Decision No. 19/2012/QD-TTg dated April 10, 2012 of the Prime Minister on the establishment of Mong Cai border-gate economic zone in Quang Ninh province

DECISION

ON THE ESTABLISHMENT OF MONG CAI BORDER-GATE ECONOMIC ZONE IN QUANG NINH PROVINCE

Pursuant to the December 25, 2001 Law on Organization of the Government;

Pursuant to the November 29, 2005 Law on Investment;

Pursuant to the Government’s Decree No. 29/2008/ND-CP of March 14, 2008, providing for industrial parks, export processing zones and economic zones;

At the proposals of the Minister of Planning and Investment and the People’s Committee of Quang Ninh province;

The Prime Minister promulgates this Decision on the establishment of Mong Cai border-gate economic zone in Quang Ninh province,

Article 1.To establish Mong Cai border-gate economic zone in Quang Ninh province.

1. Mong Cai border-gate economic zone in Quang Ninh province has definite geographical boundaries within Vietnam’s territory and under national sovereignty, and a separate economic space.

Mong Cai border-gate economic zone embraces the entire Mong Cai city (including 17 administrative units of Tra Co, Tran Phu, Ka Long, Ninh Duong, Hai Yen, Hai Hoa, Binh Ngoc and Hoa Lac wards, and Hai Tien, Van Ninh, Hai Dong, Quang Nghia, Vinh Thuc, Vinh Trung, Hai Son, Hai Xuan and Bac Son communes); Hai Ha industrial park - seaport (including

3 administrative units of Quang Dien, Quang Phong and Phu Hai communes); Quang Ha township and Quang Thang, Quang Thanh, Quang Minh, Quang Trung and Cai Chien communes (Hai Ha rural district). The total land area of the economic zone is about 121,197 hectares of which the mainland area is 66,197 hectares and sea surface area is 55,000 hectares. The geographical boundaries are determined as follows:

a/ To the north: It borders on Dongxing city (China).

b/ To the west: It borders on some communes of Dam Ha and Van Don districts.

c/ To the east and south: It borders on the East Sea (Gulf of Tonkin).

2. Mong Cai border-gate economic zone is organized into non-tariff and functional areas, including the international border gate, industrial parks, financial centers, urban areas, administrative centers, residential areas and other functional areas. The size and location of each area is determined in the general plan and detailed plan of the Mong Cai border-gate economic zone.

Article 2.The operation of, mechanisms and policies applicable to, Mong Cai border-gate economic zone in Quang Ninh province comply with the Law on Investment and its guiding documents, the Government’s Decree No. 29/2008/ND-CP of March 14, 2008, providing for industrial parks, export processing zones and economic zones, the Prime Minister’s

Decision No. 33/2009/QD-TTg of March 2, 2009, promulgating financial mechanisms and policies applicable to border-gate economic zones and other relevant legal documents.

Article 3.Implementation provisions

1. This Decision takes effect on June 1, 2012.

To annul the Prime Minister’s Decision No. 675/TTg of September 18, 1996, on the pilot application of a number of policies to Mong Cai border- gate area.

2. Ministers, heads of ministerial-level agencies, heads of government- attached agencies and the chairperson of the People’s Committee of Quang Ninh province shall implement this Decision.-
