Decree 01/2022/ND-CP amending Decree 65/2018/ND-CP detailing the Railway Law

DECREE

Amending and supplementing a number of articles of the Government’s Decree No. 65/2018/ND-CP of May 12, 2018, detailing a number of articles of the Railway Law^[1]

Pursuant to the June 19, 2015 Law on Organization of the Government; and the November 22, 2019 Law Amending and Supplementing a Number of Articles of the Law on Organization of the Government and the Law on Organization of Local Administration;

Pursuant to the June 16, 2017 Railway Law;

At the proposal of the Minister of Transport;

The Government promulgates the Decree amending and supplementing a number of articles of the Government’s Decree No. 65/2018/ND-CP of May 12, 2018, detailing a number of articles of the Railway Law.

Article 1. To amend and supplement a number of articles of the Government’s Decree No. 65/2018/ND-CP of May 12, 2018, detailing a number of articles of the Railway Law

1. To amend Clause 3 of, and add Clause 6 to, Article 18 as follows:

a/ To amend Clause 3 as follows:

“3. The provisions on useful life of rolling stocks specified in Clauses 1 and 2 of this Article shall not apply to salvage and rescue activities; movement in stations, terminals, depots, and factories; transfer between stations and depots; steam locomotives pulling tourist trains; specialized depressed center flat wagons serving national defense and security; and special-use vehicles moving on the rail.”.

b/ To add Clause 6 as follows:

“6. Rolling stocks specified in Clauses 1 and 2 of this Article whose useful life expires shall no longer be subject to provisions on useful life of rolling stocks specified in Clause 3 of this Article.”.

2. To amend Article 19 as follows:

“Article 19. Roadmap for application of useful life of rolling stocks

1. Rolling stocks whose useful life expires before December 31, 2018, may operate through December 31, 2023.

2. Rolling stocks whose useful life expires between January 1, 2019, and before December 31, 2019, may operate through December 31, 2024.

3. Rolling stocks whose useful life expires or will expire between January 1, 2020, and before December 31, 2025, may operate through December 31, 2025.

4. Rolling stocks whose useful life will expire on or after January 1, 2026, may not operate after their useful life expires.”.

Article 2. Effect

This Decree takes effect on the date of its signing.

Article 3. Implementation responsibility

Ministers, heads of ministerial-level agencies, heads of government-attached agencies, chairpersons of provincial-level People’s Committees, and heads of related agencies shall implement this Decree.-
