DECISION
Providing regulations on the grant of the export license for medical masks during the period of prevention and control of the COVID-19 epidemic

Pursuant to the Law on Commercial dated June 14, 2005;
Pursuant to the Law on Foreign Trade Management dated June 12, 2017;
Pursuant to the Government’s Decree No. 75/2017/ND-CP dated June 20, 2017 on defining the functions, tasks, powers and organizational structure of the Ministry of Health;
Pursuant to the Government’s Decree No. 69/2018/ND-CP of May 15, 2018 on detailing a number of Articles of the Law on Foreign Trade Management;
Pursuant to the Government's Decree No. 36/2016/ND-CP dated May 15, 2016 on medical equipment management, amended by the Government's Decree No. 169/2018/ND-CP dated December 31, 2018 and the Government's Decree No. 03/2020/ND-CP dated January 01, 2020;
On implementation of the Government's Resolution No. 20/NQ-CP dated February 28, 2020 on applying the regime of grant of export license for medical masks in the period of prevention and control of COV-19 epidemic;
At the proposal of the Director of the Department of Health Equipment and Works - Ministry of Health,
DECIDES:
Article 1. Scope of adjustment and subjects of application
1. This Decision provides regulations on the grant of the export license for medical masks during the period of prevention and control of the COVID-19 epidemic.
2. This Decision applies with agencies and organizations assigned to export medical masks for the purpose of international aid and support by the Government in accordance with Clause 1 of the Government’s Resolution No. 20/NQ-CP dated February 28, 2020.
Article 2. Standard for export medical masks
Medical masks must meet at least requirements of the Vietnamese National Standards TCVN 8389-1 : 2010; TCVN 8389-2 : 2010; TCVN 8389-3 : 2020 and have the circulation number granted by the medical competent authority as prescribed by law.
Article 3. Application for the grant of an export license
1. A written request for the grant of export license: 01 original according to Form No. 01 attached to this Decision.
2. Valid copies of documents of the Government, the Prime Minister or notices of the Government Office on the assignment of export of medical masks for the purpose of international aid and support.
