To change agency grant certificates of insurance on civil liability for oil pollution damage (1992)
On August 12, 2019, the Ministry of Transport issues the Circular No. 29/2019/TT-BGTVT on amending and supplementing a number of Articles of the Circular No. 12/2011/TT-BGTVT on grant and revocation of certificates of insurance or financial security under the 1992 International Convention on Civil Liability for Oil Pollution Damage.
In accordance with the previous regulations, the competent agencies grant certificates of insurance or financial security on civil liability for oil pollution damage are Vietnam Maritime Administration or Maritime Administrations located in Hai Phong City, Ho Chi Minh City and Da Nang City.
However, according to new provisions, Vietnam Maritime Administration or provincial-level Maritime Administrations or Port Authorities authorized by the Vietnam Maritime Administration to carry out the ship registration to attest that insurance or another financial security for a seagoing ship is in force and complies with the requirements prescribed in Article VII of the 1992 CLC shall be responsible for granting of such certificates.
This Circular takes effect on October 01, 2019.
