SUMMARY

To amend provisions on the Lottery Supervisory Council members

On April 08, 2020, the Ministry of Finance issues the Circular No. 21/2020/TT-BTC on amending and supplementing a number of Articles of the Circular No. 36/2019/TT-BTC dated June 17, 2019 of the Ministry of Finance on providing guidance on computer-generated lottery business.

Accordingly, the Ministry of Finance supplements provisions that the leader of a branch of a computer-generated lottery enterprise may be one member of the Lottery Supervisory Council. As in previous regulations, members of the Lottery Supervisory Council only include leaders of a number of divisions and departments of the computer-generated lottery enterprise.

In addition, this Circular also stipulates about the supplement the Lottery Supervisory Council components in force majeure case. To be specific: In force majeure case, if the Lottery Supervisory Council fails to ensure adequate components, the computer-generated lottery enterprise may supplement the composition of the Vice President of the Lottery Supervision Council in the order of priority as follows: Heads of divisions and departments, Directors of branches; deputy heads of divisions and departments, Deputy Directors of branches of the computer-generated lottery enterprise.

In case the Lottery Supervisory Council fails to ensure adequate components, the computer-generated lottery enterprise shall decide to temporarily suspend the prize drawing and publicize at its head office, branches and shops (if any), lottery agents…

This Circular takes effect on the signing date.

On amending and supplementing a number of Articles of the Circular No. 36/2019/TT-BTC dated June 17, 2019 of the Ministry of Finance on providing guidance on computer-generated lottery business

Pursuant to the Government’s Decree No. 30/2007/ND-CP dated March 01 2007 on lottery business and the Government’s Decree No. 78/2012/ND-CP dated October 05 2012 on amending and supplementing a number of Articles of the Government’s Decree No.30/2007/ND-CP dated March 01 2007 on lottery business;

Pursuant to the Government’s Decree No. 87/2017/ND-CP dated July 26, 2017 on defining the functions, tasks, powers and organizational structure of the Ministry of Finance;

On implementing the Prime Minister’s Decision No. 1109/QD-TTg dated July 11, 2011 on approving the Scheme on the establishment of computer-generated lottery enterprises in Vietnam;

At the proposal of the Director of the Department of Banking and Financial Institutions;

The Minister of Finance hereby promulgates the Circular on amending and supplementing a number of Articles of the Circular No. 36/2019/TT-BTC dated June 17, 2019 of the Ministry of Finance on providing guidance on computer-generated lottery business.

Article 1. To amend and supplement a number of Articles of the Circular No. 36/2019/TT-BTC dated June 17, 2019 of the Ministry of Finance on providing guidance on computer-generated lottery business as follows:

1. To amend and supplement Point c, Clause 2 of Article 24 as follows:

“c) Members of the Lottery Supervisory Council shall be leaders of a number of divisions, departments and branches of the computer-generated lottery enterprise;”

2. To add Clause 3a after Clause 3, Article 24 as follows:

"3a. In force majeure case caused by natural disasters, epidemics, fires and other emergency according to the Competent State agency’s decisions that lead to the Lottery Supervisory Council failing to ensure adequate components as prescribed in Clause 2 of this Article, the computer-generated lottery enterprise shall be allowed to supplement the composition of the Vice President of the Lottery Supervision Council in the order of priority as follows: Heads of divisions and departments, Directors of branches; deputy heads of divisions and departments, Deputy Directors of branches of the computer-generated lottery enterprise.
