SUMMARY

108,000 tons of import tariff quota for sugar are put for pilot auction in 2021

Guidance on the pilot auction of import tariff quota on sugar in 2021 is provided in the Ministry of Industry and Trade’s Circular No. 03/2021/TT-BCT dated June 11, 2021.

To be specific, the volume of import tariff quota for sugar put for pilot auction in 2021 is 108,000 tons. The principles, order and procedures for property auction must comply with the law on property auction as suitable to the characteristics of property put up for auction. The Ministry of Industry and Trade shall form a Council for pilot auction of import tariff quota on sugar in 2021 to administer the auction.

Besides, the Ministry of Industry and Trade shall issue a written notice on assigning the right to use the import tariff quota on sugar to auction-winning traders after receiving the auction Council’s report on auction results.

This Circular takes effect from July 26, 2021 to December 31, 2021.

CIRCULAR

Guiding the pilot auction of tariff quota for sugar import in 2021[1]

 

Pursuant to the Government’s Decree No. 98/2017/ND-CP of August 18, 2017, defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;

Pursuant to the Government’s Decree No. 69/2018/ND-CP of May 15, 2018, detailing a number of articles of the Law on Foreign Trade Management;

Pursuant to the Government’s Decree No. 62/2017/ND-CP of May 16, 2017, detailing a number of articles on measures to implement the Law on Property Auction;

Pursuant to the Government’s Decree No. 151/2017/ND-CP of December 26, 2017, detailing a number of articles of the Law on Management and Use of Public Property;

At the proposal of the General Director of the Agency of Foreign Trade;

The Minister of Industry and Trade promulgates the Circular guiding the pilot auction of tariff quota for sugar import in 2021.

 

Article 1. Scope of regulation

This Circular prescribes tariff quota for the import of sugar (HS code 1701) and principles of pilot auction of tariff quota for sugar import in 2021.

Article 2. Subjects of application

1. Traders directly using sugar as raw material for production and traders using raw sugar to produce refined sugar.

2. Individuals and organizations involved in the import of sugar under the 2021 tariff quota.

Article 3. Sugar import tariff quota for auction in 2021

The volume of sugar imported under the 2021 tariff quota put for pilot auction is 108,000 tons.

Article 4. Principles of auction

1. The principles, order and procedures for property auction must comply with the law on property auction and depend on characteristics of to-be-auctioned property.

2. The Ministry of Industry and Trade shall set up a council for pilot auction of the 2021 sugar import tariff quota to administer the auction.

3. The auction council’s chairperson shall issue the Regulation on pilot auction of the 2021 sugar import tariff quota.

Article 5. Notification of the grant of the right to use quota

1. After obtaining the auction council’s report on auction results, the Ministry of Industry and Trade shall issue a notice of the grant of the right to use tariff quota for sugar import to auction-winning traders.

2. The use of the notice on the grant of the right to use tariff quota for sugar import to auction-winning traders to carry out customs procedures must comply with the customs law.

Article 6. Effect

This Circular takes effect from July 26, 2021, to December 31, 2021.-
