committee shall process the following complaints, denunciations and petitions:

1. Petitions and complaints concerning the implementation ofregimes and policies in the Army and Public Security forces: houses and land managed by the Ministry of Defense and the Ministry of Public Security, and petitions and complaints in other domains under its management;

2. Denunciations against illegal acts of agencies, organizations and individuals in the Army and Public Security forces, except petitions and denunciations specified in Clause 4, Article 5 of this Resolution.

Article 9.- The Committee for Culture, Education, Youth. Adolescents and Children shall process the following complaints, denunciations and petitions:

1. Petitions and complaints concerning culture, information, education, training, sports, press, radio and television broadcasting or advertising; the implementation of policies toward youth, adolescents and children, and petitions and complaints in other domains under its management;

2. Denunciations against agencies', organizations* and individuals' illegal acts in domains specified in Clause 1 of this Article.

Article 10.-The Committee for Social Affairs shall process the following complaints, denunciations and petitions:

1. Petitions and complaints concerning labor, employment and salary; the implementation of policies towards people with meritorious services and preferential policies; medical examination and treatment, hospital fees, health insurance, population and family planning; social insurance; and implementation of social and religious policies, and petitions and complaints in other domains under its management:

2. Denunciations against agencies', organiza­tions' and individuals' illegal acts in domains specified in Clause 1 of this Article.

Article 11.- The Committee for Science, Technology and Environment shall process the following complaints, denunciations and petitions:

1. Petitions and complaints concerning science, technology, resources and environment; policies on development of science, technology, resources and environment; important national works under the National Assembly's resolutions, and petitions and complaints in other domains under its management;

2. Denunciations against agencies', organiza­tions' and individuals' illegal acts in domains specified in Clause 1 of this Article.

Article 12.- The Committee for Foreign Affairs shall process the following complaints, denunciations and petitions:

1. Petitions and complaints of foreign organizations and individuals and other petitions and complaints about or related to foreign affairs;

2. Denunciations against agencies', organiza­tions' and individuals' illegal acts in domains specified in Clause 1 of this Article.

Article 13.- The Deputies Affairs Board shall assist the National Assembly Standing Committee in processing citizens' complaints and denunciations concerning the election of National Assembly deputies: denunciations against National Assembly deputies, officials managed by the National Assembly Standing Committee, and National Assembly officials managed by the Party Central Committee.

Article 14.- The People's Aspirations Board shall assist the National Assembly Standing Committee in processing citizens' complaints, denunciations and petitions related to several Committees and the Council for Ethnic Minorities and complaints and denunciation falling beyond the management of the Council for Ethnic Minorities, National Assembly's Committees or the Deputies' Affairs Board.

Article 15.-

1. Biannually and annually, the Standing Board of the Council for Ethnic Minorities, the standing boards of the National Assembly's Committees, the People's Aspirations Board and the Deputies' Affairs Board shall report to the National Assembly Standing Committee on the receipt and processing of citizens' complaints, denunciations and petitions and the results of supervisory activities regarding the settlement of these complaints, denunciations and petitions.

2. The People's Aspirations Board shall assist the National Assembly Standing Committee in reviewing the receipt and processing of citizens' complaints, denunciations and petitions and the results of supervisory activities of the Council for Ethnic Minorities, the National Assembly's Committees and the National Assembly Standing Committee's Boards regarding the settlement of these complaints and denunciations and make periodical reports to the National Assembly' Standing Committee in accordance with the Regulation on operation of the National Assembly Standing Committee and the Rules of National Assembly sessions.

Article 16.- The standing boards of the Council for Ethnic Minorities and the National Assembly's Committees, the Director of the National Assembly Office and the directors of the People's Aspirations Board and the Deputies' Affairs Board shall implement this Resolution.

Article 17.- This Resolution replaces the National Assembly Standing Committee's Resolution No. 715/2004/NQ-UBTVQH11 of June 18,2004, and takes effect on the date of its signing.
