SUMMARY

To amend on regulation of certificates of insurance or financial security of civil liability for bunker oil pollution damage

On August 12, 2019 , the Minister of Transport promulgates the Circular No. 28/2019/TT-BGTVT on amending and supplementing a number of articles of the Minister of Transport’s Circular No. 46/2011/TT-BGTVT of June 30, 2011, on grant and revocation of certificates of insurance or financial security under the 2001 International Convention on Civil Liability for Bunker Oil Pollution Damage.

Accordingly, to annul the regulation on granting agencies of certificate of insurance or financial security and amend the regulation on certificates of insurance or financial security of civil liability

for bunker oil pollution damage as follow:

Certificate of insurance or financial security of civil liability for bunker oil pollution damage shall be granted by the Vietnam Maritime Administration or provincial-level Maritime Administrations or Port Authorities authorized by the Vietnam Maritime Administration to carry out the ship registration to attest that insurance or another financial security for a seagoing ship is in force and complies with the requirements prescribed in Article 7 of the 2001 Bunker Convention.

This Circular takes effect on October 01, 2019.

CIRCULAR

Amending and supplementing a number of articles of the Minister of Transport’s Circular No. 46/2011/TT-BGTVT of June 30, 2011, on grant and revocation of certificates of insurance or financial security under the 2001 International Convention on Civil Liability for Bunker Oil Pollution Damage ^{^[1]}

Pursuant to the November 25, 2015 Maritime Code of Vietnam;

Pursuant to the Government’s Decree No. 12/2017/ND-CP of February 10, 2017, defining the functions, tasks, powers and organizational structure of the Ministry of Transport;

Pursuant to the 2001 International Convention on Civil Liability for Bunker Oil Pollution Damage to which Vietnam is a contracting party;

At the proposal of the Director of Legal Department and the Director of the Vietnam Maritime Administration;

The Minister of Transport promulgates the Circular amending and supplementing a number of articles of the Minister of Transport’s Circular No. 46/2011/TT-BGTVT of June 30, 2011, on grant and revocation of certificates of insurance or financial security under the 2001 International Convention on Civil Liability for Bunker Oil Pollution Damage.

Article 1. To amend and supplement a number of articles of the Minister of Transport’s Circular No. 46/2011/TT-BGTVT of June 30, 2011, on grant and revocation of certificates of insurance or financial security under the 2001 International Convention on Civil Liability for Bunker Oil Pollution Damage (the 2001 Bunker Convention)

To amend and supplement Clause 1, Article 3 as follows:
